Lords take the Oaths.

This Day James Earl of Derby and Other Earl of Plimouth took the Oaths, and made and subscribed the Declaration, and took and subscribed the Oath of Abjuration, pursuant to the Statutes.

Willoughby & Ux. versus Master.

Upon reading the Petition of George Willoughby and his Wife, Respondents to the Petition and Appeal of Sir Streynsham Master; praying a Week's Time further, for answering to the Appeal of Sir Steynsham Master:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Petitioners have hereby Time allowed them for answering to the said Appeal, until Monday the Seventeenth Day of this Instant December, at Eleven a Clock.

Cole versus Rawlinson & al. in Error:

After hearing Counsel, to argue the Errors assigned upon the Writ of Error brought into this House the Ninth Day of November last, wherein Judgement is entered, in Her Majesty's Court of Queen's Bench, for Daniel Rawlinson and John Linger, against Richard Cole; with the Affirmation thereof in the Exchequer Chamber:

Judgement affirmed.

After due Consideration of what was offered thereupon, it is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the Judgement given in the Court of Queen's Bench, for the said Daniel Rawlinson and John Linger, against the said Richard Cole, and the Affirmation thereof in the Exchequer Chamber, shall be, and they are hereby, affirmed; and that the Record be remitted, to the End Execution may be had thereupon, as if no such Record had been brought into this House.

The Tenor of which Judgement, to be affixed to the Record to be remitted, is as followeth; (videlicet,)

Ric'um Cole assign. & allegat. videbitur eidem Dominæ Reginæ in Parliamento suo præd. quod Record. ill. in nullo vitiosum aut defectivum existit; ac quod Record, ill. in nullo fuit Errat.: Ideo ad tunc & ibidem per eandem Dominam Reginam in Parliamento suo præd. cons. fuit, quod separal. Judic. præd. in omnibus affirmentur, & in omnibus suit Roborib. starent & Effect.; dictis Causis & Materiis pro Error. per præfat.
