Hodie 3a vice lecta est Billa, "An Act to supply the Defects in a Deed of Settlement made by John Coke Esquire, deceased, and for altering a Trust in Part of the Estate of Robert Coke Esquire."
The Question being put, "Whether this Bill shall pass?"
It was Resolved in the Affirmative.
A Message was brought from the House of Commons, by Mr. Wright and others:
1. To return a Bill for rectifying a Mistake in a general Settlement of the Lord Maynard's Estate, upon Marriage of his Son; whereunto the Commons do agree, with the Addition of a Proviso, to which their Lordships Concurrence is desired.
2. To present an Act to enable Herbert Awbrey and his Trustees to sell Lands, for Payment of Debts; to which they desire their Lordships Concurrence.
Bill against Incestuous Marriages.
The Archbishop of Yorke reported, "That the Committee have considered the Bill against Incestuous Marriages; and are of Opinion, That the same is fit to be engrossed, with some Amendments."
Which, being read Twice, were Agreed to; and the Bill ordered to be engrossed, with the said Amendments.
A Message was sent to the House of Commons, by Sir William Beversham and Sir John Francklyn:
To deliver the Bill to supply the Defects in a Deed of Settlement made by John Coke Esquire deceased, and to desire Concurrence thereunto.
E of Rutland and Sir Scroope Howe.
Whereas the Earl of Rutland having this Day, by the Lord Viscount Stafford, returned his humble Thanks to this House, for the Notice they gave him of a Petition of Sir Scroope How depending in this House, wherein it was desired that his Lordship might wave his Privilege, in order to the Examination of Witnesses, in perpetuam Rei Memoriam, did return this Answer: "That if Sir Scroope How please, he shall have a speedier End of his Business; for his Lordship will submit the whole Matter to the Award and Judgement of this House, to be given upon hearing of Counsel at the Bar, if their Lordships will please to favour him to make an Award in the Case."
It is thereupon ORDERED, That Sir Scroope How have Notice of this Proposition; to the End he may signify his Consent thereunto, if he please.
Bill for more effectual Conviction of Popish Recusants.
Hodie 3a vice lecta est Billa, "An Act for the more effectual Conviction and Prosecution of Popish Recusants."
After the Reading thereof, a Proviso was tendered, to be added to the said Bill; which, being read Twice, was Rejected.
Then the Question being put, "Whether this Bill shall pass?"
It was Resolved in the Affirmative.

E. of Bristol takes his Seat.
This Day John Earl of Bristol sat first in Parliament, by virtue of His Majesty's Writ of Summons, dated the 23d Day of March, in the 29th Year of the Reign of our Sovereign Lord King Charles the Second, upon the Death of his Father George Earl of Bristol.
Bill against Clandestine Marriages.
Hodie 2a vice lecta est Billa, "An Act to prevent Clandestine Marriages, without the Consent of their Fathers."
ORDERED, That the Consideration of this Bill is committed to these Lords following; whose Lordships are to take Care and provide in the Bill that there be a suitable Penalty on Priests in Orders, that shall presume to marry Persons contrary to this Act; and upon Persons not in Orders, who take on them to officiate at such Marriages as if they were in Orders; and likewise to prevent the betraying of Infants by Guardians, and limiting a certain Time within which such Infants shall not be able to contract Matrimony, notwithstanding the usual Years of Consent; and having considered of the said Bill, and heard such Persons concerning the same as they shall think fit, are afterwards to make Report to the House:
Their Lordships, or any Five of them; to meet To-morrow Morning, at Nine of the Clock, in the Lord Chancellor's Lodgings; and to adjourn themselves as they please.
