Trade.

Africa.

fo. 12.

The Committee of the Company of Merchants trading to Africa, attending pursuant to order, they were called in; and Mr. Touchit acquainted the Board, that the Board of Ordnance having signified to them by letter, that the fort at Annamaboe was finished, and desired to know into whose charge they would have it delivered, they had taken the matter into consideration; and having found from experience, that the ten thousand pounds annually allowed by Parliament had been insufficient even for the support of the forts, which they had received from the late Company, they had thought it adviseable to prepare a petition to his Majesty, praying such further assistance for the support and maintenance of the British forts, as his Majesty should think proper; that having offered the said petition to Mr. Secretary Pitt, who they were informed was the proper person to present it to his Majesty, they had received a letter from his Secretary, Mr. Wood, returning the said petition, and acquainting them that Mr. Pitt did not think proper to present it, as he should thereby become a party in a matter, which must come under the consideration of the House of Commons, of which he was a member; that the Duke of Newcastle having also declined presenting the said petition, as not being properly within his Grace's department, they had desired to attend their lordships to receive their advice and opinion in what manner to proceed.

Whereupon their lordships observed to them, that the supplies granted for the support of the forts and settlements upon the coast of Africa had usually been granted upon petitions of the Committee; and had never, as they apprehended, been placed upon any estimate laid by his Majesty's order before the House of Commons; and therefore their lordships apprehended the proper method would be, either to state their case in their usual petition to the House of Commons, or to give a state of it to his Majesty's ministers, to the end that they might be fully apprized of it, when the consideration of what supply might be necessary for the coast of Africa should come before that House.

The Committee upon this occasion submitted to their lordships, whether it might not be proper for them to deliver their petition to the Council, to be presented to his Majesty in Council; upon which their lordships observed, that this was a channel in which matters of this nature might possibly not improperly pass; but that it was a method of proceeding which must be left to their own discretion.

The Committee then withdrew.

Plantations General.

A representation to his Majesty, proposing that new Seals may be prepared for the colonies, was agreed to and signed.

Read a memorial of Robert Grant, Esquire, to the Lords Commissioners for Trade and Plantations, dated 23rd June, 1760, praying relief against an action now depending in Nova Scotia for the duties on a quantity of rum brought to Halifax for the use of his Majesty's ships.

Their lordships, upon consideration of the said memorial, were of opinion, that the question whether the rum mentioned therein is or is not subject to the duties imposed upon rum by an Act of the Legislature, must be adjudged and determined in the Courts there; and that it is not within the jurisdiction and department of this Board to give any directions for staying proceedings in any suit depending in those courts.

Ordered, that an extract be made of so much of the first mentioned letter from Governor Shirley of the 1st of August, 1760, as relates to the trade carried on from the northern colonies with the French in Hispaniola through the channel of Monte Christi, together with a copy of the deposition therein referred to, in order to be laid before his Majesty in Council, and that the draught of a representation thereupon be prepared.

Ordered, that the Secretary do transmit a like extract of the said letter and copy of the deposition, to the Secretary to the Lords Commissioners of the Treasury, to be laid before that Board.

Plantations General.

The Secretary laid before the Board the copy of an Order of his Majesty in Council of the 11th instant, directing the Chief Engraver of Seals to prepare draughts of new Seals for America, and in preparing the same, to follow such instructions as he shall receive from this Board for that purpose.

Ordered, that the Secretary do prepare a draught of instructions for the guidance and direction of the Seal engraver in preparing the said draughts, conformable to what has been done on the like occasions.

Their lordships took into consideration that part of the letter from Mr. Senior, dated the 20th May last, which relates to the pretensions of the Dutch Governor of Elmina to restrain Portuguese ships from trading with any other nation to the westward of the River Volta; and after some time spent therein, agreed to consider further thereof on Tuesday next, the 2nd of December.
