Journal, October 1751

Tuesday, October 8. Present:—Lord Dupplin, Mr. Fane.

New Jersey.

The draught of an additional instruction to the Governor of New Jersey relative to the riots and disorders which have so long subsisted in that province and also the draught of a report to the Lords of the Committee of Council thereupon having been prepared pursuant to the minutes of the 6th of August last, were laid before the Board, agreed to and ordered to be transcribed.

New York.

Read an Order of the Lords of the Committee of Council, dated the 6th of August, 1751, directing this Board to prepare a draught of an instruction or instructions for the Governor of New York, as proposed in their report to the said Lords of the Committee upon the present state and condition of his Majesty's said province.

Ordered that the draught of an instruction or instructions be accordingly prepared.

Nova Scotia.

Read a memorial of Mr. Kilby, agent for the affairs of Nova Scotia, dated the 7th of October, 1751, desiring the Board's directions for his applying to the Lords of the Treasury for payment of £11,008 0s. 7d. for the discharge of bills drawn by the Governor for the service of that settlement and of other demands relative thereto.

Ordered that Mr. Kilby do apply to the Lords Commissioners of his Majesty's Treasury to enable him to receive the said sum of £11,008 0s. 7d. from the receipt of his Majesty's Exchequer for the above-mentioned services.

Ordered that Mr. Kilby do with all possible dispatch examine the accounts transmitted by Governor Cornwallis of the expences which have arisen within the province of Nova Scotia and prepare an estimate of what will be necessary for the further settling and improving it the next year.

Wednesday, October 9. Present:—Lord Dupplin, Mr. Fane.

Nova Scotia.

Mr. Laws, agent for Mr. Townshend, contractor with the Lords Commissioners of his Majesty's Treasury for supplying 2,500 settlers in Nova Scotia with provisions for the year 1751, attending, moved the Board to give directions to Mr. Townshend to apply to the said Lords Commissioners of the Treasury for payment of £5,687 10s. 0d., due to him on the said contract; at the same time he acquainted the Board that the provisions delivered in Nova Scotia, as appears by certificates of the Governor transmitted to Mr. Townshend by his agent, together with bread, flour and pease, which were shipped on board a vessel that sailed on the 7th instant, amounts to the sum of £13,687 10s. 0d., appropriated for that service, so that Mr. Townshend has actually performed his part of the contract; he further acquainted the Board that he believed Mr. Townshend would be well satisfied to receive £4,500 of the said sum of £5,687 10s. 0d. at present, to be paid the remainder when other demands for the service will admit, and then he withdrew.

Ordered that the Secretary do transmit to the Secretary of the Lords Commissioners of his Majesty's Treasury to be laid before that Board, a state of the money granted for the service of Nova Scotia for the year 1751, distinguishing the sum granted by Parliament, what part thereof was to be expended in England and what remained to be drawn for by the Governor, and also how much hath been paid or drawn for under each head, together with extracts of such parts of the Board's last letter to Governor Cornwallis and his answer thereto, as relate to this subject.

Proprieties.

Connecticut.

Read a letter from Mr. Wolcott, Governor of Connecticut, dated the 31st of December, 1750, in answer to the Board's letter of the 19th of July, 1750, for an account of the boundaries of that colony and of the encroachments made upon the same by the subjects of foreign princes.

Read a letter from Mr. Wolcott, Governor of Connecticut, dated Windsor, the 28th of May, 1751, in answer to one from Mr. Hill inclosing three Acts of Parliament passed in 1750, and transmitting certificates of furnaces for making of steel mills or engines for rolling iron, and plating forges erected in that colony, pursuant to the directions of one of the said Acts of Parliament.

Jamaica.

Read the following letters and papers lately received from Mr. Trelawney, Governor of Jamaica:—
Letter from Mr. Trelawney, Governor of Jamaica, to the Board, dated the 15th of April, 1751, transmitting:—
Minutes of Council between the 27th of February and the 17th of November, 1750.
Council in Assembly between the 20th of January and the 17th November, 1750.
Minutes of Assembly from the 18th September to the 17th November, 1750.
Act passed at Jamaica between the 27th of October and the 17th of November, 1750.

Letter from Mr. Trelawney, Governor of Jamaica, to the Board, dated the 4th July, 1751, inclosing the following paper, viz.:—
Extracts of several letters which past between Governor Trelawney and the Spanish Governor of St. Iago de Cuba about negroe slaves that run away from Jamaica to Cuba being protected there.

Ordered that the above-mentioned Acts be sent to Mr. Lamb for his opinion thereupon in point of law.

Ordered that the last-mentioned letter and paper be copied to be transmitted to the Earl of Holdernesse, his Majesty's Secretary of State, and that the draught of a letter to his Lordship therewith, be prepared.

Jamaica.

Read a letter from Mr. Moore, Deputy Secretary of Jamaica, to the Board, dated the 9th of July, 1751, transmitting a list of persons naturalized in that Island between the 1st of June, 1750, and the 1st June, 1751.

Maryland.

Read a letter from Captain Ogle, Lieutenant-Governor of Maryland, to the Board, dated the 11th of June, 1751, containing an account of the boundaries of that province.

Trade.

Custom House.

Read a letter from Mr. Wood, Secretary of the Customs, dated the 20th of August, 1751, with a copy of the Inspector-General's leidger of imports and exports for the year 1748.

New Jersey.

Read a letter from Mr. Belcher, Governor of New Jersey, to the Board, dated at Burlington, the 1st of July, 1751, acquainting the Board with the conduct of the new Assembly, and transmitting the following papers, viz.:—
Minutes of Council at a session of the General Assembly held at Perth Amboy in May and June, 1751.
Printed votes of the Assembly in the same session.
Four Acts passed at Perth Amboy, the 6th of June, 1751.

