Aug. 11. Allowance by Treasurer Godolphin of the incidents bill, detailed, of the Excise Office for 1703 Lady day quarter : total 948l. 10s. 6¾d.
The like of the incidents bill, detailed, of the Malt Office for same quarter : total 239l. 2s. 3d. Money Book XVI, pp. 413, 414.

William Lowndes to the Excise Commissioners. I have read to the Lord Treasurer your representation of the 3rd inst. concerning officers of Excise who act by commissions granted under the late King. Since it is the Attorney General's opinion that those commissions determined by the King's decease notwithstanding the Act of 7 Wm. III. his lordship agrees to the offering of another clause to be passed in some Act in the next Sessions for confirming the said commissions, to save the trouble and charge of renewing same and the sureties thereof "which [as you inform his lordship] will be very great and difficult." Same dated from Windsor Castle to the Attorney General to report his opinion on the enclosed memorial [missing] which has been laid before the Lord Treasurer by the Commissioners for Prizes, touching the proceedings of the Admiralty Court at Lisbon in restoring a Neapolitan ship taken as prize by the Queen's ship Montague and carried into Lisbon. Please report your opinion thereon as soon as conveniently may be. Ibid.

William Lowndes to the Comptrollers of Army Accounts to report on the enclosed case [missing] of Thomas Brerewood, merchant, undertaker for clothing the Regiment of Dragoons which was intended to have been raised under the Duke of Schomburgh. Treasury reference to the Salt Commissioners of the petition of Thomas Clinton, collector of salt Duties for co. Devon, praying for allowance of the sum of 25l. which he repaid to a merchant for damaged salt "which he can produce a certificate for and that he may not be charged with interest for the time he had the money arising by the Duty of salt in his hands, he having never been called upon for it, though he was collector for some years last past, till some time after the establishment of the present Commissioners, he having never made any advantage thereof but keeping the same for security in an iron chest expecting every day to be called upon for it." Same to the Customs Commissioners of the petition of James Goodridge, master of the ship Four Brothers from Virginia, shewing that "coming home, putting into Virginia," his men were impressed into the Queen's service who had amongst them 17 cases of tobacco, 2 of which were admitted to an entry and the other 15 seized "by reason they had no boards at the end though they were all cased according to the Act" therefore praying for same to be admitted to an entry. Robert Gardner on behalf of the Regiments of Handasyde and Livesay now in Jamaica shewing that the Paymaster of Ireland has put a stop to the clearings of those Regiments because the muster rolls are not signed by the Governor and three of the Assembly there, which method being settled by a new Establishment the Officers had no knowledge of till after those musters were closed and transmitted : therefore praying that the Paymaster may be governed by those musters "which are done with all the nicety and honor imaginable." Same to the Customs Commissioners of the petition of William Willis shewing that all his bills, bonds and accounts and some annuities have been seized on account of a Customs debt, but that little hath or can be recovered for want of his assistance : therefore praying release from prison in order to so assist. Same by same to the Queen's Remembrancer for a commission under the seal of the Exchequer Court to Thomas Mitchell, William Burgoyne and Charles Eyre to enquire into frauds and abuses in the collecting of the public taxes in the city of Exeter and county of Devon by the assessors, collectors and others thereof. Same by same to John Parkhurst to allow 176l. 13s. 7d. in Robert Culliford's account as late Agent for Prizes at Southampton during the late war with France : said sum being for 100l. for salary for 2 out of his 8 years service from 1689 July 2 (when he was appointed Agent in the said port) and 41l. 13s. 7d. for 2½ per cent. commission for the remainder time "as all other Agents had" "he having proved that the said late Commissioners for Prizes promised him 50l. per an. salary at the taking out his commission," whereupon he is entitled to have the said salary allowed him until such time as the said Commissioners made application to the then Treasury Lords for reducing the charge of management of the Prize Office, which [period] was about 2 years and that from that time to the end of the said late war he [was to] be allowed a quantum meruit of 2½ per cent. ; and 20l. for the value of a moiety of the ship Protestant Cause with raw hides clandestinely imported from Guernsey which he seized ; and 15l. 12s. 0d. for the deficiency on a parcel of clipped money returned by him to London by order of the late Commissioners for Prizes. These allowances are to be made to him on his paying in the remainder of the balance of 256l. 6s. 4¾d. on his said account. Ibid., pp. 110-111.
