Treasury reference to the Customs Commissioners of the petition of William Paul and Christopher Clitherowe, executors to John Paul, shewing that as executors they are entitled to the Duty of Prizage in London port and a doubt arising whether Prizage Wines ought to pay the new Subsidy of Tonnage granted 9 Wm. III c. 23 the petitioner Paul to settle the point brought his action against one Mr. Cook (with whom the Duty was deposited) and a special verdict being found the Court of Exchequer were divided in opinion and before any determination the said Cook died whereupon a new action was brought against Sir John Shaw to settle the question and a special verdict found but the action being brought in both the petitioners' names the name of Clitherowe was by mistake omitted in one place of the Declaration and an addition made to the former Declaration by expressing the money in the Declaration mentioned to be received for the Duty of Prizage before then granted: and exception being taken by the Solicitor General the cause was no further argued: therefore praying that the Attorney General may consent to an amendment by adding Clitherowe's name and striking out the said words. Appending: (a) an undated paper delivered to Mr. Lowndes by Mr. Guicciardine Wentworth. “Mr. John Horncastle obtained a letter of recommendation dated 24 August 1705 signed by Mr. Lowndes to the [Revenue] Commissioners of Ireland for an employment in the revenues there. Mr. Keightley says they have lately discovered divers letters from Mr. Lowndes without his Lordship's knowledge: questioning this, but desires 3 lines under his Lordship's hands and it will be enough.” Out Letters (Ireland) VIII, p. 416.
October 19. Royal warrant dated Kensington to the Lord Lieutenant of Ireland to clear the Regiment of Col. Luke Lillingston to the day of their embarcation; it having been ordered to be filled up to 300 effective privates and thereupon to be transported from Ireland to the Leeward Islands. Ibid., p. 417.
Same to same to insert and add again to the list of French pensioners on the Establishment of Ireland the Officers and allowances as follows: by reason that the royal order of Mar. 24 last directed that the Officers of the 6 French Regiments of Foot and the French Regiment of Dragoons (then ordered to be raised in England for service abroad) should be taken from the French pensioners in the Irish Establishment and be cleared their arrears of pensions to the 25th of that month and should further receive a bounty of 3 months on their respective pensions to enable them to repair to England and enter the said service: pursuant whereto divers such Officers were struck off the Irish [pensions] Establishment: but after forming the said Regiments and sending them on board the Fleet they were found to be very weak as to their numbers of private men so that it was thought fit to reduce the Officers of 3 of the Regiments and to incorporate the non Commission officers and soldiers thereof into the other 3 Regiments: whereby the said Officers are become destitute of maintenance: and likewise others of the said Officers were found by age or infirmities to be unfit and have desired to be restored to their former pensions.

Same by same to the Wine Licence Commissioners to discharge Edward Themylthorpe from a debt of 278l. 15s. 0d. on payment of 150l.: he having been employed about 20 years since to make contracts in the city of Norwich and counties of Norfolk and Suffolk with certain persons to retail wine there and did make several contracts accordingly, the last about 14 years since; and also to collect the rents due from the tenants who had taken licences to sell wines and to prosecute people who refused to pay or who sold wine without licence and to manage other business relating to the said [Wine Licence] Office wherein he took much pains and greatly advanced the rents belonging to the said Office: but having taken out several of the said licences and himself entered into contracts as security for the said tenants several of whom became insolvent, whereby he is charged with said debt. Warrant by Treasurer Godolphin to the Customs Commissioners to pay 500l. to Samuell Eyre upon his redeeming, and bringing into England, Thomas Sandwell, a prisoner in France.
