L. Fairfax versus E. Derby.

Upon reading the Petition of the Lord Fairfax Viscount Emuli in the Kingdom of Ireland, and of Colonel Ralph Widdrington, Executors of William late Lord Widdrington (who was Executor of William Stanley Esquire), relating to the Earl of Derby's Agents insisting on Privilege, in a Cause depending in Chancery, between the Petitioners and the said Earl (since the Directions of this House, the Eighteenth of March last); praying, the said Earl may waive his Privilege so far as that they may be at Liberty to publish Depositions taken in the said Cause, for the Satisfaction of Purchasers:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That the said Earl of Derby shall have a Copy of the said Petition; and put in his Answer thereunto, in Writing, on Friday the Fourth Day of March next, at Eleven of the Clock in the Forenoon.

L. Vaughan versus L. Herbert Ch.

The Earl of Stamford reported from the Lords Committees for Privileges, to whom was referred the Petition of the Lord Vaughan, complaining of a Breach of Privilege, by some Proceedings in the Exchequer, in His Majesty's Name, on the Behalf of the Lord Herbert of Cherbury, for Recovery of some Arrears of Feefarm Rents, "That their Lordships have heard Counsel, as well for the Lord Vaughan as the Lord Herbert; and are of Opinion, that the Matter complained of in the Lord Vaughan's Petition is a Breach of his Privilege, and the Privilege of this House."

To which the House agreed.

And it is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That no further Proceeding be had on the Scire Facias mentioned in the said Petition, during Privilege of Parliament.

Message from H. C. to return Farrington's Bill.

A Message was brought from the House of Commons, by Mr. Shakerly and others:

To return the Bill, intituled, "An Act for vesting in Trustees, to be sold, certain Lands of George Farington Esquire, lying in the Counties of Middl'x and Surrey (settled upon the Marriage of William Farington his Nephew); and, with the Money arising thereby, for purchasing of other Lands in Lancashire, where the ancient Estate of the Family lies, to be settled to the same Uses," with some Amendments.

Which, being read Three Times, were agreed to; and ORDERED, that the Commons have Notice thereof.

E. of Maclesfield's Divorce, Bill.

After hearing this Day Counsel and Witnesses, on the Behalf of the Earl and Countess of Maclesfeld:

It is ORDERED, by the Lords Spiritual and Temporal in Parliament assembled, That either Side may have Copies of the Letters and Depositions relating to this Matter; and that, on Wednesday next, this House will take this Matter into their further Consideration, and will hear the Counsel to sum up the Evidence on both Sides.
