Ship-wrecked Manners in Portugal, to relieve, Bill.

Hodie 3a vice lecta est Billa, intituled, "An Act for the more equal paying and better collecting certain small Sums therein mentioned, for Relief of shipwrecked Mariners and distressed Persons (His Majesty's Subjects) in the Kingdom of Portugal; and for other pious and charitable Purposes, usually contributed to by the Merchants trading to Portugal."

The Question was put, "Whether this Bill shall pass?"

It was Resolved in the Affirmative.

Message to H. C. that the Lords have agreed to it.

A Message was sent to the House of Commons, by Mr. Godfrey and Mr. Edwards:

To acquaint them, that the Lords have agreed to the said Bill, without any Amendment.

Henry Waldegrave Chevalier, being, by Letters Patents, dat. Vicesimo Die Januarii, Primo Jacobi Secundi Regis, created Baron Waldegrave, de Chenton, in Com. Somerset. to him and the Heirs Male of his Body, but dying before he sat in Parliament; his Son James, now Lord Waldegrave upon the Death of his said Father, was this Day (in his Robes) introduced between the Lord Delawar and the Lord Teynham (also in their Robes); the Gentleman Usher of the Black Rod, Garter King of Arms, and the Lord Willoughby of Eresby (who officiated in this Ceremony in the Absence of the Lord Great Chamberlain), preceding.

His Lordship presented his Patent to the Lord Chancellor, on his Knee, at the Woolsack; who delivered it to the Clerk; and the same was read, at the Table.

His Lordship's Writ of Summons was also read, as follows:

Then his Lordship came to the Table; and took the Oaths, and made and subscribed the Declaration, and also took and subscribed the Oath of Abjuration, pursuant to the Statutes; and was afterwards placed on the Barons Bench, next below the Lord Guilford.

He, after a short Introduction, in relation to the Malt Bill to be passed, delivered the same to the Clerk Assistant, in the Absence of the Clerk of the Parliaments; who brought it to the Table; where the Clerk of the Crown read the Title of that and the other Bills to be passed, severally, as follow:

1. An Act for continuing the Duties on Malt, Mum, Cyder, and Perry, to raise Money, by Way of a Lottery, for the Service of the Year One Thousand Seven Hundred Twenty-two; and for transferring the Deficiencies of a late Malt Act to the Land Tax for the said Year; and for giving Time for inserting the Money given with Apprentices in their Indentures; and touching lost Bills, Tickets, or Orders; and for exchanging the Tickets in the Exchequer for Certificates; and for suppressing Lotteries denominated Sales, and other private Lotteries; and for enlarging the Time for the Accomptant General of the Bank of England to return Duplicates of Annuities into the Exchequer."

To this Bill the Royal Assent was pronounced, in these Words; (videlicet,)

"Le Roy remercie ses bons Sujets, accepte leur Benevolence, et ainsi le veult."

2. An Act for taking off the Duty upon all Salt used in the curing of Red Herrings, and laying a proportionable Duty upon all Red Herrings consumed at Home only; and for ascertaining the Customs and Excise payable for the Sugar-houses in Scotland; and for making an Allowance for Salt lost in any Harbour or River of this Realm; and for the better securing the Duties on Salt delivered in Scotland."

3. An Act for the punishing Mutiny and Desertion, and for the better Payment of the Army and their Quarters."

4. An Act to enable His Majesty effectually to prohibit Commerce, for the Space of One Year, with any Country that is, or shall be, infected with the Plague; and for shortening the Continuance of an Act, passed in the Seventh Year of His Majesty's Reign, intituled, An Act for repealing an Act, made in the Ninth Year of Her late Majesty Queen Anne, intituled, An Act to oblige Ships coming from Places infected more effectually to perform their Quarentine; and for the better preventing the Plague being brought from Foreign Parts into Great Britain or Ireland, or the Isles of Guernsey, Jersey, Alderney, Sark, or Man; and to hinder the spreading of Infection."

"5. An Act for repealing such Clauses in the Act, passed in the Seventh Year of His Majesty's Reign (relating to Quarentine and the Plague), as gives Power to remove Persons from their Habitations, or to make Lines about Places infected."