Prefixing: report by said Commissioners on the petition of said Sandwell, master of the ship Swallow, and said Eyre owner thereof, said petition setting forth that said ship was let to freight many months since to Ezekiel Hall of London merchant to proceed to the Madeiras and back to London with wines but in her passage was taken by the French and said Sandwell to secure the ship and cargo did become a ransom for same for 1000l. sterling and agreed to remain in France till it was paid and was conveyed to Dinant many months since where he has remained prisoner upwards of 2 years and likely to perish unless relieved but the ship and cargo thereon released has since arrived in London and Eyre and Hall agreed as to meeting the charge of Sandwell's ransom but the ship and cargo are seized on an extent on a statute of bankrupt against said Hall on a debt to the Crown of 3317l. 4s. 10d. on wine bonds, for which he has absconded, and the said extent has produced 1307l. 0s. 2d. for Customs and 256l. 6s. 0d. for Excise. October 23. Treasury reference to the Excise Commissioners of the petition of Richard Richards of Saltash co. Cornwall, maltster, praying to be remitted a fine of 50l. for suffering another person to brew in his vessels. Reference Book VIII, p. 243.
Warrant by Treasurer Godolphin to the Prizes Commissioners to adjust the account of Ellis Tirrell, agent for prizes at Lisbon, Sir Lambert Blackwell, same at Leghorn, and Collin Campbell, late same at Newfoundland and now a prisoner in France, making them reasonable allowances for expenses notwithstanding the non production of the usual vouchers for such expenses, which in the case of the first two is not practicable by reason of the custom of those countries and in the case of the last is due to the French having burned the said Campbell's books and papers when that island [Newfoundland] was last invaded and taken by them. The said allowances are not to be higher than merchants in business of the like nature have usually been charged with. Warrants not Relating to Money XIX, p. 567.
Same by same to the Auditors of Imprests to prepare a royal warrant to allow the sum of 32,043l. 6s.d. to Charles Fox in his account, as late Paymaster of the Forces Abroad, from Xmas 1702 to Xmas 1703 to wit as loss by the difference of the exchange on the bills for the remittances of money as between the rates at which drawn and the rates at which the Forces were directed to be paid: the Lord Treasurer being satisfied by inspection that the said rates at which the bills were drawn are agreeable to the contracts which from time to time were made at the Treasury: and further similarly to allow to said Fox all such further sums as are directed by relative minutes of the Lord Treasurer as follows.
Prefixing: report to the Lord Treasurer from the Comptrollers of Army Accounts and Edw. Harley, Auditor of Imprests, on the state of said account with the minutes of the said Lord Treasurer thereon in the margin. (1) The payments to the Foreign Troops forming part of the 40,000 men and 10,000 additional men are according to the full numbers without warrants or muster rolls which neither in this nor in the last war were taken more than once a year for these foreign Forces and when taken none of them were ever transmitted to said Fox; nor does it appear with whom they were lodged when taken. These payments amount to 368,372l. 12s.d. (Treasurer Godolphin's marginal minute ”to be allowed by privy seal reciting the Treaties pursuant to which these payments are made). In the case of the Lunenburghers the accomptant produced the general warrant which directs a certain sum payable every 6 weeks according to the Establishment, “and in our opinion this had been the most regular method if they had followed it in the rest of the corps.”
(2) The payment for extraordinaries, waggon money, forage, levy money, transports &c. to the said Troops appear to have been made pursuant to like Establishments upon certificates (either from Monsieur Slingeland, Secretary to the Council of the States General or Mr. Vanellemeet, the States Treasurer for the said Forces) “of the like sum paid by the States General for their moiety of the same. And these certificates with the Treaties appear to be the only rate they have gone by in these cases.” These extraordinaries amount to 129,086l. 17s.d. (To be allowed by privy seal).
(3) There is no account of the 7499l. 19s. 10¾d. paid to the General [Marlborough] himself for Contingencies. (”Speak with Mr. Cardonell to know if any account be kept of this.” “Mr. Cardonel says this sum was expended for such Contingencies as vouchers could not be taken for.")
(4) The several payments for subsidies to the King of Denmark, Landgrave of Hesse, Elector of Treves and the Circle of Swabia amounting to 77,646l. 6s.d. were made pursuant to the Treaties with those Princes and acquittances are brought by the accomptant for the said sum, which may be allowed by royal warrant. (To be allowed by privy seal).
