Proprieties, Pennsylvania.

fo. 96.

Their lordships took into further consideration the laws of Pennsylvania, mentioned in the minutes of the 24th ultimo, and Mr. Jackson attending, the Board had some discourse with him thereupon.

fo. 97.

Mr. Wilmot, agent and attorney to the Proprietaries of Pennsylvania attending, was asked, whether any or what steps had been taken in consequence of the intimation given last year of the objections that had occurred to those expressions in the laws of Pennsylvania, by which the said Proprietaries are styled true and absolute Proprietaries of the three lower Counties on Delaware, and he acquainted the Board, that he had, in consequence of what had been mentioned to him by the Secretary on that subject, informed the Proprietaries thereof, who had given instructions thereupon to the Deputy Governor, who, in a letter dated in March last, had assured the said Proprietaries that care would be taken to have the style properly altered.

Mr. Wilmot being withdrawn, it was ordered, that the draught of a report to the Lords of the Committee of Council upon the said laws of Pennsylvania should be prepared.

Leeward Islands

fo. 98.

The Earl of Hillsborough, one of His Majesty's principal Secretaries of State, attends, and acquaints their lordships, by the King's command, that His Majesty had appointed Sir Ralph Payne, Knight of the Bath, to be Governor of the Leeward Caribbee Islands in America, in the room of William Woodley, Esquire; and that it was His Majesty's pleasure, that this Board should prepare and lay before his Majesty in Council, draughts of a Commission for the said Governor, and of such instructions as are usually given on like occasions.

The draught of a Commission having been accordingly prepared, was approved, and a representation to his Majesty thereupon was signed.

Proprieties, Pennsylvania.

fo. 99.

The draught of a report to the Lords of the Committee of Council for Plantation Affairs upon several laws passed in the province of Pennsylvania in the years 1769 and 1770, having been prepared pursuant to order, was read, approved and signed.

Nova Scotia, Georgia.

The Secretary laid before the Board two memorials, prepared by the agents for the settlements of Nova Scotia and Georgia to be presented to the Lords of the Treasury, praying that the money granted by Parliament for the service of those colonies for the year 1771 may be issued as usual into their hands, and their lordships approved of the said memorials being presented to the Lords of the Treasury, for their lordships' directions thereupon.

Dominica.

fo. 100.

The Secretary laid before the Board several laws passed in the Island of Dominica, together with a memorial of the agent for that Island, praying to be heard upon the subject of the said laws, when the same should be taken into consideration, and it was ordered, that the laws should be sent to Mr. Jackson, for his opinion thereupon in point of law.

Plantations General.

fo. 101.

Read two letters to Mr. Pownall from Mr. Robinson, Secretary to the Lords of the Treasury, the one dated March 26th, 1771, requesting the opinion of the Board on a petition of Benjamin Roberts, Lieutenant, late Commissary of Indian Affairs in America under Sir William Johnson, praying payment of the sum of one thousand, two hundred and fifty eight pounds, thirteen shillings and eight pence, remaining due to him for his losses and expences in the said service; the other dated May 1st, 1771, requesting the opinion of the Board on a memorial of said Lieutenant Roberts to the Lords of the Treasury, stating that several vexatious lawsuits have been commenced against him, as Commissary of Indian Affairs under Sir William Johnson, and praying some allowance in support of his present exigencies, and their lordships' directions, that he may be supported in the said lawsuits.

Their lordships took the said letters into consideration, together with an extract of a letter from Sir William Johnson to the Earl of Hillsborough, communicated by his lordship, and Lieutenant Roberts attending, was heard in what he had to offer in support of the allegations of his memorials, after which directions were given to the Secretary for an answer to Mr. Robinson's letters.

New York.

Read an order of the Lords of the Committee of Council for Plantation Affairs, dated April 29th, 1771, directing that this Board do prepare and lay before them a draught of an instruction to the Governor of New York to pass Letters patent, containing a grant of a lease to Frederick Philipse, Esquire, of all royal mines of Gold and Silver discovered and opened within the manor of Philipsburg by Mr. Philipse or his agents, for the term of ninety nine years, under the conditions specified in a report of this Board.