William Blathwayt to Mr. [George] Larkin [Deputy Auditor of her Majesty's Revenue in the Leeward Islands thereto appointed Aug. 2 inst.]. I have received your letter from the Leeward Islands and am glad you got so well out of the hands of Capt. Bennet who has now written at large to the [Customs] Commissioners from whom you will hear very soon.
The occasion of this [letter] is to desire you to accept of my deputation [of you] as [my deputy] Auditor and Surveyor of the Leeward Islands, which your other place will the better enable you to execute. You will likewise receive Instructions herewith that your chief application will be to inspect the present accompts of the revenue and to act further in relation to them as your Instructions and my commission enable you. I have likewise received directions from my Lord Treasurer to examine in the best manner the enclosed petition and papers [all missing] of Mr. Chaplain's. I desire you to report the present circumstances of those estates and advantages which he petitions for. Please consult therein his Excellency Col. Royal warrant to the Attorney or Solicitor General for a great seal for a new Commission of Prizes : the new Commissioners to be Emanuel Scroop Howe, Edward Brereton, George Morley, Robert Yard, Anthony Duncomb, William Gostlin, Alexander Pendarves and John Anstis : with the salary of 500l. per an. each : Arthur Burnaby to be Secretary and Thomas Ryves to be Comptroller of Prizes with salaries of 400l. and 300l. respectively. Same to Edward Nicholas to pay to — Lestange 200l. as royal bounty for the use of the Society of French Gentlewomen at the Hague for one year to 1703 June 24 on the said sum in the list or schedule of bounties lately established by the Queen : and to pay same in future : the said Establishment having ordered same to be issued to Van Schuylenburg for said Society but he having declined to receive same. Same to the Clerk of the Signet for a privy seal to discharge the rent of 60l. per an. (and the arrears thereon as from 1697 Lady day) payable as follows by Sir John Parsons, Samuel Vincent (since deceased), Dr. Nicholas Barbon (since deceased), Edward Noell, Samuell Tooke (since deceased) and Henry Headley under the patent to them dated 1687-8 Feb. 18 for their undertaking for 31 years for insuring houses from fire, with a prohibition to all others (save the Friendly Society under certain restrictions) to make such insurances ; they having undertaken to pay said 60l. per an. to be distributed among the gunners and other servants of the Office of Ordnance as should from time to time assist them in extinguishing fires : which sum they paid for many years viz. until Lady day 1697 : but they now represent that the said Friendly Society have not only proceeded in making insurances contrary to the said patent but several other persons and societies have set up undertakings for and insured many houses against damages by fire contrary to the said prohibition and none of them have paid anything to the said gunners and the undertakers, petitioners herein, are advised by many learned Counsel that the said Friendly Society and other undertakers cannot be restrained from making such insurances by virtue of the said letters patent and that the grant thereby intended is wholly void and was so at the time of making thereof and petitioners have not nor can have any benefit thereof, and since the last payment of the said 60l. per an. have not required any assistance from the said gunners in extinguishing fire : wherefore they have desired to surrender their said patent and have so surrendered same by an instrument dated July 20 last : the substance of which petition is confirmed by the report of the Solicitor General thereupon viz. that the prohibition or restriction therein was void in law. Warrant by same to the Surveyor General of Crown Lands for a particular of premises ut supra p. 228 being lands called the Maison Dieu &c. at Dover in order to a new lease thereof to Sir John Williams.
Prefixing : said Surveyor General's report on said Williams' petition for such lease. Sir John states that he has more lands in his lease than he enjoys or knows where to find and Valentine Fagg his undertenant states that he does not enjoy a piece of arable land called Castle Dean alias Charleton Dean containing 16 acres and that he knows not of 2 closes lying nigh Buckland called Brocksditch and containing 7 acres. But Sir John confesses that the said Castle Dean hath long been in the possession of the Governor of Dover Castle and that Col. Strode, Lieut. Governor in 1679, paid rent for the same to his father but neither Sir John nor his tenant hath recovered any since. Ibid., p. 83.
