Weyvell versus Hewley.

Upon reading the Petition of Francis Wyvell and Anne his Wife; shewing, "That there is an Appeal brought into this House, by Dorothy Hewley Spinster, whereunto they are Defendants, praying a Day may be appointed for hearing thereof:"

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That this House will hear the said Cause, by Counsel on either Part thereupon, on Saturday the 6th Day of December next, at Ten of the Clock in the Forenoon.

Serle's Bill.

Hodie 3a vice lecta est Billa, "An Act for selling the Estate of Henry Serle Esquire, deceased."

The Question was put, "Whether this Bill shall pass into a Law?"

It was Resolved in the Affirmative.

Montagu's Bill.

The Earl of Huntingdon reported from the Committee, the Bill, intituled, "An Act to enable Elizabeth Montagu Widow to make Leases for Years of Houses and Grounds in Stepney, in the County of Midd'x," as fit to pass, without any Amendments.

Hodie 3a vice lecta est Billa, "An Act to enable Elizabeth Montagu Widow to make Leases for Years of Houses and Grounds in Stepney, in the County of Midd'x."

The Question was put, "Whether this Bill shall pass into a Law?"

It was Resolved in the Affirmative.

Doubling the Excise, Bill for.

Hodie 2a vice lecta est Billa, "An Act for doubling the Duty of Excise of Beer, Ale, and other Liquors, during the Space of One Year."

ORDERED, That the said Bill be committed to a Committee of the whole House, presently.

The House was adjourned during Pleasure.

The House was resumed.

And the Lord Viscount Newport reported, "That the Committee had thought fit to pass the said Bill, without any Amendment."

A Message was sent to the House of Commons, by Sir Miles Cooke and Mr. Meredith:

To carry down the Bill, intituled, "An Act for selling the Estate of Henry Serle Esquire, deceased;" and to desire their Concurrence thereunto; and to acquaint them, that this House hath passed Two Bills; (videlicet,)

1. "An Act for doubling the Duty of Excise of Beer, Ale, and other Liquors, during the Space of One Year."

2. "An Act to enable Elizabeth Montagu Widow to make Leases for Years of Houses and Ground in Stepney, in the County of Midd'x."

Without any Amendments.

Lucy, for breeding a Protestant, &c.

The Earl of Huntingdon reported, from the Committee, the Bill, intituled, "An Act for securing the Portion of Elizabeth Lucy, and breeding her up a Protestant, and for transferring the Trust for that Purpose;" with some Amendments.

Which were read Twice, and agreed to.

ORDERED, That the said Bill be engrossed, with the said Amendments.

Bray's Bill.

Hodie 1a vice lecta est Billa, "An Act for the better enabling Jane Bray Widow, Relict and sole Executrix of the last Will of Reginall Bray Esquire, deceased, and others, to the speedier raising of the Portions already appointed for her Daughters."

Indemnity for Persons who acted for Their Majesties Service, Bill.

Hodie 1a vice lecta est Billa, "An Act for preventing vexatious Suits against such as acted for Their Majesties Service, in Defence of the Kingdom."

ORDERED, That the said Bill be read the Second Time To-morrow.

Orphans of London, Judicature for Relief of, Bill.

L. Mayor & al. to be heard about it.

ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the Lords Committees appointed to consider of a Bill, intituled, "An Act for erecting a Judicature for the Relief of the distressed Orphans of the City of London," shall meet on Wednesday next, at Nine of the Clock in the Morning, in the Prince's Lodgings near the House of Peers; of which the Lord Mayor and Court of Aldermen, and all other Persons concerned, shall have Notice; and may be heard what they have to say concerning the same.

Chancery, &c. for reforming Abuses in, Bill.

The House was put into a Committee, to proceed on the Bill, intituled, "An Act for regulating divers Abuses in the Court of Chancery, and other Courts of Equity."

The House was resumed.

And the Earl of Fauconberge reported, "That the Committee had made some Progress in the Bill; and desired that To-morrow might be appointed for the House to be put into a Committee again thereupon."

ORDERED, That the House shall be put into a Committee again To-morrow, at Ten of the Clock in the Forenoon, to proceed further upon the said Bill.

Cecill & al. versus E. Salisbury: Privilege not allowed.

Whereas this Day was appointed for hearing Counsel, upon the Petition of Robert Cecill Esquire and others, the Younger Children of James Earl of Salisbury deceased; praying, "That James now Earl of Salisbury may not be permitted to insist upon his Privilege in the several Causes (mentioned in the said Petition) depending in Chancery; as also Counsel for the said Earl of Salisbury:"

Upon reading this Day a Letter from the said Earl, directed to the Right Honourable Sir Robert Atkins, Speaker of the House of Lords, to be by him communicated to the House, and dated at Hatfeild, November 23d, 1690; wherein his Lordship owneth, that he hath formerly waved his Privilege in the Causes mentioned in the Petition of Mr. Cecill and the other Younger Children of the late Earl of Salisbury; it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That (the Earl of Salisbury having formerly waved his Privilege in those Causes now depending in Chancery) the said Earl of Salisbury shall not insist upon his Privilege, in the said Causes, for the future.

Adjourn.