Ordered, that the draught of an instruction to the Governor of New York, conformable to the directions of the said order, be prepared.

Trade, Africa.

Their lordships read and considered several laws passed in the province of Nova Scotia in the years 1769 and 1770, together with Mr. Jackson's report thereupon, and ordered, that the draught of a letter to the Governor on the subject of one of the said laws, "granting an excise on Tea, Coffee and playing Cards," should be prepared.

New Jersey.

Their lordships also read and considered several laws passed in New Jersey in the year 1770, together with Mr. Jackson's report thereupon, and it was ordered, that the draught of a representation to his Majesty should be prepared, proposing that one of the said laws, intituled, "An Act to explain and amend an Act of the General Assembly in the tenth year of his Majesty's reign, intituled, an Act for the relief of insolvent debtors, and for other purposes therein mentioned," should be disallowed, for the reasons set forth in Mr. Jackson's reports.

Massachusetts.

Their lordships also read and considered several laws passed in the Massachusetts Bay in 1770, together with Mr. Jackson's report thereupon.

Turks' Islands.

The Earl of Hillsborough, one of His Majesty's principal Secretaries of State, attends, and communicates to the Board, by his Majesty's command, the correspondence between his lordship and the Governor of the Bahama Islands and Mr. Symmer, his Majesty's agent at Turks' Islands, since the Board's representation to his Majesty on the subject of Mr. Symmer's conduct and the state of those Islands on the 3rd of May, 1768. His lordship at the same time signified his Majesty's command, that the Board should consider these papers and report to his Majesty their opinion, as well upon what further appears relative to the conduct of Mr. Symmer, as upon the state of the Islands in general, and the best means of regulating and promoting the trade for Salt carried on there.

The papers communicated by his lordship on this occasion were read and considered.

New Jersey.

The draught of a representation to his Majesty, proposing the disallowance of an Act passed in New Jersey in 1770, intituled, An Act to explain and amend an Act of the General Assembly in the tenth year of his Majesty's reign, intituled an Act for the relief of insolvent debtors and for other purposes therein mentioned, having been prepared pursuant to order, was approved, transscribed and signed.

Dominica.

Read a petition of John Greg, Rose de Breuil, widow, Payard, Pierre, Jean Baptist, Rose Julie and Elinor Payard of the Island of Dominica, praying the Board's consent to an assignment to said Greg of a lease of lands in said Island granted to the other petitioners by His Majesty's Commissioners for sale of lands; a like petition of Jean Jacques Lion of the said Island, praying the Board's consent to the assignment of a lease of lands in his possession, was read; and it appearing, that Governor Melvill had given his consent in both cases to the assignment of the said leases, the Secretary was ordered to certify their lordships' approbation thereof.

The Secretary laid before the Board three papers received from the Committee of the Company of Merchants trading to Africa, entitled as follows, viz:—
Trade, Africa.
Extract of a letter from David Mill, Esquire, dated Cape Coast Castle, 19th November, 1770, relative to the conduct of the officers belonging to the Dutch West India Company on the coast of Africa.

Governor Woortman's protest, dated St. George á la Mina, November 6th, 1770.
Governor Mill's answer to Governor Woortman's protest and a counter-protest, dated Cape Coast Castle, the 8th of November, 1770.

It appearing by the said papers, that the officers of the Dutch West India Company on the coast of Africa still continued to assert and support their claim to prevent Portuguese vessels from trading with his Majesty's subjects, it was ordered, that copies should be made of the said papers to be communicated to the Earl of Halifax, and that the draught of a letter to his lordship thereupon should be prepared.

Plantations General.

The Earl of Hillsborough communicated to the Board, by his Majesty's command, for their consideration and representation to his Majesty in Council thereupon, a report and several papers thereto annexed, of the Surveyor General of his Majesty's Woods in America of the state of his proceedings in the execution of his office.

fo. 116.

The said report and papers having been read and considered, directions were given for the draught of a representation to his Majesty thereupon to be prepared, and the Secretary was, in the meantime, ordered to transmit to Mr. Jackson, for his consideration and opinion, that part of the said report which relates to the lands on Kennebeck river, claimed under grants from the Council of Plymouth.

Nova Scotia.

