Minnit versus, Whinery.

The Answer of John Whinery, Respondent to the Petition and Appeal of Joshua Minnit Merchant, was brought in the Twentieth Instant.

Rochfort versus Creswicke:

After hearing Counsel, upon the Petition and Appeal of Robert Rochfort Esquire; complaining of a Decree of the Court of Chancery in Ireland, of the Tenth of November last, in certain Causes, wherein Francis Creswicke Esquire was Plaintiff, and the Appellant Defendant; and wherein the said Francis Creswicke and Mary his Wife were Plaintiffs, and the Appellant Defendant; et è contra; and praying, "That the same may be reversed, and the Appellant relieved:" As also upon the Answer of the said Francis Creswicke put in to the said Appeal; and due Consideration had of what was offered by Counsel on either Side in the said Causes:

Judgement affirmed, with Costs.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal be, and is hereby, dismissed this House; and that the Decree therein complained of be, and is hereby, affirmed: And it is further Ordered, That the Appellant do pay, or cause to be paid, to the Respondent, the Sum of Sixty Pounds, for his Costs in respect of the said Appeal.

State of the Public Credit to be considered.

Ordered, That, on Thursday next, this House shall be put into a Committee of the whole House, to take into Consideration the State of the Public Credit; and that the several Papers relating to the State of the Fleet, the Debt of the Nation, and concerning the Produce of the Customs, be referred to the said Committee; and that all the Lords be summoned.

Nedham & al. Pet. referred to Judges.

Upon reading the Petition of Edward Nedham Gentleman, Mary Nedham Widow, Mother of the said Edward Nedham, Charles Dymoke Gentleman and Mary his Wife, and Elizabeth Nedham Spinster, and George Nedham; praying Leave to bring in a Bill, for Sale of such Part of the Manor of Ilston, alias Ilveston, and other Premises, in the County of Leicester, as is not in Jointure, for raising Money, to supply the Occasions of the Petitioner Edward Nedham; and that the Jointure Estate may be settled, in Lieu thereof, to the same Uses as the settled Estate is now limited:

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Consideration of the said Petition be, and is hereby, referred to the Lord Chief Justice of the Court of Common Pleas and Mr. Justice Tracy; who are forthwith to summon all Parties concerned in the Bill; and, after hearing them, to report to the House the State of the Case, with their Opinion thereupon, under their Hands, and whether all Parties that may be concerned in the Consequences of the Bill have signed the Petition; and also that the Judges, having perused the Bill, do sign the same.

E. of Westmorland's Privilege; Drinker his Servant subpœna'd.

A Complaint was made to the House, of a Breach of the Earl of Westmorland's Privilege, committed by one Smith, a Schoolmaster in Peterborough, in serving a Subpœna on William Drinker, his Lordship's menial Servant:

It is Ordered, That the Matter of the said Complaint be, and is hereby, referred to the Lords Committees for Privileges.

Cambridge's Bill:

Hodie 3a vice lecta est Billa, intituled, "An Act for discharging Part of the Estate of Richard Cambridge Esquire, in the County of Gloucester, from the Uses and Limitations contained in his Marriage Settlement; and for settling another Estate, in the same County, of better Value, to the same Uses."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

River Dane navigable, Bill.

Ordered, That the said Bill be committed to the same Committee to whom the Bill for repairing the Roads leading from Ledbury stands referred.

Broadheath Common, to enclose, Bill:

Robertson versus E. of Kinnoul.

Upon reading the Petition of John Robertson, Appellant in a Cause depending in this House, to which George Earl of Kinnoul is Respondent; setting forth, That, by an Affidavit annexed to the Petitioner's Appeal, it does appear, that he is not worth Five Pounds in the World; and in regard he was admitted in the Court below, and in this House the last Session, to prosecute his Suit in Forma Pauperis, the Petitioner humbly prays, that Doctor Paul and Mr. Mead may be assigned his Counsel:"

It is Ordered, That the Petitioner be admitted to prosecute his Appeal in this House in Forma Pauperis as formerly; and that Doctor Paul and Mr. Mead be, and are hereby, assigned the Petitioner's Counsel, according to the Prayer of the said Petition.

To return the Bill, intituled, "An Act for settling the Estates of Richard late Earl Rivers, deceased, pursuant to an Agreement made between Fredcrick Earl of Rochford and Bessy Countess of Rochford his Wife, James Barry Earl of Barrymore in the Kingdom of Ireland, and Lady Penelope Barry his Daughter, and John now Earl Rivers, subject to the Payment of the Debts and Legacies of the said late Earl Rivers remaining unpaid; and for other Purposes in the said Act mentioned;" and to acquaint this House, that they have agreed to the said Bill, without any Amendment.

With a Bill, intituled, "An Act for continuing the Duties granted by several Acts made in the Sixth and Tenth Years of Her late Majesty's Reign, for repairing the Harbour and Key of Watchet, in the County of Somerset;" to which they desire the Concurrence of this House.

A Message from the House of Commons, by Mr. Haldane and others:

With a Bill, intituled, "An Act for continuing the Duty of Two Penny Scotts, or One Sixth Part of a Penny Sterling, laid upon every Scotts Pint of Ale and Beer sold within the Town of Dundee and Privileges thereof, for paying the Public Debts of the said Town, building or endowing a new Church, and for other the Purposes therein mentioned;" to which they desire the Concurrence of this House.

Jeffreys & al. Pet. for a Bill to build a Chapel in the Parish of St. Andrew's, Holborn, dismissed.

The Earl of Clarendon reported from the Lords Committees appointed to consider of the Petition of Nicholas Jeffreys and others, Inhabitants in Bedford Row, Red Lyon Street, and other Parts adjacent, where a great Number of new Buildings have been lately erected, in the Parish of St. Andrew's Holborn, in the County of Middlesex; praying Leave to bring in a Bill, to enable the Petitioners to build and finish a Chapel, within the Neighbourhood of those new Buildings, at their own Charge: "That the Committee have considered the said Petition, and heard the Parties concerned therein; and it being insisted on, by the Duke of Montagu, Patron of the Rectory of the Parish of St. Andrew's Holborn, and Doctor Sacheverell the present Rector of that Parish, that they are advised such a Bill, as desired by the said Petition, will be an Insringement of their respective Rights; the Committee, upon Consideration of what had been offered on both Sides, are of Opinion, That such Bill may interfere with the Rights of the said Duke of Montagu and Doctor Sacheverell; and that therefore the said Petition ought to be dismissed."

Which Report, being read Twice by the Clerk, was agreed to by the House.

State of the Public Credit to be considered.

The Order of the Day, for the House to be in a Committee, to take into Consideration the State of the Public Credit, being read:

Address for Papers concerning the Fleet.

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That an humble Address be presented to His Majesty, "That His Majesty will be graciously pleased to cause the proper Officers to lay before this House, an Account of what Flag Officers have been allowed Sea-pay while ashore, in Time of Peace, since the Year 1697.

"Also, what Captains and Commodores have been paid as Flags, with the Number of Ships each of them had under their Command, from the Year 1689 to the Year 1714.

"Also, an Account of what Squadrons of Ships have been sent on Service Abroad, without Muster-masters, from the Year 1689, to the Year 1714.

"Also, a List of such Ships, with their Rates, as came into Port to be laid up and paid off (there being no further Service for them) between the Eighth of August 1712 (the Time of the Cessation of Arms) and the First of August 1714; and how long they remained in Port before they were paid off, and the Occasion thereof.
