Treasury reference to the Customs Commissioners of the petition of John Graves (since 1696 collector of Customs in the Bahama Islands) shewing that in 1703 and 1704 the French and Spaniards plundered the island of New Providence, where he had two houses burned, was plundered of all his own [money] and 100l. of the Queen's money then in his hands: alledges great services in preventing clandestine trade and that he has undergone great hardships from the inhabitants as well as the enemy: therefore praying to be relieved in the said 100l.and to have his services and sufferings considered. Jan. 4. J. Taylour to the Barons of the Exchequer, Scotland, to report on the enclosed memorial [missing] of James Erskine of Grange for a charter of the lands and barony of Preston. The Treasury Lords think it necessary they should be informed of the nature of the grant before they can offer it to be signed by the King. They therefore desire you to certify that it contains nothing but what is usual and fit for his Majesty to grant.
My Lords desire you to lay before them at the same time such rules and methods as you shall judge necessary to be observed in all time coming for the more regular applying for and passing of signatures in Scotland. Out Letters(North Britain) III, p. 281.
Royal warrant dated St. James's to the Attorney or Solicitor General for a great seal to re-constitute John Parsons to the office of Comptroller of Excise and New Imposts in Scotland: during pleasure: with the fee or salary of 350l. per an. for himself and clerks: being the office granted to him by Queen Anne: whose patent is hereby revoked. I have lately received an account of the public revenues of Massachusetts Bay, as also one year's accompts of his Majesty's revenue of quit rents and 2s. per hogshead arising in Virginia to 1714 April 25. Royal warrant dated St. James's for a patent under the great seal of Scotland to re-constitute John Phelp and Robert Arbuthnot to be Auditors of his Majesty's Revenues, Aids, Taxes and Casualties in Scotland during pleasure: being the office to which they were constituted by commission [which is hereby revoked]. In consideration of their salary settled on them by letters under the privy seal of Scotland they are hereby strictly charged and commanded not to take any fee, reward or gratuity from any accomptants whatsoever for any matter or thing relating to their accompt. This patent or commission is to pass the seal of Scotland (appointed by the Treaty of Union to be kept in place of the great seal of Scotland) per saltum without passing any other seal or Register: “ for doing whereof these shall be to the Director of our Chancellary for writing the same and to the Keeper of our said seal of Scotland for causing the seal to be appended thereunto a sufficient warrant.” Out Letters (North Britain) III, pp. 284–5.
The like to re-constitute William Bowles to be Solicitor in all matters and cases relating to debtors and accomptants to the Crown in Scotland except those under the conduct of the Solicitor of Customs and Solicitor of Excise there: and to take care that they be duly prosecuted until they have finished and fully discharged the same: with the salary of 80l. per an. Treasury letters patent constituting James Sadler to be Inspector and Examiner of Outport Books, to examine the Books of the patent officers of all the [out] ports of England, Wales and Berwick loco Richard Holmes, whose constitution dated 1712 June 24 and 1713 Sept. 22 from the late Lord Treasurer Oxford is hereby revoked: all by reason that it was some time since represented that the parchment books annually issued out of the Exchequer Court, commonly called Port Books, had not been duly and regularly kept and returned into the said Court by the patent officers of the said ports so that no regular account of the Customs had been found upon record in the said Court and the Comptroller and other officers of several of the outports or their deputies (whose business it is chiefly to be a cheque upon the collectors) had been remiss in making exact and due entries of goods in the said Books: for which reason the said Holmes was constituted to inspect the several books &c. of the officers of the ports of England and Wales and to compare them together to see that the entries are duly and regularly made therein and to take care that the same be duly returned into the Exchequer Court.
[The Port Books were the source from which were compiled the statistics of Imports and Exports; and the attention of Parliament had been specially drawn to them in July 1713 in connection with the trade treaty part of the Utrecht Treaty negociations. By special clauses in some of the Acts of every Session of Parliament for many years past where Lottery tickets have been burnt, lost or otherwise destroyed, the persons to whom they belonged have been intended to be relieved upon making affidavit before you of such loss and on producing to the Paymaster of such tickets a certificate from one of you of such affidavit and upon giving security to indemnify the Paymaster. The Treasury Lords have read a report made to them by Mr. Arnold, late Paymaster of the Malt Lottery tickets, on a petition of Matthew Kirwood, relating to some of those tickets so sworn to be lost. I am to enclose you a copy [missing] thereof for your consideration. My Lords desire that you will please to be very strict in your examinations where any such affidavits shall for the future be made so as you may be well satisfied of the truth of such loss before granting any certificate.
