Same to Mr. Hewer, enclosing an Order of Council [missing], dated 1684, Aug. 8, directing the Mayor, Recorder and Town Clerk of the late Garrison of Tangier, in whose hands 50l. was deposited by Sir John Mordant upon proceedings had against him for words spoken against Edward Hughes, Commissary of the Musters there, to repay the same to said Mordant. You are to certify the Treasury Lords how this matter stands and why same has not been so repaid. Ibid.

Treasury warrant to the Customs Commissioners to remit the extra duty of 1 per cent [the Mediterranean Duty] to Sir Gabriell Roberts et al., owners and freighters of the ship John and Ann, Samuel Skinner master, from Gallipoli with oils ; said ship having sailed from London four years since, gunned and manned according to law, but two men died on the voyage and five ran away at Tunis and eight left and went into his Majesty's ships at Tuniz, wherefore she returned not regularly manned ; being circumstances of unavoidable necessity. Prefixing : (a) Order of the King in Council, dated Whitehall, Nov. 15 inst. Upon consideration of the state of the several trades the King has thought fit to regulate the number of seamen allowed to go out this year, as in part relaxation of the embargo imposed by Order in Council, Sept. 18 last. It is hereby ordered that the several ships and number of seamen in the list annexed hereto be allowed to go out [? from London port] with their convoys to the Plantations, East Indies, Africa and to the several ports of Spain and Portugal therein expressed under the same conditions and limitations as formerly. If any mariners beyond the said number attempt to sail, the supernumerary men are to be taken out and the ship is to be stopped, it being the King's pleasure that in all other respects the former embargo be continued till further order.
The list of ships is not appended, but only the following note thereof : number of ships, 211 ; seamen, 2,749 ; burthen, 29,810 tons.

Nov. 19. Royal warrant to the Clerk of the Signet for a privy seal for the issue to Edward Russell, Treasurer of the Navy, of 1,000,000l. upon account for the services as in the clause of the Act for the Twelve Months' Aid [2 Wm. and Mary, Sess. 2, c. 1], appropriating 1,000,000l. for pay of seamen, stores, victuals, naval ordnance and other necessary services. And whereas before the passing of said Act the sum of 41,160l. was taken up [on loan] and issued to the Treasurer of the Navy for the service thereof ; which by virtue of said Act is to be taken as part of said 1,000,000l. ; and since the passing of said Act the further sum of 40,000l. has been issued to said Treasurer out of loans made on said Act ; the total thereof, viz. 81,160l., is to be accounted part of the 1,000,000l. hereby authorized to be issued. Same to Charles Fox and Thomas Coningsby, Paymasters of the Forces in Ireland, to pay to Mary Barnier, the mother of Camille St. Sauveur, deceased, 38l. 5s. 0d. forthwith for 153 days' arrears to Nov. 1 inst. on the pension of 5s. a day which William Harbord, late Paymaster General of said Forces, was by royal sign manual of April 5 last directed to pay her in consideration of the said St. Sauveur's services : with dormant clause for payment of same for the future, monthly or quarterly. William Jephson to the Customs Commissioners to appoint some other loco Mr. Warburton as deputy to Oliver Lyme, Comptroller of Chester port ; the said Lyme being desirous to return to his charge and being willing to pay 4l. a year to a new deputy in lieu of that which is said to be clerk's fees. Warburton is hereby to be sent to some other place ; and Lyme is to pay said 4l. per an. over and above the 20l. per an. formerly settled to be also paid to him [said deputy], and he [Lyme] may live at Liverpool "so as he do not interfere in the office to the prejudice of the service." William Jephson to the Customs Commissioners, enclosing (a) and (b) infra. You are to observe the directions in (b) and as to (a) you are to cause an enquiry to be made and to report thereon to the Treasury Lords.
Appending : (a) Order of the King in Council, dated Nov. 15, made upon a presentment of the 7th inst. concerning a riot by the people of St. Ann's parish, Padstow, Cornwall, about a vessel laden with tobacco from Virginia, forced by stress upon that coast, the master and mariners of which were barbarously used by the rude multitude dispos[sess]ing them of their ship and embezzling and plundering the goods. Hereon the Council orders the Treasury Lords to enquire and report. (b) The like Order of like date made on the said Commissioners' presentment of the 10th inst., desiring directions concerning certain Dutch soldiers' wives and children passing to and fro and also disbanded soldiers coming out of Ireland, who were kept in several ports and are still detained for want of passes. Hereon the Council orders the Customs officers to stop all private soldiers coming out of Ireland until they shall be examined by Sir John Morgan or Sir Geo. St. George or such as they shall appoint, and meantime to allow them a competent maintenance not exceeding 6d. a day : and as to the women and children they are to be allowed freely to pass unless there be some special cause to the contrary.

By their patents, during pleasure, and by the Treasury order of April 21 last, the King's waiters in London port must have their deputies approved by the Treasury Lords. Very few (if any) of the said deputies have been so approved. You are to report why any of them are suffered to act without such approval and how many such places are executed by the principals and how many by deputies ; and to take care for the future of the observance of the said rule. Baker commander, with 20 English mariners, was allowed to the share of Mr. Paggen, merchant, but she was broke in pieces in her way towards the Downs and eight men out of her complement were proposed to be allowed to Francis Gyles for the Barbados trade and [per contra] five men are spared out of the complement of the Jacob, James Porter master, bound to Virginia ; thus leaving 17 men for the Concord.
