Jan. 11. Charles Bertie [to the Customs Commissioners] to include the solicitor's bill of charges in the new bonds which are to be taken from Mr. Stockdale and his securities : but the sum due for Coinage duty is to be paid presently. On the new securities being completed by Stockdale and Dent and Stockdale and Arnold, the old bonds are to be given up. Out Letters (Customs) III. p. 258.
Jan. 12. Report to the King from Treasurer Danby on the petition of Maurice Keating, of Narraghmore, co. Kildare. Said petition sets forth that by a clause in the Act of Settlement, Ireland, he was to enjoy all lands purchased by or in trust for his father before 1641, Oct. 23, from John Carol, Esq., if the Lord Lieutenant and Council on hearing the parties concerned should adjudge same accordingly : that thereupon petitioner represented by petition to the Duke of Ormonde that his [petitioner's] father in July, 1641, purchased of said Caroll for 1,500l. the fees of Ballybritt, Lissenerin, Rosnefaghnee, Glascloone, Ballyphilip, Garranfinather alias Finchehor, and Ballinlough, making the purchase in the name of one Semper, being unwilling to merge the same : that thereupon the said Lord Lieutenant and Council decreed that petitioner should have said lands, and the Commissioners of the late Court of Claims allowed the title, but could not grant a certificate for the same, the power being lodged in the Chief Governor and Council by the Act. Therefore in his present petition he prays a letter to the Lord Lieutenant to pass a patent of said lands to him. Said petition being referred to the Lord Lieutenant July 1 last, said Lord Lieutenant reported hereon Oct. 16 last, allowing petitioner's statements and advising a grant accordingly at some small increase of rent, viz., 20s. per an. over and above the 3l. 7s. 7d. rent already payable. To this report Treasurer Danby hereby agrees. Warrants not Relating to Money VII. p. 23.
Warrant from Treasurer Danby to the Barons of the Exchequer to take the securities of John Holman as collector of Newcastle port, he having the reversion thereof after William Burrough who is lately dead : said securities being William Burrough, of Burrough, co. Leicester, Thomas Eldred, of London, woollen draper, and Richard Holman, of London, mercer. Warrants not Relating to Money VII. pp. 23-4.
Same from same to the Surveyor General of Crown Lands for a particular and ratal of lands, as below, with a view to re-grants thereof to Sir John Coryton, as by said Coryton's petition referred to said Surveyor General, Sept. 21 last and entered in the Letter Book, p. 229. [This Letter Book is missing]. The present re-grants are to pass without fine.
Prefixing : Said Surveyor General's report dated 1676, Dec. 2, on said petition. In 1661 a lease of Kerrybullock Park, parcel of the manor of Stoke Climsland and of the Duchy of Cornwall was granted to Francis Buller, Esq., for the life of William Coryton (son of said Sir John), after the death of John and Anthony Buller (surviving lives in a former lease) and under the ancient rent of 8l. 2s. 0d. and 12l. de incremento for the last life only. Said lease was assigned to petitioner 1662-3, Mar. 6. Also in 1660 a lease was granted to petitioner of woods called Wareham and Greenscombe Woods for 31 years from 1660, Mich., at one entire rent of 12l. 3s. 0d. per an. (being 8l. 3s. 0d. old rent and 4l. increase). By the Parliament's [Commonwealth] Survey Kerrybullock Park contained 465 acres, valued at 80l. per an. ; by Sir Rich. Prideaux [however it was estimated at] 450 acres at 60l. per an., and by several inhabitants of the parish of Stoke Climsland it is valued but at 41l. per an. On this item I advise re-grant on surrender (John Buller being dead) at a fine of 104l. according to Sir Richard Prideaux's survey, which is the lowest [valuation] in my custody. If the certificate of the inhabitants is credited then the fine may be reduced to 80l. The composition for taking off the increased rent of 12l. per an. for one life after a life in possession is three years' purchase or 36l. As to Wareham and Greenscombe woods they are certified to contain 218 acres, valued by the Parliament's Survey at 30l. 4s. 0d., and by Sir Prideaux at 32l. 14s. 0d. per an., including the rents. But the inhabitants of Stoke Climsland value them but at 9l. per an., which I cannot give credit to. To turn the present estate into three lives (the clear yearly value by the lowest survey being 22l. per an. above the old rent) I advise a fine of 66l. and 28l. as composition for taking off the increased rent, being seven years' purchase for the present term of 15 years. Jan. 12. Royal warrant to the Clerk of the Signet for a privy seal for 2,064l. 14s. 6d. to Sir Robert Holmes for money laid out in repairing forts and castles in the Isle of Wight between 1670, May 1, and 1676, April 25, amounting to 