The draught of a letter to Lord William Campbell, Governor of Nova Scotia, on the subject of a law of that colony, "granting an excise on Tea, Coffee and Playing Cards," having been prepared pursuant to order, was approved and ordered to be transcribed.

New York.

fo. 117.

The draught of an additional instruction to the Governor of New York, authorizing him to grant a lease to Mr. Philipse of all royal mines of gold and silver discovered or to be discovered within the manor of Philipseburgh, having been prepared pursuant to order, was approved, and the draught of a report thereupon to the Lords of the Committee of Council, was signed.

West Florida.

The Secretary laid before the Board a memorial prepared by the agent for West Florida to be presented to the Lords Commissioners of the Treasury, praying that the money granted by Parliament for the service of that colony for the year 1771, may be issued as usual into his hands, and their lordships approved of the said memorial being presented to the Lords of the Treasury, for their directions thereupon.

New Hampshire.

Their lordships read and considered six Acts passed in the province of New Hampshire in 1770, together with Mr. Jackson's report thereupon.

Grenada.

fo. 119.

The Earl of Hillsborough signified to the Board His Majesty's commands, that they should prepare and lay before his Majesty in Council the draught of an additional instruction to the Governor of Grenada and the other Southern Caribbee Islands, authorizing him to accept from the Assemblys of the said Islands under his Government an additional salary, under the like conditions and restrictions contained in a like instruction to the Governor of the Leeward Islands.

The draught of an additional instruction having been accordingly prepared, was approved, and a representation to his Majesty thereupon was signed.

Trade, Africa.

Nova Scotia.

The draught of a letter to the Earl of Halifax, inclosing copies of papers on the subject of the pretense set up by the officers of the Dutch West India Company on the coast of Africa to prevent Portuguese vessels trading with his Majesty's subjects, having been prepared pursuant to order, was signed; as was also a letter to Lord William Campbell, Governor of Nova Scotia, on the subject of the law, for "granting an excise to his Majesty on Coffee, Tea and Playing Cards."

Massachusetts.

fo. 121.

Read a memorial of Doctor Stennett, praying their lordships to recommend to his Majesty to disallow an Act passed in the province of Massachusetts Bay in June, 1768, by which the Antipedo Baptists and Quakers are compelled to pay to the support of a Minister of a different persuasion.

Their lordships thereupon read and considered the said Act, and it was ordered, that the draught of a representation to his Majesty should be prepared, proposing that it may be disallowed.

Plantations General.

fo. 122.

The Secretary laid before the Board a memorial, prepared to be presented to the Lords of the Treasury, by Mr. Cumberland, agent and attorney to the Surveyor General of lands for the Northern district of North America, praying that such part of the money granted by Parliament in the last session for general surveys as is allotted to the said Surveyor, may be issued into his hands, and their lordships approved of the said memorial being presented to the Lords of the Treasury, for their lordships' directions thereupon.

Read a letter from Philip Stephens, Esquire, Secretary to the Lords of the Admiralty, to the Secretary to this Board, dated May 21st, 1771, desiring him to move their lordships, to give orders to Captain Holland to permit Lieutenant Mowat to take copies of his plans of surveys of the Northern district of America, for the use of that Board.

Plantations General.

fo. 123.

Ordered, that the Secretary do write to Mr. Holland, and signify to him the Board's directions, that he should allow Lieutenant Mowat to take copies, for the use of the Lords of the Admiralty, and for their use only, of such parts of his surveys as should be required for that purpose by Lieutenant Mowat.

Bahamas, Turks' Island.

Their lordships resumed the consideration of the papers, communicated by his Majesty's command, relative to the state of Turks' Islands and the conduct of Mr. Symmer, and it was ordered, that the draught of a representation to his Majesty thereupon should be prepared.

fo. 124.

Leeward Islands.

Read a letter from Mr. J. Gardiner to the Secretary, dated March 21st, 1771, relative to certain proceedings and determinations of the Judges in the Island of St. Christopher's, which he states to be prejudicial to the commercial interests of Great Britain, and inclosing office copies of said proceedings.

Their lordships were of opinion, that the above letter and its enclosures should lye by for further consideration, in case the parties stated to be aggrieved should make an application to the Board on that subject.

