Upon reading the Report of Mr. Justice Tracy and Mr. Baron Price, relating to the Petition of Mountagu Drake Esquire and others; praying Leave to bring in a Bill, for the Purposes in the Petition mentioned:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the said Report shall be referred to the same Judges, to certify to whom the Surplus-money upon the Sale of the Estate in the Petition mentioned will go.

Viscount Kingsland versus Barnwell & al;

After hearing Counsel upon the Petition and Appeal of Nicholas Lord Viscount Kingsland of the Kingdom of Ireland, Appellant from a Decree or Order made in the Court of Chancery in Ireland, the Eleventh Day of December One Thousand Seven Hundred and Five, whereby the Petitioner's Bill, exhibited in the said Court, against Nicholas Barnwell the Elder, Executor of Robert Barnwell Esquire deceased, Robert and Nicholas Barnwell the Younger, Peter, Robert, Christopher, James, and Richard Barnwell, the Younger, all Minors, by Richard Tisdale Gentleman, their Guardian, John Arthur, Robert Leigh, Michael Fleming, and Isaac Ward, Esquires, is and stands dismissed out of the said Court; and praying the Reversal of the said Decree of Dismission: As also upon the Answer of the said Nicholas Barnwell the Elder, Executor of Robert Barnwell Esquire deceased, John Arthur, Robert Leigh, Michael Fleming, Isaac Ward, Esquires; and of Robert Barnwell the Younger, Nicholas Barnwell, Christopher Barnwell, James Barnwell, and Richard Barnwell the Younger, all Minors, by Richard Tisdale their Guardian, put in thereunto; and due Consideration of what was offered thereupon:

Judgement affirmed.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal of Nicholas Lord Viscount Kingsland shall be, and is hereby, dismissed this House; and that the Decree therein complained of shall be, and is hereby, affirmed.
