Prefixing : (a) order of the Queen in Council dated St. James's Sept. 6, for the payment to Silvester Stukely, merchant, sole owner of the Silvester galley, of 195l. 0s. 5½d. being certified as the nine tenths parts of the salvage of the ship King David : it appearing that Stukely fitted his ship out for a voyage to Guinea about the latter end of Oct. last and near the Start Point met and took into harbour the King David laden with corn which had been deserted by her master and all her men and was driving up the sea ; by which Stukely was delayed and his ship caught in the late violent storm and lost ; after which the King David was claimed in the Admiralty by some merchants of London who fully made out their property and had the ship decreed to them on payment of one fifth to the Lord Admiral for salvage, said fifth part being certified to be 178l. 14s. 0d. for the lading (appraised at 893l. 10s. 0d.) and 37l. 19s. 10d. for the ship (appraised at 189l. 19s. 0d.) : the said order in Council being made upon a report dated 17 Aug. 1704 from Prince George of Denmark as Lord High Admiral, based upon the opinion of Dr. Bramston, Surrogate to the Judge of the High Court of Admiralty. William Lowndes to Mr. St. John [Secretary at War] to prepare a royal warrant for charging 1444l. 10s. 2d. on the growing offreckonings of the Regiment commanded by the late Col. Brewer, being a debt for clothing : all in accordance with your report on the petition of Geo. Jenkins, executor to said Brewer.
Appending : said report. In 1695 said Regiment received a full clothing but having the misfortune to be taken prisoners at Dixmude the Colonel was obliged to make another clothing within the same year which was the occasion of a debt of 1669l. 17s. 6d., towards which the Commissioners for stating the Army [Debts] Accounts have certified 65l. 1s. 6½d. to be the remainder of the offreckonings applicable for clothing said Regiment for the time it was on the English Establishment and 159l. 11s. 4d. to be the offreckonings of the reduced and disbanded men, thus leaving 1444l. 10s. 1d. of which 958l. 10s. 7d. is by the said Commissioners assigned to Gabr. Glover and 213l. 19s. 6d. to Mr. Johnson out of the Colonel's personal pay. It ought to be charged on the growing offreckonings of the Regiment. Out Letters (General) XVII, pp. 443-4.
Treasury reference to Mr. Borret of the petition of Elizabeth Gellot, daughter to Col. Henry Washington deceased, shewing that her mother died about five years since and left to petitioner's daughter most of what she possessed, with the proviso for same to go to pious uses in case of her death before marriage : that said daughter is now dead and petitioner through many misfortunes is reduced to great poverty : therefore prays a grant of such part of said estate left to pious uses as the Crown can grant [as being a forfeit to the Crown by reason of such proviso of bequest]. William Lowndes to the bishop of Exeter. The Lord Treasurer returned not out of the country till last Saturday night. He will take the first opportunity of introducing the Dean of Exeter, with your address, to her Majesty as soon as the Queen is in town. He earnestly desires you to use your endeavours to hasten up the West Country members [of Parliament] that so the House may be able to go upon the great business of the ensuing session as soon as may be, my Lord being apprehensive that the fair weather may otherwise invite some of them to tarry longer in the country than her Majesty's weighty affairs in Parliament can easily admit. Same to the late Commissioners for Sick and Wounded of the petition of Bithiah Dowse widow, shewing that her husband was housekeeper to the said Commissioners and 71l. 5s. 0d. is due thereon : therefore praying payment, she having a large family and being very poor. Ibid., p. 119.
Report by Treasurer Godolphin to the Queen on the petition of Charles Hore praying a reward for discovering several abuses in the Victualling. I have received a petition from Richard and James Hore representing that they were equally concerned therein. In the address from the House of Lords relating to this affair they are all three named without distinction. The matter has been examined by the House of Lords and in accordance with their opinion I consider they deserve a reward of 300l. Warrants not Relating to Money XVIII, p. 344.