Leeward Islands, Antigua, St. Christopher's, Montserrat, Nevis.

Their lordships read and considered several laws passed in the Islands of Antigua, St. Christopher's, Montserrat and Nevis, together with Mr. Jackson's reports thereupon.

Ordered, that draughts of representations to his Majesty be prepared, proposing that several of the said laws, which appear liable to material objections, may be disallowed, viz:—
Antigua.
An Act passed in the Island of Antigua, intituled, "An Act for the ease and relief of several insolvent debtors."

St. Christopher's.
An Act passed in the Island of St. Christopher's, intituled, "An Act to amend an Act, intitled An Act to enable the several parts of this Island formerly belonging to the French, to choose and send representatives to serve in the Assemblies of this Island; to declare and ascertain the number of representatives for the whole Island, what number each parish shall elect, and the several qualifications of the electors and candidates; to secure the freedom of elections, and for repealing an Act of this Island, dated the thirteenth day of November, one thousand seven hundred and eleven, intitled, an Act for preserving the freedom of elections, and appointing who shall be deemed freeholders, and be capable of electing, or being elected representatives."

Read a report of Richard Jackson, Esquire, upon a question stated to him by their lordships' order, relative to white pine trees growing upon lands upon Kennebeck river, claimed under grants from the Council of Plymouth.

Ordered, that the said report be taken into consideration on Wednesday next, and that Mr. Jackson be desired to attend.

New York.

fo. 129.

Their lordships took into consideration an order of the Lords of the Committee of Council for Plantation Affairs, dated July 5th, 1770, referring to this Board, for their consideration and report, a petition of several officers and soldiers, who served in America during the late war and were reduced at the peace, setting forth, that, in pursuance of the proclamation of the 7th of October, 1763, they obtained warrants from the Lieutenant Governor of New York for sundry tracts of land to be surveyed, and patents for divers tracts in the Northern parts of that province; which lands remain unsettled in consequence of claims of grantees under the Government of New Hampshire, and an instruction from his Majesty to the Governor of New York; and praying that the Earl of Dunmore may be permitted to grant lands to such of the petitioners, as have located and surveyed them, and to confirm to others the grants which have been already made.

Their lordships at the same time took into consideration the resolution they came to thereupon on the 13th of July, 1770, together with several letters, memorials and representations, since received by the Earl of Hillsborough from the Governor of New York, touching the disordered state of that country, and the necessity there is for his Majesty's service, of coming to some speedy resolution thereupon.

Ordered, that this business be taken into further consideration on Wednesday next.

Grenada, St. Vincent's.

There being a vacancy in the Council of St. Vincent's by the resignation of William Fitzhugh, Esquire, a representation to his Majesty was signed, recommending Archibald Ingram, Esquire, to supply the said vacancy.

Bahamas, Turks' Island.

The draught of a representation to his Majesty on the papers communicated by the Earl of Hillsborough, relative to the state of Turks' Island and the conduct of his Majesty's agent there, having been prepared pursuant to order, was approved and ordered to be transcribed.

Plantations General.

Their lordships took into further consideration Mr. Jackson's report on the question stated to him relative to white pine trees growing on lands upon Kennebeck river, claimed under grants from the Council of Plymouth, and Mr. Jackson attending, their lordships had some discourse with him thereupon.

Massachusetts.

fo. 133.

Ordered, that the Secretary do write to Mr. Jackson and desire his opinion, in point of law, whether white pine trees growing on lands within the province of Massachusetts Bay, not erected into a township, can, under the provisions and reservations of the statute of the 8th of George the first, Cap. 12, be in any case felled or destroyed without his Majesty's licence for so doing first had and obtained.

Leeward Islands, St. Christopher's.

fo. 134.

Read an order of the Lords of the Committee of Council for Plantation Affairs, dated May 23rd, 1771, referring to this Board, for their consideration and report, the petition of the Honble. Samuel Crooke of St. Christopher's, Esquire, to the King, stating the inconveniences arising to the said petitioner from the want of a Court of Errors in the Island, properly constituted to determine a writ of error depending against him, and praying relief from his Majesty.