1,949l. 4s. 7d. and from 1676, April 25, to Sept. 29 following, amounting to 115l. 9s. 11d. : as appears by accounts made up by Auditor Parsons, auditor of his Majesty's revenue of that island. same to be paid out of the Exchequer or out of money in said Sir Robert's hands. Same to the Attorney or Solicitor General for a great seal for a grant to Richard Ransford, William Tate, Thomas Willoughby, John Willoughby and William Buckley of the moneys which shall grow due on Hearthmoney in the town of Northampton for seven years next ensuing : same to be employed by them towards the rebuilding and repairing of the churches and other public buildings in said town under the direction and discretion of the Earl of Northampton ; they making a just account thereof yearly to said Earl : all by reason of the petition from said town representing the sad and miserable condition thereof by a late dreadful fire which consumed all or the greatest part of that town. Royal warrant to the Earl of Essex, Lieut. General and General Governor of Ireland. By the King's letter of 1675, Dec. 3, you were authorised to issue a Commission under the Great Seal of Ireland impowering yourself and four others of the Privy Council of Ireland to inquire into and examine the values of all such lands as you shall judge to be of not sufficient value to satisfy the quit rents (and arrears thereof) payable thereout, and to grant abatements of such quit rents and arrears as you shall think fit. We are now informed by Treasurer Danby that he finds by a late letter from you that the reducement of the said quit rents is in a good forwardness ; and we judging it necessary for our service to know (before any public declaration or order be made by you) the particulars of such arrears of quit rents as you intend to remit, do require you to transmit the same to Treasurer Danby with the names of the persons and the defalcations to be allowed thereupon either to the late Farmers of the Revenue of Ireland or to Visct. Ranelagh and his partners. And you are to make no recitals [sic? for remissions] of any arrears until upon a view of the whole we shall send our further pleasure. King's Warrant Book V. p. 265.
Same to the Attorney or Solicitor General for a privy seal for a grant to Michael Nash, gent., of the personal estate of Hoggard, alias Fivian [Vyvian], late of Turners Puddle, co. Dorset, widow and relict of Richard Hoggard alias Fivian, lately deceased without kin, whereby said estate does belong to the King. Ibid.

Warrant from Treasurer Danby to the Receipt to issue 16,158l. 14s. 10d. on any unsatisfied orders in the name of William Ashburnham as Cofferer of the Household, and if there be not orders registered sufficient to bear the same, then to draw new orders by virtue of the privy seal of Aug. 31 last. Letter of direction on an order of the 9th inst. for 13,833l. 15s. 0d. to Samuel Pepys for Tangier garrison, which (with 466l. 5s. 0d. that is deducted quarterly for the Earl of Inchiquin) makes up 14,300l. for last Dec. quarter of 55,200l. per an. for the garrison of Tangier. Jan. 14. Royal sign manual for 100l. to Edward Cranfeild, Esq., as royal bounty for his services performed by our directions in viewing our garrisons and harbours in Jamaica and taking out copies of records to enable him to make a report unto us of the state of that our island. Jan. 15. Report to the King from Treasurer Danby on the petition of Alexander Cosby, of Stradbury [Stradbally], Queen's county, Ireland. Said petition sets forth that King James granted to petitioner's grandfather the manors of Stradbury and Timichoe [Timogue] with proviso to make no lease or settlement thereof without license. In the troublous times petitioner's father lost the licences by which he made such leases. To remove doubts, petitioner prays a confirmation of said grant, without being molested for breach of said proviso. Said petition was referred to the Lord Lieutenant Oct. 3 last, who referred it to Sir John Temple, Solicitor General [for Ireland], Nov. 29 last. Said Solicitor General reported Dec. 6 last whereon said Lord Lieutenant reported Dec. 13 last that King James granted, 1608, Dec. 1, to Richard Cosby and his heirs male the manor, town and lands of Timochoe [Timogue], Fossy, Eskerbegg, Killbalihahill, Orchard alias Oulart, Garryglasse, Ballyclough and other lands within the barony of Cullenagh, in Queen's County. Petitioner is said Richard's grandson, and obtained a royal letter 1674-5, Mar. 5, to pass a patent for leave to make leases for 21 years or three lives, which was accordingly granted by patent 1675, June 28, but said patent does not dispense with the breach of covenant as above. The desired release may be granted him as an encouragement to him to plant and improve the lands. Treasurer Danby hereby agrees with said report. Warrants not Relating to Money VII. p. 25.
