Hodie 2a vice lecta est Billa, intituled, "An Act for charging and continuing the Duties upon Malt, Mum, Cyder, and Perry, for the Service of the Year One Thousand Seven Hundred and Eleven."

Ordered, That the Consideration of the said Bill be committed to a Committee of the whole House, on Wednesday next, the First Business.

Paul and Clitherow versus Sir J. Shaw, in Error.

After hearing Counsel, to argue the Errors assigned upon the Writ of Error brought into this House from Her Majesty's Court of Exchequer, the Second Day of March One Thousand Seven Hundred and Nine, where in Judgement is entered for Sir John Shaw Baronet, against William Paul and Christopher Clitherow Esquires, for reversing a Judgement given in the Exchequer for the Plaintiffs in Error, William Paul and Christopher Clitherow, upon which Errors were assigned, and Issue joined; and due Consideration of what was offered thereupon:

Judgement affirmed.

It is this Day Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the Judgement given for the Reversal of the Judgement of the Exchequer for William Paul and Christopher Clitherow shall be, and is hereby, affirmed; and that the said Writ and Transcript annexed be remitted to the Court of Exchequer, to the End that the said Sir John Shaw may have Execution upon the said Judgement, in like Manner as if no such Writ of Error had been brought into this Court.

The Tenor of which Judgement, to be affixed to the Record to be remitted, is as follows:

"Et postea, scilicet, Sexto Die Martii, Anno Regni Dominæ Annæ nunc Reginæ Mag. Brit. &c. Octavo, Transcript. Record. & Process. prædict. inter Partes præd. cum omnibus ea tangen. Prætextu cujusdam Brevis de Errore corrigend. per præfatos Williel. Paul & Christopherum Clitherow, in Præmiss. prosecut. dictæ Dominæ Reginæ in Parliamento suo, a præd. Cur. dictæ Dominæ Reginæ de Scaccario suo, coram ipsa Regina, transmiss. fuit; & prædictis Will'o Paul & Chr'o Clitherow, in eadem Cur. Parliamenti comparentibus, diversas Causas & Materias pro Error. in Record. & Process. præd. pro Revocatione & Adnullatione Judicii præd. in præd. Cur. Camer. Scaccarii præd. assignaverunt. Et postea, scilicet, Vicesimo Nono Die Januarii, Anno Regni dictæ Dominæ Reginæ Nono, in præsenti Curia Parliamenti, visis & per Cur. ibidem diligenter examinatis & plenius intellectis tam Record. & Process. præd. ac Judic. super iisdem reddit. & Revocatione & Adnullatione ejusdem Judicii, quam præd. Error. superius assignat. pro eo quod videtur Cur. Parliamenti præd. quod Record. Revocationis & Adnullationis ejusdem Judicii in nullo vitiosum aut defectivum existit, & quod in Record. ill. in nullo fuit Erratum: Ideo consideratum est per eandem Cur. Parliamenti, quod præd. Judicium in Camera Scaccarii præd. ut præsertur reddit. pro Revocatione & Adnullatione Judicii præd. in Cur. Scaccarii præd. reddit. affirmetur, & in suo Robore & Effectu stet; dictis Causis pro Error. assignat. in aliquo non obstant."