Entry of a Treasury caveat in behalf of Sir John Crew, Chief Ranger of the Forest of Delamere, co. Treasury reference to the Navy Commissioners of the petition of the old creditors (being near 400 in number) of the Navy shewing that upon a vote of the House of Commons the late Treasury Lords did by their order of 1702 May 5 see supra Tr. Cal. Vol. XVIII, p. 206, direct the Navy Commissioners to apply the deficient tallies on the second 2s. Aid [11 Wm. III, c. 2] amounting, with interest, to 14,333l. 6s. 8d. (which tallies they have received) towards satisfaction of their said debt, and that there remains 21,444l. to completely discharge the whole debt on the second book in course : therefore praying payment of the remainder out of moneys appointed for the present course of the Navy. Same to William Borrett of the petition of Paul, John, Mary and Francis Pigou shewing that about 18 years since their father and uncle fled to England from the French persecution and left an estate worth 15,000l. [in France] ; that they [the father and uncle] applied what money they had to the service of the Government in clothing several Regiments : that about 14 years since their brother James Pigou died intestate in London leaving about 1000l. "leaving your petitioners' father, his only brother, and Magdalen, the wife of Peter Bouxin merchant, his sister and James Baron only son of Henry Baron" et al : that the said Baron is now suing the petitioners for his share of the 1000l. ; but, as he is a Papist and is in France an enemy to England his share belongs to the Crown : therefore pray a grant of same. Royal warrant, dated Kensington, to the Earl of Ranelagh late Paymaster General of the Forces to make out debentures for payment of three articles amounting to 994l. 4s. 7d. as petitioned for in the demand of Robert Livingston : he having petitioned setting forth that he is entitled by warrant and commission from Wm. III to several sums out of the revenue of the Province of New York amounting to 2016l. 4s. 7d. sterling, but that for want of due payment of the Forces in that Province the revenue which was intended for petitioner's satisfaction was applied to defray the Contingent charges of the said Forces and Fortifications : but that by a clause of an Act of the last Session [2 and 3 Anne c. 17 for punishing mutiny § 56-7] the payment of the arrears due to the said Forces was authorised to be made and thereafter the surplus of the 30 per cent. exchange profit on money of the province (after satisfaction of the Officers &c.) was to be issued to such persons as the Queen should adjudge to be duly entitled thereto : which surplus amounts to 2498l. 17s. 4d. : and on his said petition William Blathwaite has reported that there ought to be paid to petitioner the sums of 678l. 14s. 5d. sterling or 882l. 6s. 8¾d. New York money for interest of money by him lent and advanced for the use of the Forces ; and 52l. 17s. 8d. sterling or 68l. 15s. 0d. New York money to make up his salary of Commissary of Provisions to 1700 Nov. 1 he having performed that service ; and 262l. 12s. 6d. sterling or 341l. 0s. 4d. New York money for 8 per cent. interest (being the usual rate of interest in New York) on 853l. 10s. 9½d. New York money (or 656l. 11s. 4d. sterling) disbursed by him for provisions furnished between 1st May 1698 and 26 March 1699 which interest petitioner computes from 1699 March 26 when the principal sum became due to him, as by a report of the late Treasury Lords to Wm. III : and further that the said surplus amounts in all to 2991l. 4s. 1¾d. whereof the late Commissioners of the Accounts [Debts] of the Army &c. have certified 533l. 10s. 1¼d. to the several Officers directed to be satisfied out of the same and for which the debentures are issuing to them accordingly ; thus leaving 2457l. 14s. 0½d. surplus of said 30 per cent. still disposeable. William Lowndes to the Principal Officers of the Ordnance. In reply to your memorial of the 19th ult. it is the Lord Treasurer's pleasure that although the 2787l. 5s. 11d. paid into the Exchequer by Mr. Bertie (for the balance of his account to 1699 June 30) was re-issued to him in part of the proportion for Land service of the Ordnance, anno 1704, yet you may apply same as you think convenient for the service of your Office. But you must expect that the quota to the Ordnance for this year will be deficient by more than that sum.
His lordship desires particulars of the persons set in super in the accounts of the Ordnance in whose behalf you desire stay of process. Disposition Book XVII, p. 154.
Same to the Agents for Taxes. The Lord Treasurer approves of your agreeing with Benjamin Mathews, late Receiver General for the Counties of Northampton and Rutland, to pay 2000l. forthwith and 100l. in each succeeding month till his whole debt be satisfied. Out Letters (General) XVII, p. 442.
Same to the Commissioners of Prizes. I have read to the Lord Treasurer your report of the 3rd inst. on Visct. Dursley's case relating to the ship Sardinacious taken by him at Newfoundland. As the prosecution against him relative to said ship appears grounded on a false report you are to cease further proceedings. Ibid. XVIII, p. 5.
Treasury reference to the Agents for Taxes of the petition of Baldwin Malet, late Receiver General of Taxes for Somersetshire, shewing that upon Mr. Brawn's death he was appointed to receive the remainder of the fifth 4s. Aid and has overpaid 3000l. thereon and 700l. on the Subsidies but cannot clear his account thereof because Mr. Brawn's executors refuse to clear their part : therefore prays that process may issue against them to clear their account, and that said overpayments may be transferred to [said Malet's account of] the sixth 4s. Royal warrant to the Lord Lieutenant of Ireland to hear Robert Feilding and Lord Bophin and to ascertain what remains unpaid of the 25,500l. (claimed by said Feilding as administrator to Margaret, Viscountess Purbeck) ut supra pp. 293, 294 and what share thereof ought to be paid out of the share of Lord Bophin's estate vested in the Crown.