Charles Bertie to the Customs Cashier to bring in with [due] respect to the weekly payments (and same to the Auditor of the Receipt to issue) 25l. for Mr. Ellesden for last Christmas quarter on his pension of 100l. per an. Out Letters (General) p. 16.
Same to same likewise to pay 225l. and 108l. 12s. 6d. to Mr. Breton (now Receiver at Dover) for salary as Customer at Sandwich and Comptroller of the petty customs in London port. Ibid.
Same to same to bring in, notwithstanding any former restriction (and same to the Auditor of the Receipt to issue) 250l. to the King's new royal foundation [of Mathematical boys at Christ's Hospital] for last Christmas quarter on their 1,000l. per an. and 380l. 15s. 0d. [sic for 308l. 15s. 0d., the total being stated as 558l. 15s. 0d.] as the King's allowance to ten [Navy] apprentices chosen out of that hospital for the year ended Dec. 31 last. Ibid, p. 17.

Reference to the Customs Commissioners of the petition of Thomas Morris and William Warren, of London, merchants, concerning 140 pipe of Viduanois wines warranted to be re-shipped for Dantzic, but which now prove aeger and which they desire to be tasted, and that a small duty may be paid on them and that they may be sold here. Jan. 16. Warrant from Treasurer Danby to John Phillips, Auditor for cos. London and Middlesex, for a particular of the manor and bailiwick of Westminster with a view to a lease thereof to John Hall, Esq. This particular is to be transmitted to the Attorney or Solicitor General or to the agents of said Hall. Warrants not Relating to Money VII. p. 25.

Warrant from Treasurer Danby to the Customs Cashier to pay 3,675l. to Samuel Maydwell for one year's impost wines to Christmas last at the rate of 42s. per tun to the noblemen and others usually allowed the same. Letter of direction on an order of Dec. 18 last for 140,000l. to his Highness, William Henric, Prince of Orange ; 40,000l. thereof being for the marriage portion of the Princess of Orange, ut supra Cal. Treas. Books III. pp. 783-4, and 53,090l. being due to him from his Majesty and all interest thereof : same is hereby to be satifised by levying tallies for 140,000l. on Edward Backwell, who is appointed Attorney or Procurator for receiving of the States General 600,000 patacons due to the King for the three remaining parts of the 800,000 patacons covenanted to be paid to him by the 10th article of the treaty between the King and said States General dated 9/19 Feb., 1673-4. [to Samuel Pepys for the Governor of Tangier] being to be deducted out of the establishment of Tangier garrison [being] for one year's pay to William, Earl of Inchiquin as Governor, Colonel and Capt. thereof. Warrant from Treasurer Danby to the Surveyor General of Crown Lands for a particular of premises as below with a view to a lease thereof to Francis Watson.
Prefixing : Said Surveyor General's report dated Jan. 13 on said Watson's petition for same, being made on an order of reference thereon dated Dec. 8 last. I fear the King's title to the tenements and lands forfeited and seized by Queen Elizabeth by virtue of the bastardy of John Bullock alias Watson, junr. (who died seised thereof without issue), whereupon a lease was granted to one Curson for 21 years at 30s. per an., payable from the recovery thereof, which was never answered, yet petitioner being tenant to the land and believing that he shall be able to maintain the king's right against the pretended owner thereof, to whom he is tenant, I advise a lease to him for 31 years at 30s. per an. rent, he covenanting to do his best at his own cost to maintain the King's right, and to be void if such land be not recovered to the King within five years. "It is not improbable that the said lease obtained by Curson was done by design to defeat the Crown of the said forfeiture as hath been done in like cases." Jan. 17. Money warrant for 137l. 10s. 0d. to Sir Phillip Musgrave for 275 days Mar. 25 last to Dec. 25 last of his fee of 10s. a day as Governor of Carlisle Castle. (The usual letters dated Feb. 10 hereon to the Customs Cashier to pay same in with [due] respect to the weekly payments ; and to Receipt to issue same when it is so paid in.) Money warrant for 7,500l. to Sir Edward Griffin, Treasurer of the Chamber, as imprest for one quarter's service for that office : to be paid out of the Exchequer. Royal warrant to the Attorney or Solicitor General for a great seal for a grant to Hen. Guy and Robt. Cooke, Esqrs. (at the nomination of John Hall, Surveyor General of the Queen Consort) of all that the King's bailiwick, liberty and manor of Westminster, co. Midd., with all rights, members and appurtenances thereto belonging, and of all that the king's manor or farm called Neats Court, Foxenden tenement, and the tenements called Hughs tenements, lying in the Isle of