Ordered, that this business be taken into consideration on Friday next, and that notice be given to Mr. Hamersly, the petitioner's agent, to attend on that day.

New York.

Read an order of the Lords of the Committee of Council for Plantation Affairs, dated May 23rd, 1771, referring to this Board, for their consideration and report, a petition of Lieutenant Donald Campbell to the King, praying, for the reasons therein set forth, that his Majesty will be pleased to order a revisal of an Order in Council of the 10th September, 1766, for granting to him, his brothers and sisters, thirty five thousand acres of land in the province of New York, and in lieu thereof to grant him one hundred thousand acres upon the terms of the royal proclamation of the 7th of October, 1763, with indulgence agreeable to Governor Cosby's encouragements of locating the same in such parts or parts of the said province, and on lands fit for cultivation, as the petitioner may think convenient, and in lots not less than five thousand acres, to enable him to support himself, his brothers and sisters.

Lieutenant Donald Campbell attending, was called in, and heard in what he had to offer on the subject matter of his petition.

Ordered, that the draught of a report to the Lords of the Committee of Council thereupon be prepared.

North Carolina, South Carolina.

Read an order of the Lords of the Committee of Council for Plantation Affairs, dated May 25th, 1771, directing that this Board do prepare and lay before them, draughts of additional instructions to the Governors of North Carolina and South Carolina for the settling of a final boundary line between those provinces, conformable to the report of this Board of the 24th of April last.

North Carolina, South Carolina.

The draughts of additional instructions to the Governors of North Carolina and South Carolina, conformable to the directions of the said order, having been prepared, were approved, and a report to their lordships thereupon was signed.

Nova Scotia.

Read a memorial and petition of the Revd. Dr. Breynton, Rector of St. Paul's, Halifax, in Nova Scotia, in behalf of the parishioners, to the Board, dated May 22nd, 1771, setting forth the expences they have incurred in ornamenting and repairing the said church, and their inability to accomplish what is immediately wanted, and praying their lordships to allow them such assistance, as they shall think proper.

Ordered, that the said memorial be taken into consideration, when the next estimate for the service of Nova Scotia shall be prepared.

New York.

Read a petition of Major Robert Rogers, praying to be recommended for a grant of twenty thousand acres of land in New York.

Ordered, that the said petition do lye by for further consideration, with the several petitions for land, mentioned in the minutes of the 10th instant.

East Florida.

Their lordships took into consideration the state of the Council of East Florida, together with a letter from the Governor of that colony to the Earl of Hillsborough thereupon, and ordered, that the draught of a representation to his Majesty be prepared, recommending the establishment of the said Council, conformable to the rank which each person holds in the said Council under the Governor's appointment.

Antigua.

St. Christopher's, Montserrat.

The draughts of representations to his Majesty, proposing the disallowance of three Acts passed, the one in the Island of Antigua, the other in the Island of St. Christopher, and the third in the Island of Montserrat, having been prepared pursuant to the minutes of the 22nd instant, were approved, transcribed and signed.

The further consideration of the business relative to the lands on the west side of Connecticut river, was postponed to another opportunity.

Their lordships took into further consideration the reference from the Lords of the Committee of Council of Mr. Crooke's petition, mentioned in the minutes of Wednesday last, and Mr. Hamersly, the petitioners' agent, attending, was heard in what he had to offer thereupon.

fo. 142.

It appearing that the obstruction to the course of justice complained of by Mr. Crooke, arose from the want of a proper number of members of the Council resident on the Island, not interested in the suit in question, to compose a Court of Errors, and there being now two vacancies in the Council, their lordships ordered the draught of a representation to his Majesty to be prepared, recommending Stephen Payne Gallway and William Wells, Esquires, to supply the said vacancies, by whose appointment, if approved by his Majesty, together with an appointment of two other persons, which has been made since Mr. Crooke's petition was presented, and by the return to the said Island of one of the absent members, their lordships were of opinion, that the obstruction complained of will be removed.

St. Christopher's.

A representation to his Majesty, recommending Stephen Payne Gallway and William Wells, Esquires, to be of the Council of St. Christopher's, having been accordingly prepared, was signed; as was also a report to the Lords of the Committee of Council upon Mr. Crooke's petition.
