North Carolina.

Order of the Committee of Council.

Complants against Sir Richard Everard.

An Order of the Lords of the Committee of Council, dated the 31st of the last month, referring to this Board the copy of an address from the members of the Council for North Carolina, containing complaints against Sir Richard Everard, Deputy Governor of that province, and requiring the Board to examine into the allegations thereof and report their opinion thereupon, was read, together with the copy of the said address.

Another Order of the Lords of the Committee of Council, of the same date, referring to this Board the copy of a letter from Sir Richard Everard, Deputy Governor of North Carolina, to the Duke of Newcastle, with a copy of Sir Richard's orders and resolutions, delivered to the Council of that province, about granting lands and filling vacant places in that Government, and requiring the Board to examine into the same, and report their opinion thereupon, was read, together with the said papers; whereupon directions were given for inquiring who appears or solicits in behalf of Sir Richard Everard, and of the members of the Council for North Carolina, in order to their bringing what proofs they have to offer in support of their respective allegations.

Draught of representation to be prepared.

A third Order of the Lords of the Committee of Council, dated the 31st of the last month, referring back to this Board their letter of the 20th of May, 1729, to his Grace the Duke of Newcastle, with a copy of one from Major Gooch, Lieutenant Governor of Virginia, relating to some difficulties in forming a rent roll for the two new counties of Spotsylvania and Brunswick in that colony, and requiring the Board to lay before the said Committee a state of the fact, and also an account of the number of acres taken up, for which no quit rents or purchase of rights have hitherto been paid, with the amount of such rights and quit rents, and likewise to report what they think advisable to be done thereupon, was read, and directions were given for preparing the draught of a representation accordingly.

Difficulties in preserving trees.

A fourth Order of the Lords of the Committee of Council, of the same date, referring to this Board the copy of a letter from the Lords of the Admiralty to the Duke of Newcastle, and of letters to Mr. Dunbar, Surveyor of His Majesty's Woods on the continent of America, relating to difficulties in preserving such trees as are proper for masting of ships from the inhabitants of New England, and requiring this Board to examine into the same and report what they conceive necessary to be done thereupon, was read, and directions were given for preparing the draught of a representation on that subject.

Letter to Mr. Worseley signed.

A letter to Mr. Worsley, Governor of Barbadoes, agreed at the last meeting, was signed.

Letter to the Duke of Newcastle.

Copies of Mr. Worseley's papers, signed.

A letter to his Grace the Duke of Newcastle, for inclosing copies of Mr. Worseley's letters of the 1st and 15th of June, 1729, and of the papers therewith transmitted, relating to the disputes which have happened in Barbadoes about the validity of the Act passed there for supporting the honour and dignity of the Government, in order to their being laid before His Majesty, was signed.

Pennsylvania.

Letter from Mr. Lowndes.

Imposition on the arrival of Palatines.

South Carolina.

This affair to be recommended to a new Governor.

A letter from Mr. Thomas Lowndes, of the 7th instant, relating to an imposition in Pennsylvania upon such Palatines as shall arrive there for the future, and proposing encouragement for some of the same nation to settle in South Carolina, was read; whereupon their Lordships agreed, when a Governor for South Carolina shall be nominated, to recommend to him the encouraging such protestants as shall arrive from the Palatines to settle there.

Montserrat.

Acts considered.

Their Lordship then took into consideration two Acts, passed in His Majesty's island of Montserrat, the 27th of March, 1729, intituled.
An Act for the establishing of a Court of King's Bench and Common Pleas, etc.
An Act of Settlement and Limitations for avoiding suits at law.

Whereupon ordered that the said Acts be sent to Mr. Attorney and Mr. Solicitor General, for their opinion thereon in point of law.

Quit rents.

Their Lordships also took into consideration the draught of a representation, ordered at the last meeting to be prepared, to the Lords of the Committee of Council, relating to the quit rents and purchase of rights for taking up land in the two new counties of Brunswick and Spotsylvania in the colony of Virginia, and made a progress therein.

Jamaica.

Letter from the Duke of Newcastle and from the Admiralty.

Lynch's island.

A letter from the Duke of Newcastle, of the 11th instant, referring to this Board a letter from the Lords of the Admiralty relating to some land in Lynch's island on the coast of Jamaica, which is necessary to be vested in the Crown for the use of His Majesty's navy, was read, and some directions given for preparing the draught of a representation thereupon.