Sheppey, Kent, with their appurtenances and all other the King's messuages, cottages, tofts, lands, tenements and hereditaments, whatsoever freehold or copyhold which are or "hereafter [heretofore] were" reputed part of the said bailiwick, liberty or manor of Westminster or of the said manor of Neats Court or either of them : and of all courts, profits and perquisites of Courts, liberties and privileges to the said bailiwick, liberty and manors belonging : and of the reversion and remainder of the said premises or any part thereof in as ample manner as same are now in the Crown or in Denzell, Lord Holles, Phillip, Earl of Chesterfield, William, Visct. Brouncker, Henry, Earl of Clarendon, John Hervey, William Mountagu, Sir Rich. Bellings, Kt., and the said John Hall, Trustees of the Queen Consort : to hold the same to said Guy and Cooke their heirs, etc., for 80 years from Christmas last at the rent of 7l. 3s. 4d. per an. for said bailiwick, liberty and manor of Westminster and 2l. 16s. 8d. per an. for the manor or farm of Neats Court and other the premises in said Isle of Sheppey. And whereas certain leases have already been granted by the King, or by others assigned of all or the greater part of said premises (among other things) to the said Trustees of the Queen Consort as in trust for said Queen during her life and our intention [herein] is to grant to said Guy and Cooke) an estate in law of all such parts of said premises as are not in the respective grants to them [the said Queen's Trustees] made or assigned as above and also to impower and enjoin the said Trustees (in case the Queen think fit to make a present estate to the said Guy and Coke) to execute a lease forthwith to them of said premises during said term, etc., or otherwise to lease same to them immediately after the death of the Queen Consort for the years unexpired of said term and at said rents payable from such date of death, therefore said Trustees are hereby empowered to make such a lease.
In the margin : Memorandum that the patent passed upon this warrant was surrendered by indenture dated 1 July, 1678, which is enrolled in the office of the King's Remembrancer in the Exchequer in Trinity and also in Michaelmas term, 1678. Royal warrant to the Clerk of the Signet for a privy seal for a release and discharge as follows to Samuel Vincent, the survivor of the late Farmers of the Law duty, and to the executors and administrators of his late partners in said farm. By indenture dated 1672-3, Feb. 12, the King, in consideration for 30,000l. advance granted to Peter Calverd, Samuell Vincent and Edmund Bostock said Law duties for three years from Oct. 22 preceding at the rent of 26,500l. per an. with covenants for defalcations to them in case of remission, pardon or respit of such duties. Further it was ordered by the King in Council, 1671, June 22 (upon a report made 1671, June 12, by the Lord Keeper, Treasury Lords, Judges and King's Counsel) that the Law duty item of 2s. 6d. on recognisances should be paid upon recognisances entered into by persons licenced to keep alehouses under the Statute 5 and 6 Edw. VI, c. 25, whereby no person is to keep an alehouse without licence and the licencee is to enter into a recognizance, which recognizance is to be certified at the next Quarter Sessions. Said Calverd, Vincent and Bostock have petitioned, setting forth that when they took said farm they doubted not but that said duty of 2s. 6d. would have been quietly paid, otherwise they would not have given so much rent for said farm by 12,000l. per an., they making it appear by certificates and otherwise that there are about 90,000 alehousekeepers in England and Wales which at 2s. 6d. would amount to 11,250l. per an., besides accidental licences of alehouses upon death and removal : that Sir Robert Atkins, Receiver of said duty, had quietly received a great part of said 2s. 6d. duty, but that immediately after said Farmers entered on said farm the Justices of the Peace in most parts of the kingdom obstructed the payment of said duty, whereupon the Farmers commenced several suits at law at Westminster for recovery thereof in which there were several demurrers joined in order to have the opinion of all the Judges, upon which they met at Serjeants Inn, in Chancery Lane, and heard the arguments of Counsel on both sides, but declined to deliver their judgments therein : that in said suits said Farmers spent above 2,000l., and that by reason thereof, and of a vote which afterwards passed in the House of Commons to the effect that said imposition was not due for alehousekeepers' recognizances and of a bill brought into that House thereupon to be passed into an Act to take away the same, declaring it was never intended to be granted : wherefore said Farmers prayed a defalcation for such loss and allowance for