Prayers.

The Lord Keeper acquainted the House, "That Her Majesty had commanded him to deliver a Message to this House, under Her Royal Sign Manual."

Which his Lordship read, and is as follows; (videlicet,)

Queen's Message concerning the Treaty for a Peace; - the Resolution concerning the Peers of Scotland being barred from being created English Peers; - and complanining of the Number of Libels, &c.

"ANNE R.

"Her Majesty, not having yet recovered Strength enough, since the Return of the Gout, to be present this Day in Person, and being unwilling that the Public Business should receive any Delay, thinks fit to communicate to this House the Substance of what She intended to have spoke.

"At the Opening of this Session, Her Majesty acquainted Her Parliament, that both Time and Place were appointed, for the Meeting of the Plenipotentiaries of all the Confederates, to treat with those of the Enemy, concerning a general Peace; and also expressed the Care which She intended to take of all Her Allies, and the strict Union in which She proposed to join with them, in order to obtain a good Peace, and to guaranty and support it when obtained.

"Her Majesty can now tell you, That her Plenipotentiaries are arrived at Utrecht; and have begun, in Pursuance of their Instructions, to concert the most proper Ways of procuring a just Satisfaction to all in Alliance with Her, according to their several Treaties, and particularly with relation to Spain and The West Indies.

"You may depend on Her Majesty's communicating to Her Parliament the Terms of Peace, before the same shall be concluded.

"The World will now see how groundless those Reports are, which have been spread abroad by Men of evil Intentions, to serve the worst Designs, as if a separate Peace had been treated; for which there has not been the least Colour given.

"Her Majesty's Ministers have Directions to propose, that a Day may be fixed for the Finishing, as was done for the Commencement, of this Treaty; and, in the mean Time, all the Preparations are hastening for an early Campaign.

"There is One Thing, in which Her Majesty's Subjects of the North Part of this Kingdom are extremely concerned; the Distinction such of them who were Peers of Scotland before the Union must lie under, if the Prerogative of the Crown is strictly barred against them alone. This is a Matter which sensibly affects Her Majesty: And She therefore lays it before this House; earnestly desiring their Advice, and Concurrence, in finding out the best Method of settling this Affair, to the Satisfaction of the whole Kingdom.

"Her Majesty finds it necessary to observe, how great Licence is taken, in publishing false and scandalous Libels, such as are a Reproach to any Government. This Evil seems to be grown too strong for the Laws now in Force: It is therefore recommended to you, to find a Remedy equal to the Mischief."

Then, it being proposed, "To resolve,

Address to be drawn.

"That an humble Address be presented to Her Majesty, to express the great Concern of this House, for the Continuance of Her Majesty's Indisposition, whereby this House is deprived of the Honour of Her Majesty's Royal Presence this Day: And to return the Thanks of this House for Her most Gracious Message; particularly for Her Majesty's great Condescension, in acquainting this House with the Progress already made towards the Peace; and the Assurance Her Majesty gives, of communicating to this House the Terms of the Peace, before the same shall be concluded:"

To which the House agreed.

And the Lords following were appointed a Committee, to prepare an Address, upon the said Resolution; and report to the House; videlicet,

Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That this House shall be put into a Committee, To-morrow at One a Clock, to take into Consideration Her Majesty's most Gracious Message to the House this Day; and all the Lords summoned to attend.

House of Hanover, Precedency, Bill.

The Lord Treasurer acquainted the House, "That it was Her Majesty's Pleasure and Desire, that the Precedence of the most Excellent Princess Sophia, Electress and Dutchess Dowager of Hanover, of the Elector her Son, and of the Electoral Prince the Duke of Cambridge, and also the Heirs of the Body of the said Princess Sophia, being Protestants, should be settled."

And his Lordship presented to the House a Bill for that Purpose.

Then,

Hodie 1a et 2a vice lecta est Billa, intituled, "An Act for settling the Precedence of the most Excellent Princess Sophia, Electress and Dutchess Dowager of Hanover, of the Elector her Son, and of the Electoral Prince the Duke of Cambridge."

Ordered, That the said Bill be engrossed.

L. Gower's Bill.

Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Committee to whom the Bill, intituled, "An Act to enable John Lord Gower Baron of Stit'nham, an Infant, to make a Settlement upon his Marriage," be revived; and do meet Tomorrow, at Eleven a Clock.

Annesley versus D. Bucks Privilege.

Upon reading the Petition of Francis Annesley Esquire, on Behalf of himself and of the Right Honourable the Lady Catherine Annesley, an Infant; shewing, "That, in Trinity Vacation last, the Petitioner exhibited a Bill in Chancery, in his own Name, and of the said Lady Catherine by him as her Guardian and next Friend, against the Duke and Dutchess of Bucks, and others; and the said Duke and Dutchess, being served with the usual Process of the said Court, did, after a considerable Delay, appear; but have not yet put in their Answer to the said Bill, and doth now insist upon his Privilege of Parliament, as a Peer of this Realm;" and praying, "That the Petitioner may be at Liberty to proceed in the said Cause against the said Duke and Dutchess, notwithstanding any Privilege of Parliament claimed by the said Duke; and that the said Duke may be ordered not to insist upon the same:"

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of the said Petition shall be, and is hereby, referred to the Lords Committees for Privileges; who, having sent for and heard such Persons concerning the same as they shall think fit, are afterwards to report their Opinion thereupon to the House: Which Committee is to meet on Saturday next, at Eleven a Clock, in the House of Peers; and to adjourn as they please.

Ly. Seymour & al. versus Sir Edward Seymour.

Upon reading the Petition and Appeal of Dame Letitia Seymour Widow, and of the Right Honourable Francis Lord Conway and Charles Seymour Esquire (her Sons) and Francis Gwyn Esquire (their Trustee) and of William Berkeley Esquire and his Wife, from a Decree made in the Court of Chancery, the Fifteenth Day of June last, on the Behalf of Sir Edward Seymour Baronet; praying, "That some Parts of the said Decree may be reversed; and that Sir Edward Seymour may answer the said Appeal:"

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the said Sir Edward Seymour may have a Copy of the said Appeal; and shall and he is hereby required to put in his Answer thereunto, in Writing, on or before Tuesday the Twenty-ninth Day of this Instant January, at Eleven a Clock.

Wright and Meller's Petition referred to Judges.

Upon reading the Petition of George Wright Esquire, and Thomas Meller Clerk; praying Leave to bring in a Bill for ascertaining and establishing the Glebe Lands, Tithes, and other Profits, of the Rectory of Gotehurst, in the County of Bucks:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of the said Petition shall be, and is hereby, referred to Mr. Justice Blencowe and Mr. Justice Tracy; who are forthwith to summon all Parties concerned in the Bill: and, after hearing them, to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties that may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

Bp. Norwich to preach the 30th Instant.

Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Lord Bishop of Norwich be, and he is hereby, desired to preach before this House, in the Abbey Church at Westminster, on Wednesday the Thirtieth Day of this Instant January.