The draught of a representation to the Lords of the Committee of Council, relating to the quit rents and purchase of rights for taking up land in the two new counties of Brunswick and Spotsylvania in the colony of Virginia, as mentioned in the Minutes of the last meeting, was agreed and ordered to be transcribed.

Representation, Quit rents, signed.

A representation to the Lords of the Committee of Council relating to the quit rents and purchase of rights for taking up land in the two new counties of Brunswick and Spotsylvania in the colony of Virginia, as agreed at the last meeting, was signed.

Jamaica.

Representation, Lynch's island, signed.

The draught of a representation to her Majesty, ordered yesterday to be prepared, upon the letters from the Duke of Newcastle, and from the Lords of the Admiralty, relating to some land in Lynch's island on the coast of Jamaica, which is necessary to be vested in the Crown for the use of His Majesty's navy, was agreed, transcribed and signed, together with a letter for inclosing the same to his Grace the Duke of Newcastle.

North Carolina.

Captain Burrington, late Deputy Governor of North Carolina, attending, the undermentioned papers, lately received from him, concerning that province, were laid before the Board, viz:—
The Journal of the Lower House of Assembly, from the 1st of November, 1725, to the 14th of April, 1726.
Copy of a letter from Captain Burrington, late Deputy Governor of North Carolina, to the lord proprietors, without date, complaining of his being removed, and giving some account of the affairs of that province.
Copy of the declaration of Sir Richard Everard, present Deputy Governor of North Carolina, dated the 6th of January, 1728–9, owning his having been imposed on by Mr. Lovick, the Secretary, Mr. Gale, Chief Justice, and Mr. Little, Attorney General.

The two Orders of the Lords of the Committee of His Majesty's most honourable Privy Council, both dated the 31st of July last, and mentioned in the Minutes of the 7th instant, the one referring to this Board the copy of an address from the members of the Council for North Carolina to His Majesty, containing complaints against Sir Richard Everard, Bart., Deputy Governor there, the other referring likewise to this Board the copy of a letter from Sir Richard Everard to the Duke of Newcastle, with a copy of Sir Richard's orders and resolutions delivered to the Council of that province, being now again read, together with the said copies of papers, their Lordships, after discoursing with Captain Burrington thereupon, gave directions for preparing the draught of a report in answer to the Orders of the Lords of the Committee of Council abovementioned.

Antigua.

Securing water for the use of the navy.

An Order of Council, of the 18th instant, upon a memorial from the Lords of the Admiralty to Her Majesty, relating to the securing of water at the island of Antigua for the use of His Majesty's ships, as also about lands near English Harbour, moderating the price of fuel and maintaining some fortifications proposed for that island, and requiring this Board to consider the same and to prepare the draught of an instruction to the Earl of Londonderry, Governor of the Leeward Islands, on these heads, was read; whereupon directions were given for writing to Mr. Burchet, Secretary to the Lords of the Admiralty, to desire he will move their Lordships that the Board of Trade may have copies of such proposals as the Council of Antigua, or merchants trading thither, have made concerning the said fortifications, and of such minutes or other papers, as relate to the assurances already given by the merchants to the Navy Board, relating to the repair thereof, in order to the better forming the draught of an instruction according to His Majesty's commands.

Warrants.

New Seals.

An Order of Council, of the 18th instant, requiring this Board to prepare draught of warrants to be sent with the new seals for Barbadoes, Jamaica, Virginia and South Carolina, for impowering the Governors or Commanders in Chief of those colonies to use the said seals, etc., was read, and directions given for preparing the draughts of warrants accordingly.

August 27. Present:—Mr. Bladen, Mr. Cary.

North Carolina.

The draught of a report, directed yesterday to be prepared, to the Lords of the Committee of the Privy Council, relating to the complaints from the Council of North Carolina against Sir Richard Everard, Deputy Governor of that province, and to Sir Richard's complaint against the said Council, was agreed and ordered to be transcribed.

Bermuda.

Ordered that a letter be writ to Captain Pitt, Lieutenant Governor of Bermuda, to acknowledge the receipt of his of the 30th of April last, and acquaint him what this Board have done thereupon.