collecting, charges in the said suits and in asserting the king's right in the Courts of Westminster, and before the Committee of the House of Commons, and also for their overplus of interest upon their advance of 30,000l., they alleging that they were at great charges in raising and procuring said 30,000l. In consideration whereof the King did order that said Farmers shall be accomptants to the King at the rate of 21,000l. per an. for the Law duties and likewise for all the money they received upon such alehouse keepers' recognizances, and shall also have reasonable allowances for interest money, pains and expenses ; upon which Treasurer Danby did accordingly order Auditor Aldworth to charge them with such rent and per contra to allow them 8 per cent. interest on their advance money, 5,000l. for [their abovesaid law, etc.] charges, and 1,000l. per an. for reward. In accordance herewith said Farmers are charged with 63,000l. for these three years, and 3,791l. 7s. 6d. for their actual receipts of said duty on alehousekeepers' recognizances ; as against which they are credited with 50,953l. 6s. 8d. paid into the Receipt, 300l. for house rent, 620l. for salaries, 5,000l. for charges in collecting, 3,000l. for their own pains ; 150l. for the Auditor ; 4,501l. 5s. 4d. for 8 per cent. interest on their advance or in all 64,524l. 12s., which leaves a debit balance of 2,266l. 15s. 6d. As to this remain the said Vincent (now the only survivor of said Farmers) has petitioned for a further allowance for charges and expenses in the receipt and payment of said duty, which much exceeded the 5,000l. allowed above. The present privy seal is to confirm the abovesaid allowances and to make a further allowance to said Vincent of 916l. 15s. 6d. towards charges and expenses as above, leaving a balance of 1,350l., which said Vincent has paid into the Exchequer by two tallies. Therefore the present privy seal further authorises the declaring the said account and the releasing and discharging of said Vincent, and of said heirs, etc., of said Bostock and Calverd from the said recited indenture and everything therein. And whereas said Vincent has represented that although said Farmers in their account accompt for 66,791l. 7s. 6d. of receipts, yet they have not actually received the same but a great part thereof is standing out or remaining in the hands of several of their deputies and collectors and other persons who have received the same from the King's subjects, and yet refuse or neglect to pay same to said Farmers. Therefore this privy seal authorises said Vincent to sue for and recover such arrears, and to give acquittances for same. (Treasurer Danby's subscription dated Jan. 24 of docquet hereof.) Treasurer Danby to the Judge of the Prerogative Court of Canterbury or his surrogate. I am informed that Edward Copley, late of Batley, co. Yorks, is dead intestate, being greatly indebted to the King. Part of his estate is within the province of Canterbury. I desire you to grant letters of administration to William Atfen, of Lambeth, gent., in trust for the King. (The like letter to the Judge of the Prerogative Court of York for similar letters to be granted to said Atfen for that part of said Copley's estate which is in the province of York, first reversing the administration which John Fingle, a poor labouring man, altogether insolvent, has surreptitiously got in said court at York of said portion of said estate, with intention to defeat the King of said debt.) Report to the King from Treasurer Danby on the petition of Owen Caroll, of Dublin, to the Lord Lieutenant praying his Excellency's recommendation to his Majesty of his request [said request setting forth] that Thomas Herold, of Dublin, gent., purchased Kellmain, Killbey, Ballydonegan, Curragh, Ballydoonegan, Monyderagh and Fiagh, in the territory of Ely O'Carroll, and had a patent for the same, 13 Car. I, but with condition not to alien any part of the lands without forfeiture to any mere Irishman and not of English or British blood or name, for above three lives or 40 years. Said lands were purchased by Howard Uxburgh, esq., of Barbara, sole daughter of said Tho. Herold, and petitioner would purchase same of said Uxburgh if the King will renew the patent and leave out that clause. Said petition was referred by the Lord Lieutenant Oct. 31 last to the Attorney or Solicitor General [of Ireland], whereupon Sir John Temple, Solicitor General for Ireland, reported that such grant would be no prejudice to the King making the present rent [of] 4l. 0s. 9d. [into] 4l. 10s. 0d. The Lord Lieutenant's letter hereon (together with said report) to Secretary Coventry being referred to Treasurer Danby Dec. 9 last Treasurer Danby hereby reports thereon that he sees no inconvenience to the King in discharging the land from said condition.
