My Lord Treasurer has read the enclosed report [missing] of the Auditors of Imprests on the petition of Sir Thomas Clarges, bart., and Walter Chetwynd praying directions to Mr. Holbech to pay over to the executors of Lord Fitz Hardinge the fees or poundage received by him [Holbech] on payments to her late Majesty's servants in the Office of Treasurer of the Chamber, the petitioners alleging that the executors are entitled to same by said Fitz Hardinge's will. Oct. 2. Fiat by Treasurer Shrewsbury for royal letters patent to appoint Thomas Archer as Comptroller of Customs in Newcastle port loco Francis Brydges, Esq., deceased. (Warrant dormant dated Oct. 24 to the Customs Cashier to pay 20l. per an. salary to said Archer for said office: followed by: two later Treasury renewals dated 1714–15 Jan. 26 and 1717 May 22 thereof.) Oct. 3. William Lowndes to [? the Attorney and Solicitor General]. My Lord has received the enclosed letter from the Navy Commissioners upon an information by John Lee and Charles Maugridge against Capt. Francis Hosier, late Commander of the Salisbury, with an abstract of the several species and quantities of goods which they accuse the said Captain of taking on board his said ship and trading therewith in several ports of the West Indies (for which you will see by the enclosed copies from the Admiralty he has already been censured and fined by a Court Martial). Please report what you think fit to be further done for recovering his Majesty's Duties and effectually preventing such practices for the future.
Appending:: (1) the Navy Commissioners to Mr. Lowndes dated Navy Office 1714 Oct. 4. In obedience to yours of the 28th ult. we advertised in the Gazette and this morning one John Lee and Charles Maugridge brought us a paper concerning Capt. Francis Hosier's trading to the West Indies when he commanded his Majesty's ship Salisbury. They acquainted us that he had been tried for dealing in merchants’ goods contrary to his instructions and fined six months' wages.
(2) Certificate by the Admiralty Lords, dated Admiralty Office 19 Aug. 1713. At a Court Martial held at the Nore by Sir Edward Whitaker, Vice Admiral of the White Squadron, on board the Dreadnought the 13th inst., Capt. Francis Hosier, late Commander of the Salisbury, was fined six months’ pay for trading to several ports in the West Indies in the year 1712.
(3) Capt of the said Court Martial.
Present: Sir Edward Whitaker, Kt., Vice Admiral of the White Squadron, President; Captains Tudor Trevor, W. Cock, Geo. Saunders, John Carleton, Richard Thompson, B. Raymond, W. Heriot, Charles Constable, William Clarke, William Ockman, William Houlding, Francis Drake, Geo. Gordon, Thomas Jacob, William Collier, J. Pulley, R. Girlington, Edward Falkingham.
The complaint of John Lee, late midshipman on board the Salisbury, against Capt. Fra. Hosier, late Commander of the same, for taking merchants’ goods on board the said ship and trading with the same in several ports in the West Indies, having been laid before the Court and several witnesses having been examined thereupon it doth appear to the Court both by the deposition of the witnesses and by Capt. Hosier's own confession that he did take some parcels of goods on board at different times and trade with the same to some ports in the West Indies: and it is the unanimous opinion of the Court that Capt. Hosier by so doing has acted contrary to the 140th article of the General Instructions given to all the Commanders of his Majesty's ships of war. But in regard that Capt. Hosier has laid before the Court the orders which he had from the Commanding Flag in the West Indies to proceed to the several ports at which he touched and that he has satisfied the Court he was obliged to take some small goods on board with him to make presents or to sell to the Spaniards to procure him a free access to the inhabitants of the country and thereby to get better intelligence of the enemy, which had so good effect that he took two of the enemy's ships out of the port of Santa Martha, and whereas it further appears by the examination of the officers that she never was so pestered with any goods but that she was always ready to be put immediately into a condition of fighting in case of meeting with an enemy, the Court therefore in consideration of the abovesaid reasons do only think fit to fine the said Capt. Hosier for this his misdemeanour six months’ pay for the benefit of the Chest of Chatham.
(4) An abstract by John Lee and Charles Maugridge of the whole trading of Capt. Francis Hosier whilst in the West Indies (: to wit)
May 1711. At Madeira, wines taken: sold at Jamaica.
May 1712 and July 1712. At Port Royal, flour, soap, tobacco, sugar: sold to Spaniards upon the main Continent of new Spain at the Grand Beico [? Boca Grande], Carthagena and Girebay [? Caribana].
Sept. 1712. At Port Royal, 12 negro slaves: sold at Petty Gravis [Petit Guavas].
Nov. 1712. At Port Royal, flour, beef, herrings: sold at Petty Gravis, and 1,000 pound [weight] of Indigo taken on board.
Dec. 1712. At Port Royal, negro slaves, flour, sugar, butter, cheese: sold to the Spaniards at Gire Bay; 30 casks of flour sold upon the main to a French Guinea man.
Feb. 1712. At Port Royal, woollens, linens, wax: sold 20 negro slaves off Petty Gravis.
Note: Capt. Hosier brought home in the Salisbury from Donna Maria Bay about 7,000 pound weight of indigo, the same being the purchase [price] of the 20 negroes aforementioned, at which time Lieut. Duran (who had been carried to Jamaica in the Salisbury as security for the purchase money for the slaves) was released after having been six weeks on board the Salisbury: the said 7,000 pound weight of indigo being entered as prize goods to defraud her Majesty's Duties at Chatham Custom House was seized on and brought to London, information being exhibited against the said goods. But we are informed that Capt. Hosier hath got the said goods from out the Custom House at London without any legal or lawful delivery. Out Letters (General) XXI, pp. 281–3.
