Miscellanies.

Mr. Lowndes' protests against the Board's favour to the Secretary.

Board's resolves thereon.

The Secretary presented to the Board a paper he had received from Mr. Lowndes, entituled, Thomas Lowndes's protest against the Lords Commissioners declared prepossession in favour of their Secretary, which was read [fos. 32, 167]; and Mr. Lowndes not attending, their Lordships came to the following resolution, viz: "The Board, having perused several papers left with them by Mr. Thomas Lowndes, consisting of letters and memorials, relating to Colonel Horsey's petition for a tract of land in South Carolina, and finding the same to contain many false and malicious assertions, to the discredit of this Board and of their Secretary; they appointed this day for the said Lowndes to attend and justify his proceedings therein, if he could, which he has refused to do; whereupon the Board have resolved to have no further correspondence with the said Lowndes, nor to receive any papers, letters or memorials for the future from him, and have directed their Secretary to communicate this resolution to the said Lowndes, whenever he shall come to this office" [vide infra, fo. 172].

New York.

Mr. Goodwin objects against an Act.

Act sent to Mr. Fane.

A petition from Mr. Goodwin and his wife against a private Act of New York, passed in 1719, for annulling and making void a fraudulent conveyance of Mary Davenport, made by her when she was sole, was read; and directions were given for sending the said Act to Mr. Fane, for his opinion thereupon in point of law.

Barbadoes.

Stores of war wanting.

Mr. Leheup and Mr. Sharpe, agents for Barbadoes, attending, a memorial from them, desiring stores of war may be sent thither, was read; and the Board taking into consideration a letter from Lord Howe, Governor of that island, upon the same subject, directions were given for preparing the draught of a representation thereupon.

South Carolina.

Mr. Fane's report on Beresford's Act.

Mr. Fane's report, dated January 28th, 1733–4, on an Act passed in South Carolina for settling the estate of Richard Beresford, Esq., deceased, was read; ordered that Mr. Beresford be desired to attend the Board on Tuesday next.

Trade.

Russia treaty of commerce considered.

Mr. Holden, Governor of the Russia Company, attending, as he had been desired, with Mr. Nettleton and several members of the said Company, and the Board taking again into consideration the letter from the Lord Harrington, read the 27th of the last month, referring to this Board several papers received from the Lord Forbes, relating to the articles of commerce proposed between Great Britain and Russia; Mr. Holden desired copies of the said papers, that they might consider the same; and promised to let the Board have their opinion thereupon in writing in a few days; whereupon copies were given them accordingly.

Antigua.

Letter from the Governor, with papers.

A letter from General Mathew, Governor of the Leeward Islands, dated the 20th December, 1733, with an Act of Antigua for settling an additional salary on him, and transmitting also:—
Leeward Islands.
Recommendations of persons for Councillors.
A list of six persons in each of the Islands of Antigua and Nevis, recommended by General Mathew, to fill up vacancies in the Councils of those islands.
Minutes of Council of Antigua, from the 31st October, the day General Mathew published his commission, to the 29th of November, 1733.
Journal of the Assembly of Antigua, from the 12th to the 29th of November, 1733.
Antigua.
Act for Governor's additional salary sent to Mr. Fane.
An Act for providing an honourable support for his Excellency William Mathew, Esq., during his Government, etc.
and directions were given for sending the said Act to Mr. Fane, for his opinion thereupon in point of law.

Barbadoes.

Report for stores of war.

The representation, ordered yesterday to be prepared, upon the Lord Howe's letter, and the memorial of the agents of Barbadoes, desiring some stores of war to be sent thither, was agreed and signed.

March 19. Present:—Mr. Ashe, Sir O. Bridgeman.

South Carolina.

Beresford's Act to be repealed.

Mr. Beresford attending, as he had been desired, the Board acquainted him, that having considered the Act, entituled, An Act for settling the estate of Richard Beresford, Esq., deceased, passed in Carolina in 1723–4, they proposed laying the same before His Majesty for his disallowance [fos. 36, 66], but that, as the repeal of this Act would deprive his brother from the benefit thereby intended him, they hoped he would take care of him; upon which Mr. Beresford said, that he was now going to Carolina, where he promised not only to give his brother a liberal education, but to provide for him.

Ordered that the draught of a representation be prepared for repealing the said Act.

Trade.

Russia treaty further considered.

The Secretary then laying before the Board a letter he had received from Mr. Holden, Governor of the Russia Company, with that Company's observations on the treaty of commerce with Russia, the same was read; and directions were given for preparing the draught of a representation thereupon.

Leeward Islands.

Governor's letters, and papers.

Three letters from General Mathew, Governor of the Leeward Islands, were read, viz:—
Letter from Mr. Mathew, Governor of the Leeward Islands, dated December 20th, 1733.
List of six persons recommended by General Mathew as proper to fill up vacancies in each of the Councils in the four islands.

Letter from Governor Mathew, of 17th January, 1733–4, complaining of the great want of stores of war, and of their weak state of defence, with a
List of ordnance stores of war, etc., wanting in the Leeward Islands.

Letter from General Mathew to the Secretary, dated January 18th, 1733–4, giving an account of a box of papers sent by the same ship.

Antigua.

Act for Governor's additional salary to be confirmed.

