Upon reading the Petition of Sir Richard Sprignall, against Sir Michaell Livesey:
It is ORDERED, To be taken into Consideration when the Act of Indemnity is brought up from the House of Commons.
Gerrard's Petition.
Upon reading the Petition of Radcliffe Gerrard, &c.
It is ORDERED, To be referred to the Consideration of the Committee for Petitions, to hear the Parties concerned therein, and to report to this House.
L. Berkeley and L. Delawar, Precedency.
The Earl of Dorsett reported from the Committee for Privileges, "That the Lord Berkeley of Berkeley making his Claim of Precedency to the Lord De la Warr, according to his Salvo entered in the House of Lords, the Lords Committee are of Opinion, That the said Lords should be heard, by Counsel, at this Bar, at what Day their Lordships shall appoint for the same."
It is ORDERED, That this Business shall be heard, by Counsel, at this Bar, on Tuesday the 17 July next; and the Lord De la Warr is to have Notice hereof.
ORDERED, That the Committee of Privileges shall hereby have Power to summon Alderman Vyner to appear before them, upon the Lady Capell's Complaint.
Order for 5859 l. 15 s. 6 d. for Gen. Monck.
"Resolved, by the Lords and Commons assembled in Parliament,
"That the Sum of Five Thousand Eight Hundred Fifty-nine Pounds, Fifteen Shillings, and Six Pence, which appears to be the Residue remaining unpaid of the Twenty Thousand Pounds conferred on the Lord General Monck, over and above what is paid at the Receipt of Exchequer, and what is charged on the Ordinance for Three Months Assessment, be paid to the Lord General Monck, or whom he shall appoint, out of the general Receipt of the Excise; and that the Commissioners of the Excise for the Time being be, and hereby are, authorized and required to pay to the Lord General Monck, or his Assigns, the Sum of Three Hundred Fifty-nine Pounds, Fifteen Shillings, and Six Pence, Part thereof, upon the Thirtieth Day of June Instant, and Five Hundred Pounds every Week after, until the said whole Sum of Five Thousand Eight Hundred Fifty-nine Pounds, Fifteen Shillings, and Six Pence, be fully satisfied and paid; and that the Acquittance or Acquittances of the said Lord General, or his Assigns, be unto the said Commissioners a sufficient Discharge."
Order for the Marq. of Winton to have Leave to search for his Goods taken away in the late Troubles.
Upon Information given this Day to the House, "That Bernard Reeves, Edward Acton, and other Persons, in Basingestoke and elsewhere, do retain divers Goods, Household Stuff, Writings, and Plate, belonging to the Lord Marquis of Winchester, which were taken out of Basing House since these unhappy Times:"
It is ORDERED, by the Lords in Parliament assembled, That the Lord Marquis of Winton shall have Liberty, by his Servants and Agents, to make diligent Search, for any of his said Goods, Household Stuff, Writings, and Plate, in the Dwelling-houses and Outhouses of the said Bernard Reeves, Edward Acton, and other suspicious Persons, in Basingestoke and elsewhere: And, that the said Goods may be the better discovered and found out, it is further ORDERED, That the said Parties, thus employed by the Lord Marquis, shall and are hereby impowered (upon Resistance made) to break open, in the Day-time, with a lawful Officer, any Door, Trunk, Chest, or Box, that shall not be opened in Obedience to this Order; and such Goods of the said Marquis's as shall be thus found, to take, bear, and carry away, for his Lordship's Use; any Thing to the contrary in any Wise notwithstanding.
