Prefixing : (a) Order of the Queen in Council, dated Whitehall, Aug. 18 inst., granting leave to the sloop Neptune, Stephen Elliot master, riding at anchor in the Hope, to make entry notwithstanding the quarantine ; the master having come from Jamaica with a pacquet sent from the President and Council there to acquaint their Majesties with the unhappy condition of that place by reason of a violent earthquake which happened there June 7 last : the said master's petition shewing that at the time of his departure the said island was in good health and free from any contagious distemper, and that the crew have been and are all healthy ; as is supported by the oaths of Robert Walker and Robert Smithel, and therefore praying to be admitted to entry, so that the ship may be speedily fitted again for the island to carry advice what supplies are designed for that place.

Same to the Excise Commissioners. My Lords are willing that you should constitute Mr. Allen to the place of Excise collector at Bristol, void by the death of his father. But you are to provide for Mr. Clarke, late collector of Excise in co. Salop, by constituting him to the first collection of like value that shall fall vacant and lie convenient for him. Ibid.

Same to Robert Griffith, agent of the first Marine Regiment, of the petition of Walter Brough, a Lieutenant in Capt. Cooper's Company of Mariners [Marines], petitioner shewing that his commission is dated 1690-1, Feb. 23, and that from date thereof to the present he has received 3l. 10s. 0d. only for two fortnights' subsistence for himself and servants : therefore praying an order to the Agent [of the Regiment] to pay him the four months' pay now ordered to him, he coming in upon the death of Nathaniell Price, whose executors have received eight months' pay of twelve which was due to them. Same to Mr. Aaron Smith [Treasury Solicitor] of the petition of George Pit (Pitt), junr., to the Queen, shewing that he was found guilty of manslaughter for killing John Hoyle, esq., and was pardoned, but cannot be restored to his goods without a particular privy seal : therefore praying same. Treasury warrant to Thomas Musgrave to make leases to such of the owners and inhabitants of houses adjacent to that long slip of ground in the parish of St. Margaret's, Westminster, without the walls of St. James's Park, extending from the house now or late in the possession of John Webb, as will accept of same at the rate of 10s. a foot for the unbuilt ground and 15s. a foot for the built ground : and in case of refusal then to be at liberty to erect any new buildings on any part thereof as unleased : the said ground having been granted to said Musgrave and Richard Kent, since deceased, by patent of 1690, June 7, at the rent of 6s. 8d. per an., with covenants to make such compositions and agreements with the owners and inhabitants of the adjacent houses as should be directed by Treasury warrant, but they having refused to accept the above prices. Treasury warrant to the Revenue Commissioners, Ireland, to pay William Culliford his salary as late one of the said Commissioners, viz., up to the date of the present [new] Commission ; he not having been suspended until the 14th inst., and all the remaining Commissioners having been paid to the date of the new Commission. Royal warrant to the Attorney General to enter a noli prosequi to the information against John Strong, who was prosecuted for perjury, and William Claver, an officer of the Customs, Weymouth port, the said Claver having prosecuted Richard Strong in 1683 for transporting wool, who was fined 90l., and thereupon brought an action against Claver for 117l. 10s. 0d. as money lent, supporting same at the trial by said John Strong, his son, and obtained a verdict, thereby reducing Claver and his family to great poverty ; whereupon Claver prosecuted said John for perjury, who was found guilty at the Assizes at Dorset in Michaelmas term, 1687, but no fine was set, nor was Strong ever taken thereupon. The present warrant is by reason that said Richard Strong is willing to repair to said Claver all his damages, who therefore prays this noli prosequi on Strong's behalf as a means of repairing his [Claver's] losses, "though Strong, the person convicted, deserves no favour." Report to the Queen from the Treasury Lords on the petition of Edmund Prideaux, Henry Ustick and Matthew Remington, esq., as by the order of reference of July 21 ; petitioners praying a privy seal (upon a warrant signed by the King before he went for Flanders) for a grant of a third of such moneys as they should discover and recover from divers persons who formerly levied several sums upon Dissenters in case of recusancy etc., and did not pay same into the Exchequer. The King's warrant, signed as above, remains at the Treasury not countersigned, and no further progress made thereon. We thought the same not advisable in consideration of the powers and interest which petitioners desired. (1) They were not the first discoverers, but had their information from others who were concerned in prosecuting the same in the reign of the late King. (2) It would give vexation and disturbance to a great number of your Majesty's subjects, especially such as have served as Mayors, Sheriffs, Justices of the Peace or other public employments. (3) It would be almost impossible to have any certain cheque or control upon the petitioners if they should make any underhand compositions.
We prefer that the Attorney General, upon information from time to time, should sue on the Crown behalf, with a third part of the recoveries as a reward to the discoverers, "and finding that Thomas Baker and Peter Stepkins were early in the discoveries of these concealments and that they have actually informed us of several sums to the value of 2,500l. or upwards in the hands of several particular persons, we have agreed to employ them in the method before mentioned without passing any grant for the same under the great or privy seal."

Royal letters patent appointing Thomas Addison, esq., to take immediate possession of the late Jesuits' College in the Savoy (viz. of the houses, edifices and buildings which are described in the plan [missing] hereto annexed and of the several goods as in schedule below) and to keep same for such uses as their Majesties shall from time to time appoint, during pleasure : all by reason that said Addison did lately inform that there were several houses and buildings in the Savoy which had lately been possessed by Jesuits and other forfeiting persons who had left the same, whereupon the said buildings and the goods therein were seized into the King's hands and made use of for the keeping of prisoners of war, and it is necessary to appoint some person as keeper to have the custody thereof and to look after the repairs and preservation thereof.

Same to the Commissioners of Excise and Hearthmoney to pay 188l. 13s. 0d. to Francis Parry and Nathaniel Horneby out of the arrears of Hearthmoney in discharge of an overpayment as follows, viz. : William Probert, Receiver General of Hearthmoney in North Wales and part of South Wales, stood charged for the 1685, Michaelmas [half year's account], with 3,768l. 14s. 0d., plus 7s. 9d. remain : and on his said account he was credited with 3,957l. 14s. 9d. : which is 188l. 13s. 0d. more than he is charged with from the receipt of that duty, and was occasioned by an advance of that sum by Nathaniel Horneby, then one of the Hearthmoney Commissioners, by order of 1686, April 13, for payment of several allowances and incidents of seven collectors sent down in that collection, which could not be paid then out of the produce of said half year ended 1685, Michaelmas, the said Robert [Probert] having before the stating the said seven collectors' accounts paid the whole produce of that half year into the office and the same was answered into the Exchequer ; and the said Horne was afterwards reimbursed said 188l. 13s. 0d. by mistake out of 500l. imprested to the Commissioners out of the Excise, whereupon said Parry and Horneby (two of the then Commissioners) gave an acquittance to Mr. Duncombe, the Excise Cashier, and the said 500l. now stands charged on them in the account of the Excise, thus leaving the 188l. 13s. 0d. still owing to Parry. Warwick in 1686 were indicted and convicted for the murder of a person who happened to be killed at Coleshill, they [the said three officers] being casually in the company, though the murder was actually done by one Ryley, who escaped, whereupon Treasurer Rochester procured a royal warrant for their pardon upon a certificate from the Judge of Assize of the nature of their case, but they lying in gaol and reprieved for some short time were too poor to pay the cost of passing their pardon, whereupon the said Commissioners directed Mr. Noell to procure their pardon to be passed under the great seal.
