His Majesty has commanded my speedy return to Portugal and that amongst other things I should solicit the portion of the Queen's dowry which is still in arrear. Therefore I desire a statement of said arrear and of the difficulties likely to be made by reason of the extreme wants of that kingdom. (Sir Robert Long certifies that there has been paid into the Exchequer and issued thence 157.351l. 3s. 8d. of the Queen's portion.)
ii. The first claim for defalcations is likely to be about the houses of Tangier, in which if the treaty of marriage were to be the only rule they could perhaps pretend to very little as will appear from the 3rd and 4th articles of the treaty and the report presented to the King by the Commissioners of Trngier on this point. But having heard that His Majesty had determined the controversy in favour of the Portuguese I do upon enquiry find some footsteps thereof in an instruction to the Earl of Teviot and in an answer formerly given to a memorial of the Portugal Ambassador, but I cannot fully learn what Sir Richard Fanshaw did in Portugal because his books and papers are out of town. I am inclined to believe that (besides the matter of fact that many of them did actually sell their houses to the English) they will be able to shew some authentic declaration from His Majesty that these houses are to be paid for out of the Queen's dowry. So that the dispute is most likely to fall about the computation of the value. Desires advice herein.
iii. The Portuguese also press for an allowance for the artillery of the garrison. The third article of the marriage treaty gives them liberty to take away such cannon as can be spared from the defence of the place and I have Lord Peterborough's declaration that all the cannon left behind were little enough for the defence. (We conceive this a good answer; for the Governor now sends for 30 cannon more for the defence of the place.)
iv. They have urged that there was a troop of Portuguese horse received into His Majesty's service. Lord Petarborough affirms the contrary, and only admits that the troopers not being able to have embarcation in our men-of-war for their horses some who could not sell them left them behind in the town, perhaps to the number of about 40. So that now the demand can only be founded on the refusal of embarcation, which we are obliged unto. Therefore desire advice. (The Earl of Sandwich can only speak to this, unless Sir John Mennes can say anything to it.)
v. It appears by His Majesty's answer to a memorial of the Portugal Ambassador that the King did allow that the English forces should for three months after their arrival have some supply out of the dowry. (What was paid to the King's Ambassador ought to be allowed.
vi. His Majesty did at another time give the English forces a donative of 40,000 Crusadoes out of the dowry. (If the King's order and their execution of it appears, then to be allowed.)
vii. There was a ship laden with victuals sent once by the King of Portugal to relieve the Garrison of Tangier when it was in distress. (If they produce the receipt of an officer of Tangier for it, and that they were not paid for it, then to be allowed.)
viii. There was about two years since an Ostender seized by a Portuguese man-of-war and brought into Portsmouth, and because most of the goods belonged to the Canary Co. his Majesty detained them and ordered the value to be received out of the dowry. (If the valuation of the goods and order of payment appear signed by the King or Secretary of State, to be allowed, otherwise not.)
ix. Several other particulars will be objected touching assignations on the residue of the dowry and sums of ready money paid out of it.
x., xi. The [Portuguese] coin is, since the Queen's marriage, raised a fifth part, so that a Crusadoe (having but a new figure stamped on it is now five Testoons. Since Crusadoes are named in the treaty am I to insist on the original value of them. (We suppose the King ought to have Crusadoes in specie or else in value [after the same rate of coin value] as when the articles of treaty were made.)
xii. Presuming the amount of the arrear to be settled I desire orders as to the disposal thereof. (If ready money may be had then let it be shipped home in specie; but if none, then let him insist on the best sort of assignations that can be obtained; and if herein there fall out also such difficulties as cannot be overcome he is left to such further instructions as the Secretaries of State shall give him.)
xiii. The Portuguese may object the promise inserted in the 8 and 9 articles of the treaty, as a consideration for the dowry, that a settlement of 30,000l. a year should be made on the Queen. which they think has not been complied with. (Her family [household] is settled as amply as can be desired and 23,000l. per an. in lands; she is supplied in money more than [sufficient to make up] 30,000l. [per an.], and we are passing 17,000l. in lands to complete 40,000l. per an.)
xiv. I am commanded in case of great exigencies to relieve His Majesty's forces in Portugal out of such money as the Treasury shall give me credit for. (Care is taken to own [honour] a bill not exceeding 600l. Alderman Backwell is spoken to about it, and will accept it.)
xv., xvi. I desire payment of my extraordinaries of 760l. odd and some advance for equipage.
