E. of Clare's Bill.
The Earl of Dorsett reported, "The Lords Committees have considered the Bill for settling Part of the Estate of John late Earl of Clare, and for enabling Gilbert Earl of Clare his Son and Heir to dispose of some other Part thereof for Payment of Debts and Portions; and have made some Alterations therein, which are offered to the Consideration of the House."
And the said Alterations, being read Twice, were Agreed to; and the Bill is ordered to be engrossed, with the said Alterations.
The Lord Arlington acquainted the House with a Message from His Majesty; which was read, as followeth:
Message from the King, concerning an Adjournment.
"Charles R.
"His Majesty conceives that a Recess this Christmas will not be unwelcome to you; and therefore intends an Adjournment upon the 17th Day of this Instant December, until the Beginning of February."
The Lord Widdrington is added to the Committee for Trade between the Kingdom of England and Scotland; and the Earl of Cardigan is added to the Committee for Petitions.
Palmes' Bill.
Hodie 1a vice lecta est Billa, "An Act for exchanging certain Manors and Lands of William Palmes Esquire for other Lands settled upon him and his Issue by Mary his Wife."
Trade between England and Scotland.
ORDERED, That the Committee to consider of the balancing of Trade between England and Scotland do meet To-morrow Morning, at Nine of the Clock.
Committee to consider of Laws expiring.
ORDERED, That the Committee to consider of those Laws as are expiring do meet To-morrow in the Afternoon.
Writs of Certiorari Bill.
ORDERED, That the Committee for the Bill to prevent the Abuses of Certioraris do meet on Wednesday next, in the Afternoon.
Sir R. Wiseman and Plott's Bill.
Hodie 2a vice lecta est Billa, "An Act for settling the Lands therein mentioned upon Sir Richard Wiseman and John Plott, and their Heirs, to enable them the better to perform a Trust."
ORDERED, That the Consideration of this Bill is committed to these Lords following:
Their Lordships, or any Five; to meet on Thursday next, at Three of the Clock in the Afternoon, in the Prince's Lodgings.
ORDERED, That the Lord Colepeper is added to the Bill for banishing the Earl of Clarendon.
Prizing Wines Bill.
The Earl of Dorsett reported, "That the Committee have considered the Bill for the better putting into Execution the Bill for Prizing of Wines, and have made some Alterations and Amendments, which are offered to the Consideration of the House."
Which, being read Twice, were Agreed to; and the Bill is ordered to be engrossed accordingly.
Committee to consider of Abuses in Wood and Coal.
ORDERED, That the Committee appointed to consider (fn. 1) to remedy the excessive Rates of Wood and Coal do meet To-morrow Morning, at Nine of the Clock.
The Earl of Anglesey and Lord Windsor are added to the Committee for the Bill concerning the banishing the Earl of Clarendon.
The Earl of Cardigan, Vicecomes Mountagu, Lord Sandys, Lord Eure, and the Lord Arundell of Wardor, are added to the Committee for the Bill concerning Sir William Juxon.
Bill for taxing Adventurers in the Fens.
ORDERED, That the Bill for the taxing and assessing the Lands of the Adventurers within the Great Level of the Fens, and the several Petitions relating to the same, and the Proviso, be referred to the Consideration of these Lords following; who, having heard all Parties concerned as aforesaid, are to make Report thereof to this House:
Their Lordships, or any Five; to meet on Thursday next, at Three of the Clock in the Afternoon, in the Prince's Lodgings.
Selvin, Blackston, & al. Appeal from Chancery.
ORDERED, That the Order of this House, dated the Fifth Day of this Instant December, made in the Case of Robert Selvin, Robert Blackston, and others, be amended and altered in the End thereof, by these Words; (videlicet,) ["giving Security for Payment of Costs, and otherwise, as the Lord Keeper of the Great Seal shall see Cause to direct"], instead of ["giving good Security both to perform such Judgement as the Lord Keeper of the Great Seal shall find meet upon the said Hearing to make therein, and to pay such Costs as the Court shall think fit."]
E. of Clarendon's Petition voted scandalous by both Houses.
Next, this House took into Consideration the Votes brought from the House of Commons at the last Conference; which were read, as followeth:
"Resolved,
"That the Paper sent by the Earl of Clarendon to the Lords, and by them sent down to this House, is scandalous and seditious, and doth reproach the King, and the public Justice of the Nation.
"Resolved,
"That the Lords be desired, that the Paper be burnt by the Hand of the Hangman."
The Question being put, "Whether this House agrees to these Votes?"
It was Resolved in the Affirmative.
To be burnt by the Hangman.
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Paper, intituled, "The humble Petition and Address of Edward Earl of Clarendon to the Lords Spiritual and Temporal in Parliament assembled," (which Paper is by both Houses of Parliament voted to be scandalous and seditious; and that it doth reproach the King and the Public Justice of the Nation) shall be burned by the Hand of the Hangman: And the Sheriffs of Middlesex and London are hereby required to see that the said Paper be burnt, by the Hand of the Hangman, at the Gate of Gresham Colledge (now called The Exchange) in Bishopsgate Streete in London, on Thursday the Twelfth Day of this Instant December, between the Hours of Twelve and One of the Clock the same Day.
Harris, Campbell, and Mohun, claim Privilege in Wymondsall's Suit against them, as Guardians of L. Mohun.
This House being moved, "That an Order of Privilege may be issued, to stay Proceedings at Law against Corderia Harris, Theophila Cambell, and Phillippe Mohun, Aunts and Guardians to Charles Lord Mohun, they being sued by Dawes Wymondsall, upon a Bond of Six Hundred Pounds, for Payment of Three Hundred Pounds, in which Bond they stand bound with Warwicke late Lord Mohun their Brother, whose proper Debt it is:"
It is thereupon ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Lords Committees for Privileges are hereby appointed to consider of this Case, and report their Opinion to the House, whether Privilege of Parliament ought to be granted or no.
A Rail to be set up in the Painted Chamber for Conferences.
The House being moved, by the Lord Great Chamberlain of England, "That a Rail may be set on that Side of the Table in the Painted Chamber on which the Members of the House of Commons are to stand at Conferences, between the Committees of both Houses, to the End that those Members of the House of Commons who are appointed Managers or Reporters of Conferences may not be disturbed by the Press of other Persons standing behind them:"
It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That a Rail shall be placed in the Painted Chamber, as is proposed; and that the Lord Great Chamberlain of England is hereby desired to give particular Directions therein.
