Journal, November 1733

November 1. Present:—Mr. Docminique, Sir O. Bridgeman, Sir A. Croft.

Barbadoes.

New Councillor recommended.

Mr. John Sharpe, agent for Barbadoes, attending, acquainted the Board in behalf of the Lord Howe, Governor of Barbadoes, with the death of Mr. Leslie, one of the Council there, and with Lord Howe's desire that the Board would please to recommend Mr. Peers to supply the said vacancy; and the Board was pleased to agree thereto, when their Lordships shall receive any account from the Lord Howe of Mr. Leslie's death.

Massachusetts.

The Governor's Act, salary.

An Order of the Lords of the Committee of Council, of 2nd November, 1733, referring to the Board the memorial of Mr. Belcher, in behalf of his father, Governor of New England, praying leave to pass an Act for giving him £3000, was read; and directions were given for preparing the draught of a report, proposing the allowance thereof.

Plantations General.

State of the islands.

The Board then took into consideration the draught of a general report upon the state of the British islands in America, and made a progress therein.

Barbadoes.

Letters from the Governor.

Two letters from the Lord Viscount Howe, Governor of Barbadoes, dated 13th June and 2nd September, 1733, were read, and the papers, therein referred to, were laid before the Board, viz:—
Minutes of Council, from 12th April to 26th June, 1733.
Minutes of Assembly, from 17th April to 13th July, 1733.

A letter from Mr. Berwick, President of the Council of Barbadoes, dated the 16th October, 1732, was also read.

Councillor recommended.

A representation proposing Mr. Peers, junior, to be of the Council of Barbadoes, in the room of Mr. Leslie, deceased, as desired by the Lord Howe, was agreed and signed.

Massachusetts.

Governor's salary, Act.

The draught of a representation, ordered to be prepared at the last meeting, proposing to allow Mr. Belcher, Governor of the Massachusetts Bay, in New England, to give his assent to an Act, passed there, giving him £3000, was agreed.

Representation thereupon.

The representation, proposing to allow Mr. Belcher, Governor of the Massachusetts, to pass an Act giving him £3000, agreed at the last meeting, was signed.

Plantations General.

State of the islands.

The draught of a general report upon the state of the British islands in America, mentioned in the Minutes of the 6th instant, was again considered, and a progress made therein.

November 15. Present:—Mr. Bladen, Sir O. Bridgeman.

Their Lordships made a further progress in considering the general report upon the state of the British islands in America, mentioned in yesterday's Minutes.

St. Christophers.

Nevis.

Councillors removed.

Copy of an Order in Council of the 19th July, 1733, directing Wavel Smith's name to be left out of the Council of St. Christophers, and Mr. Bridgewater's out of the Council of Nevis, unless they forbear to act in the present offices, as they do at present.

Leeward Islands.

Governor's instructions approved.

Copy of an Order in Council of July 19th, 1733, approving Governor Mathew's instructions, with the alteration of one Councillor in Nevis, and of another in St. Christophers.

North Carolina.

Validity of the laws.

The memorial of Gabriel Johnstone, Esq., praying that the representation of Mr. Smith, Chief Justice of North Carolina, relating to the validity of the laws in that province, may be referred to the Solicitor General, for his opinion thereon, was read; and directions were given for sending a copy of the said representation to Mr. Attorney and Mr. Solicitor General, for their opinion thereupon in point of law.

South Carolina.

Letter from the Governor, with two affidavits, sent to the Duke of Newcastle.

A letter from Colonel Johnson, Governor of South Carolina, dated the 17th of September, 1733, enclosing two affidavits of the loss of the Spanish Flota, was read.

Ordered that copies of the said depositions be sent to his Grace the Duke of Newcastle, for His Majesty's information.

Trade.

East India Company's exports.

Order in Council of 1st November, 1733, referring to this Board an account of the East India Company's exports, between Michaelmas, 1732, and Michaelmas, 1733, was read; and directions were given for adding the same to the other East India accounts, upon which the draught of a representation was ordered to be prepared the 25th of July last.

Antigua.

Memorial, stores of war.

A memorial from Mr. Yeamans, agent for Antigua, praying for stores of war, for the use of the Island of Antigua, was read, and directions were given that Mr. Yeamans should attend the Board thereupon on Tuesday morning next.

Jamaica.

Ordered that a letter be wrote to Mr. Burchet, to desire he will move the Lords of the Admiralty for a copy of what Sir Challoner Ogle has written, concerning the late defeat of the party sent out against the rebellious negroes in Jamaica.

Ordered that the draught of a representation be prepared for appointing Mr. Halls of the Council of Jamaica, in the room of Mr. Moore, deceased.

Acts sent to Mr. Fane.

Ordered that the public Acts, transmitted with General Hunter's letters, be sent to Mr. Fane, for his opinion thereupon in point of law.

New York.

Letter from the chief Justice, complaining of his being removed.

A letter from Mr. Morris, dated at New York, August 27th, 1733, complaining against Colonel Cosby, for removing him from his office of Chief Justice there, was read, and the papers, therein referred to, were laid before the Board, viz:—
Copy of a letter from a gentleman at New York, to his friend in London, about the Governor's taking a present from the Assembly.
The opinion of the Chief Justice of New York, concerning the jurisdiction of the Supreme Court there to determine causes in a course of equity.

Letter from the Governor, Chief Justice removed.

The Secretary laid before the Board the extract of a letter from Colonel Cosby, Governor of New York and New Jersey, relating to his having removed Mr. Morris from being Chief Justice of New York, which was read.
