Treasury warrant to the Attorney General to enter a noli prosequi to the information against Capt. Kerrill Roffey and other the officers lately employed in his Majesty's ships of war upon the late Expedition to Newfoundland for landing part of the prizes taken by them therein, they having divided the said prizes according to instructions received for that purpose from the Admiralty Lords and on their being threatened with prosecutions relating thereto the King did by his sign manual of 1698 June 26 direct noli prosequi to be entered to them but several persons (designing to prevent the King's grace and favour to the said Captain &c.) have exhibited the said informations on the ground that the said prizes have not paid Customs: whereupon the Customs Commissioners have reported that the goods in question appear to have been of no considerable value, and that the prosecutors have been satisfied for their parts of the same. Royal warrant dated Kensington to the Attorney or Solicitor General for a great seal for a grant to Sir Thomas Cooke and John Cass (in consideration of 1000l.) of 7½ parts of 16 parts in the Brewhouse called the Phoenix in the parish of St. Buttolph without Aldgate several dwelling houses adjoining and utensils, the property of Sir John Freind lately convicted of high treason, he being possessed thereof in partnership with Anthony Sturt Esq. and Daniel Neale, brewer; and also of the goods and jewels of the said Freind which were in his lodgings at the time of his conviction; and also of the tenth part of the ship Modena: the said Freind being indebted to the said Cooke in 3600l. and to the said Cass in 1300l.: (marginal note: "the word jewels is interlined [in his warrant] in his Majesty's presence 13 March 1699–1700.") Directions under the King's sign manual to the officers, ministers and keepers of New Forest to apply themselves to the preservation of timber in said forest in accordance with the Act of Parliament for that purpose and in accordance with the Address to the King made by the Parliament (which assembled on 4th July 1698) for the same purpose: all on pain of the King's high displeasure: it having been represented to the King that great discouragement hath been given and coldness and indifference manifested by divers of the said officers and keepers towards the making of the inclosures and that divers persons have presumed to put their hogs to pannage and colliers have made coal hearths within the woods and covert of the said forest and the underkeepers permitted the same and several other evil practices are continued contrary to the said Act of Parliament. Hamilton's Regiment of Foot with necessaries amounting to 621l. 2s. 6d. which sum petitioners advanced to Cupper on an assignment to be paid out of the offreckonings of the said Regiment, but the Agent of said Regiment detains in his hands the tallies allotted to them: therefore praying relief. Feb. 14. Same to Lord Coningsby to pay 57l. 3s. 4d. to Lucy Fenwick, widow of Charles Fenwick, late of the Royal Regiment of Foot of Ireland under Col. Frederick Hamilton, for her husband's pay respited on the muster rolls of said Regiment for 245 days from 1690–1 Mar. 1 to 1691 Oct. 31 at 4s. 8d. a day, he having been during most of that time employed by the Lords Justices of Ireland as Governor of Macroom, a frontier garrison, where he did good service, and in assisting Judge Cox, Governor of the County of Cork. Treasury reference to the Excise Commissioners of the petition of John Byndlos, proprietor of salt works near Portsmouth, shewing that he sent up 5600 bushels of salt to the salters to be sold by weight which they would only buy by the measure which proved a considerable loss to him; that he is indebted 900l. to the King for salt Duty: therefore praying an allowance of 10 per cent. upon his paying the said Duty in ready money as the Act directs and some consideration for his loss in selling the same by measure. Stafford ever since the Revolution, shewing that one Woodward (whom petitioner employed for many years to make returns of moneys [by bills] for him) went off with 2841l. 5s. 3d. which petitioner has made good: therefore praying leave to sue in the King's name against 2 mortgaged estates of Woodward's out of which petitioner can recover said debt. Feb. 28. Royal warrant to the Clerk of the Signet dated Kensington for a privy seal for payment of a yearly allowance of 25l. to Anthony Marie D'La Croze, vicar of the parish church of Old Windsor, and to his successors vicars of the said church as in lieu and compensation for all tithes, as from 1698 Xmas, there being insufficient maintenance for the minister of said parish which is one of the largest in England, but the greatest and best part of Windsor Great Park is in the said parish for which he has no allowance either for the herbage of the deer or agistment of the cattle or from the persons living in the said park who have great stock of cattle, fruit and other tithable things and though the late Chief Ranger thereof paid him a sum in lieu of tithes, yet since his death nothing has been paid by the present Chief Ranger or by any other the inhabitants thereof. Same to same for a same for passing the accounts as follows of Dr. John Richards deceased (who was appointed to execute the office of Treasurer of the Chamber) for 1 year and 359 days from 1692 June 28 to 1694 June 24: all notwithstanding that the preceding accounts of the Treasurer of the Chamber [Sir Rowland Gwyn] are not before the Auditors for which reason the Auditor "could not examine whether the salaries mentioned in the [said Richards'] account now to be passed do commence from the times they ought; that the accountant craves allowance for payments agreed to be made in full of several bills and warrants part of which are alleged to be paid by Sir Rowland Gywn Kt. late Treasurer of our Chamber and the warrants and bills to remain with him; that the payments to our messengers were usually made according to the rolls delivered in by the clerk of the cheque to the said messengers but that no such rolls are now brought to vouch the same." The said accounts are hereby to be passed notwithstanding the absence of such prior accounts, rolls or vouchers, the King being well satisfied with the truth of the account. Further allowance of interest is to be made to the said Richards at 6 per cent. in the sum of 3219l. 13s. 3d. advanced by him which was to be repaid him out of the profits of the said Office and he has accordingly been so repaid the said principal and a further 133l. 5d. 0d. for interest "although it did not appear to our said auditor how the profits did arise by which the principal was paid, otherwise than by a paper delivered in by the accountants." He is further to be allowed 421l. 16s. 0d. for incident charges during the time of this account. Ibid., pp. 161–2.