Mr. Fane's report, dated the 12th instant, on an Act, passed at Antigua in 1733, for providing an honourable support for William Mathew, Esq., during his government, was read, and directions were given for preparing the draught of a representation for confirming the same.

Jamaica.

Letters from Governor, report for a new Councillor, signed.

Two letters from General Hunter, Governor of Jamaica, the first dated December 24th, 1733, with a list of Acts passed there in 1733, with some remarks thereon, etc.; the second dated December 29th, 1733, signifying the death of Mr. Laws, one of the Council there, and recommending others to supply vacancies at that Board, were read; and the Board observing a vacancy in the Council of that island, by the death of James Laws, a representation, for recommending Temple Laws, Esq., to supply the same, was agreed and signed, as also

Antigua.

Report for Governor's additional salary, signed.

The representation, ordered yesterday to be prepared, for proposing the confirmation of the Act for providing an honourable support for his Excellency William Mathew, Esq., during his government, etc., passed at Antigua in November, 1733, was signed.

Leeward Islands.

Letter from Governor, stores of war wanting, papers sent.

Two letters from General Mathew, Governor of the Leeward Islands, one to the Board, dated 17th January, 1733–4, complaining of the great want of stores of war, and of their weak state of defence; the other to the Secretary, dated the 18th of January, 1733–4, giving an account of a box of papers sent by the same ship, were read; and their Lordships resolved to consider further thereof at another opportunity.

Nova Scotia.

Mr. Fane's report on Mrs. Campbell's surrender of land to the Crown.

Mr. Fane's report, dated the 4th of March, 1733–4, on Mrs. Campbell's proposal to surrender her right to the Crown, and method of doing it, was read; and their Lordships being of opinion that two thousand pounds was a reasonable sum to pay Mrs. Campbell in consideration of her making over to His Majesty all her right and claim in Nova Scotia, directions were given for writing to Mr. Scrope accordingly, in answer to his letter upon this subject, read the 21st of the last month.

South Carolina.

Report, for appeal of the Appropriation Act. signed.

The report to the Lords of the Committee, agreed the 20th of the last month, proposing the repeal of the Act, passed in South Carolina in 1731, for appropriating the sum of £104,725 in paper money for the payment of the publick debts, was signed [fos. 28, 127].

Nova Scotia.

Letter to Treasury on Mrs. Campbell, value of land.

The letter, ordered yesterday to be prepared, to Mr. Scrope, relating to Mrs. Campbell's claim to certain lands and quit rents in Nova Scotia, with the Board's opinion that £2000 is a reasonable sum to pay her for the same, was agreed and ordered to be sent.

Trade.

Letter from the Lord Harrington, dated March 8th, 1733–4, with

Grainger's heiresses in Sweden.

An extract of a letter from Mr. Finch to Lord Harrington, relating to pretensions upon the heiresses of Mr. Grainger at Stockholm, and the draught of a declaration proposed to be made by his Swedish Majesty thereon, with some observations on the same, were read, and ordered that the Swedish merchants be desired to attend the Board on Tuesday morning next thereupon.

Miscellanies.

Account of incidents, sent to Treasury.

The Secretary laid before the Board the accounts of the incidental charges of this office, from Christmas, 1733, to Lady Day, 1734, and a letter to the Lords of the Treasury, desiring payment thereof, as also of the salary due to the Secretary and other officers in the service of this commission, was signed.

New York.

Goodwin's Act further considered.

Mr. Fane's report upon an Act, passed at New York in 1719, for annulling and making void a fraudulent conveyance of Mary Davenport, made by her when she was sole, by the name of Mary Miserol, to one James Brown of certain lands, etc., was read, and their Lordships, after some discourse with Mr. Fane thereupon, resolved to consider further thereof to-morrow sennight, and ordered that Mr. Paris, who applies against the said Act in the behalf of Mr. Goodwin, whose petition was read the 15th of the last month, should attend at the same time.

Trade.

Commerce with Russia.

Their Lordships taking into consideration the draught of a representation, ordered to be prepared the 19th instant, upon a project of a treaty of commerce with Russia, the same was agreed.

St. Christophers.

Report for confirming Crooke's Act, signed.

Mr. Fane's report on an Act for barring and cutting off all estates tail and estates in remainder, limited and appointed by Clement Crooke, Esq., deceased, and for vesting an estate in fee simple in Clement Crooke, Esq., his eldest son, etc., was read, as also the said Act, and a representation, proposing the confirmation of the said Act, was agreed and signed.

Trade.

Report on Russian treaty. signed.

The representation, agreed yesterday, upon the project of a treaty of commerce with Russia, was signed, as also a letter, inclosing the same to the Lord Harrington.

St. Christophers.

Mr. Payne's relations enquired into.

An Order of the Committee of Council, of 22nd March, 1733, directing the Board to enquire what relations Mr. Payne has in the Council of St. Christophers, was read, and directions were given that Mr. Yeamans, agent for Antigua, should be desired to give the Board an account of this matter on Tuesday morning next.

New York.

Miserol's Act objected to.

A letter from Mr. Paris, with a memorial to the Board, desiring the repeal of an Act, passed at New York in 1719, for making void a conveyance made by Mary Miserol, and to have a copy of a paper left in the office by General Hunter in behalf of the said Act, was read, and directions were given that he should have a copy accordingly.