Ordered that the said Acts be sent to Mr. Lamb for his opinion thereupon in point of law.

Ordered that the said letter be copied to be transmitted to the Earl of Holdernesse and that the draught of a letter to his Lordship therewith be prepared.

Read a memorial of Mr. Partridge, agent of New Jersey, dated the 5th of August, 1751, praying the Board's favourable recommendation of William Morris, Esquire, to supply a future vacancy in the Council of that province, and inclosing the following papers, viz.:—
Certificate of the grand inquest of New Jersey in behalf of William Morris, Esquire, dated Trenton, May 25th, 1751.
Certificate of several gentlemen of Philadelphia in behalf of William Morris, Esquire, of Trenton in the province of New Jersey, dated at Philadelphia, the 27th of May, 1751.
Certificate of the judges of the province of New Jersey in behalf of William Morris, Esquire, certifyed by the Mayor of Philadelphia under the seal of that city, the 28th of May, 1751.
Certificate of several gentlemen of New Jersey in behalf of the character of William Morris, Esquire.

Bermuda.

Read a letter from Mr. Popple, Governor of Bermuda, to Mr. Hill, dated the 29th of July, 1751, transmitting the following protests, viz.:—
Two protests of masters of vessels on some violences committed by the Spaniards at Turks Islands, dated the 15th July, 1751.

Ordered that the said letter and protests be copied to be transmitted to the Earl of Holdernesse and that the draught of a letter to his Lordship therewith be prepared.

Leeward Islands.

Read a letter from Lieutenant-General Fleming, Commander in Chief of the Leeward Islands, to the Board, dated at St. Christopher's, the 9th of July, 1751, containing an account of the proceedings in the several Islands under his government in support of their claim of taxing publick bills, and transmitting:—
A message from the Assembly to the Commander in Chief of St. Christopher's in Council on the 8th July, 1751.

Nova Scotia.

Read the following letters lately received from Colonel Cornwallis, Governor of Nova Scotia, viz.:—

Letter from Colonel Cornwallis, Governor of Nova Scotia to the Board, dated at Halifax, the 24th of July, 1751, inclosing copy of some intelligence he had lately received from Louisbourg of the naval strength and designs of the French.

Ordered that copies of the two first letters be delivered to Mr. Kilby.

Ordered that the two last-mentioned letters be copyed to be transmitted to the Earl of Holdernesse and that the draught of a letter to his Lordship be prepared.

Read a letter from Lieutenant-Colonel Mascarene, LieutenantGovernor of Nova Scotia, dated at Annapolis Royal, the 5th of June, 1751, recommending Captain John Gorham to the favour of this Board for the services he has done and the expences he has been at in the part he has acted from the beginning of the late war in the defence of that province.

Nevis.

Thursday, October 10. Present:—Lord Dupplin, Mr. Fane.

Read a letter from Wavell Smith, Secretary of the Leeward Islands, to the Secretary of this Board, dated at St. Christopher's, the 7th of July, 1751, inclosing a copy of his letter to LieutenantGeneral Fleming, dated the 17th of January, 1750–1, and also a copy of the deposition of Mr. Archibald Calder, Deputy Secretary of Nevis, relative to the minutes of Council upon the contest concerning the repeal of the Papist law in that Island, together with a copy of General Fleming's answer to Mr. Wavell Smith's letter on that head, for the information of this Board.

Wednesday, October 23. Present:—Earl of Halifax, Mr. Pitt, Mr. Grenville, Mr. Townshend.

New Jersey.

The draught of a report to the Lords of the Committee of Council, with the draught of an additional instruction for the Governor of New Jersey relative to the riots and disturbances in that government, having been transcribed pursuant to the minutes of the 8th instant, was laid before the Board and signed.

Plantations General.

Their lordships having resumed the consideration of the memorial of the merchants, sugar planters and others, trading to and interested in his Majesty's sugar colonies, complaining of the illicit trade carried on from the northern colonies to the French and other foreign settlements, ordered the Secretary to write to the agents of the several northern colonies respectively, and also to Mr. Sharpe, agent for the planters, to desire their attendance at the Board on Tuesday, the 5th of November next.

Nova Scotia.

Read the following letters lately received from the Honourable Edward Cornwallis, Governor of Nova Scotia, viz.:—
Letter from Colonel Cornwallis to the Board, dated at Halifax, the 29th June, 1751, containing advice of a bill drawn by him for the service of Nova Scotia.
Letter from Colonel Cornwallis to the Board, dated at Halifax, the 4th of September, 1751, with an account of bills drawn by him since May last upon the agent, for sundry services.

Ordered that copies of the above letters be delivered to Mr. Kilby.

Nova Scotia.

Read the following letter and papers from the Honourable Edward Cornwallis, Esquire, Governor of Nova Scotia, viz.:—
Letter from Colonel Cornwallis to the Board, dated the 4th of September, 1751, containing an account of the present state of that province and transmitting:—
Copy of a letter from him to the Board, dated the 1st of January last.
Minutes of Council in the months of December, January and February last.
Minutes of Council from the 1st of June to the 1st of December.
Treasurer's quarterly accounts and vouchers.

Letter from Colonel Cornwallis to the Board, dated the 4th of September, 1751, acquainting them that Mr. Townshend has failed in the performance of his contract for supplying the settlers with provisions and transmitting:—
Copy of a letter from Messrs. Levy and Franks, merchants at Philadelphia, to Mr. Townshend's agent at Nova Scotia relating to a supply of bread and flour for the settlers.

Ordered that the Secretary do write to Mr. Townshend to desire his attendance at the Board on Tuesday, the 5th of November.