(5) For the 2000l. paid to Sir William Robinson for the transporting of 2 Regiments from Ireland to Holland a report from us relating to the method of discharging this lies before your Lordship. (It must be set in super [on said Robinson] if he has not accounted for it already).
(6) As to the 13,723l. 7s. 0d. which was paid to the King of Portugal (for the Queen's proportion of the ordinary pay of those Forces from 1703 Nov. 1 to Dec. 31) before the arrival of Mr. Morrice, the [Deputy] Paymaster of those Forces, both Mr. Methuen, the Ambassador, and the said Morrice have signed an account for the receipt of said pay from 1703 Nov. 1 to 1704 July 31. As this account is agreeable to the Treaty the sum may be allowed by royal warrant. (If these payments are agreeable to the Treaties they are to be allowed).
(7) The sum of 18,503l. 11s. 0d. remitted to Mr. Methuen for buying horses for remounting the Horse and Dragoons is acknowledged by him but cannot be allowed without royal warrant and must be set in super on Methuen. (Approved).
(8) The loss by exchange amounts to 32,043l. 6s.d. on bills amounting to 974,312l. 0s.d. for the 40,000 men, the 10,000 men, the Portugal men and the Circle of Swabia, and Mr. Sweet charges himself with every particular bill in his original accounts taking credit at the foot thereof for the difference between the price of the bills and the 10 guilders 15 stivers per £ rate at which he was directed to make all payments [to the Troops] there. (My Lord takes notice that different accounts are jumbled together in this sum. Let Mr. Taylour [in the absence of William Lowndes] examine the agreements so far as any were made for the rates of exchange: and when the loss is settled it is to be allowed by privy seal).
(9) The sum of 5134l. 14s.d. for fees on the receipt of 1,232,331l. 7s. 11¾d. at the Exchequer at 1d. per £, being the rate settled by Act of Parliament, may be allowed by royal warrant. (To be allowed by privy seal).
(10) The accomptant craves 93l. 5s. 6d. for charges of privy seals and 251l. 1s. 4d. for repairing and furnishing the house wherein he kept his office and 32l. 10s. 6d. for carriage of money from the Exchequer. (The first two items allowed, the last item disallowed).
(11) As to the 2300l. remitted to the Duke of Marlborough to pay Foreign Troops in consideration of their pretensions for sick and wounded men, Mr. Cardonell says that Mr. Sweet will have the proper vouchers and warrants to discharge it. Royal warrant dated St. James's to the Clerk of the Signet for a privy seal for making allowances, detailed, in the account of Sir Edward Seymour as late Treasurer of the Navy as follows: viz. certain orders dated 1671–2 Feb. 26 on wines and vinegar in the name of Sir Thomas Osborne [now Duke of Leeds], then Treasurer of the Navy, for in all 189,100l. 9s.d. for navy debts owing before 1668 Dec. 31 and certain other orders dated 1671–2 March 7 in the name of the same for in all 265,368l. 19s. 2d. were by authority of a privy seal of 1676–7 Feb. 21 transferred to Sir Edward Seymour, then Treasurer of the Navy, all the said orders being then unpaid to the amount of 452,930l. 1s.d. except one order for 1539l. 7s. 0d. assigned by the said Osborne to Capt. John Miller. By certificate of the Auditor of the Receipt dated 1704 Dec. 22 it appears that all the said orders amounting to 452,930l. 1s.d. remain on the register unsatisfied in the name of said Osborne except 420l. assigned by Sir Edward Seymour to Robert Reeves, leaving 452,510l. 1s.d. unsatisfied and unassigned. But the said orders are lost or mislaid and cannot at present be found but said Seymour has made oath that he has not assigned any thereof and that if same be found he will deliver them up to the Auditor of the Receipt to be vacated, and both he and the Duke of Leeds have by deed dated Oct. 24 inst. assigned and surrendered to the Crown the said sum of 452,510l. 1s.d. and all interest therein. Allowance is therefore hereby to be made of said sum in said Seymour's account as late Treasurer of the Navy.