6. An Act, giving further Encouragement for the Importation of Naval Stores; and for other Purposes therein mentioned."

7. An Act for granting the People called Quakers such Forms of Affirmation, or Declaration, as may remove the Difficulties which many of them lie under."

8. An Act for the more equal paying and better collecting certain small Sums therein mentioned, for Relief of ship-wrecked Mariners and distressed Persons (His Majesty's Subjects) in the Kingdom of Portugal; and for other pious and charitable Purposes, usually contributed to by the Merchants trading to Portugal."

9. An Act for restoring and re-building the Haven and Piers of Bridport, in the County of Dorset; and for making a Sluice there."

10. An Act for the amending the Highways leading from Brampton Bridge, near Church Brampton, in the County of Northampton, through the Parish of Thornby, to a Bridge called Welford Bridge, in the Parish of Welford, in the said County; and also the great Post Road, from a Place called Morter Pitt Hill, in the Parish of Pisford, in the said County, through the Towns and Parishes of Brixworth, Lamport, Maidwell, Kelmarsh, and Oxenden Magna, to a Bridge called Chain Bridge, leading into Market Harborough, in the County of Leicester."

11. An Act to explain and amend the Act, passed in the Third Year of His present Majesty's Reign, for repairing the Highway from several Places therein mentioned, leading towards Highgate Gatehouse and Hampstead, in the County of Middlesex."

12. An Act for continuing an Act, passed in the Tenth Year of the Reign of Her late Majesty, intituled, An Act for repairing the Highway, between a certain Place called Kilburn Bridge, in the County of Middlesex, and Sparrows Hern, in the County of Hertford; and for making the said Act more effectual."

13. An Act for laying a Duty of Two Pennies Scots, or one Sixth Part of a Penny Sterling, upon every Scots Pint of Ale or Beer that shall be brewed for Sale, vended, or tapped, within the Town of Elgin, and Privileges thereof, for paying the public Debts of the said Town, and for other the Purposes therein mentioned."

14. An Act for making the River Eden navigable, to Bank End, in the County of Cumberland."

To these Bills the Royal Assent was severally pronounced, in these Words; (videlicet,)

15. An Act to vest Two Fourth Parts of a Feefarm Rent, of Eighty-two Pounds, Eight Shillings, and Two Pence, issuing out of the Manor of Kingswood, in the County of Wilts (of which Two Fourth Parts the Lord Viscount Horcourt is seised in Fee), in Trustees, to the like Uses as a Messuage and Lands called Johnson's Farm, in the Parishes of Stanton Harcourt and Southly, or One of them, in the County of Oxon, were devised by Dame Elizabeth Harcourt Widow, deceased; and, in Lieu thereof, for vesting the said Premises called Johnson's Farm in the said Lord Viscount Harcourt and his Heirs."

16. An Act to enable the Mayor, Burgesses, and Commonalty, of the City of Bristol, to build an Exchange there, for the Conveniency of the Merchants and Traders of that City."

17. An Act for Sale of Part of Sir John Wentworth's Estate, towards raising Part of the Sum of Ten Thousand Pounds, for the Purposes therein mentioned."

18. An Act for vesting Part of the Estate of Sir Ralph Milbanke Baronet in Trustees, to be sold, for performing his Father's Will, and an Agreement made with his Brother and Sisters."

19. An Act for uniting and consolidating the Parish Churches of Stypul, alias Steeple, and Tyneham, within the Isle of Purbeck, in the County of Dorset."

20. An Act to enable Elizabeth and Margaret Newton, Infants, during their Minority, with Consent of Trustees, to grant and fill up Leases of Part of the Estate late of John Newton Esquire, their Father, deceased."

21. An Act for vesting the Estate late of James Price, of Pilleth in the County of Radnor Esquire, deceased, in Trustees, to be sold, for Payment of several Portions and Legacies charged thereon."

22. An Act to empower the Commissioners and Trustees for the forseited Estates to give such Relief to Hugh Wallace of Inglestoun Esquire and Hugh Wallace his Son, in relation to their Part in an Heritable Bond and Enfeosment upon the Estate of James late Earl of Linlithgow, attainted of High Treason, as they have given to other Claimants upon the said Bond."

Allardes versus Smart et al.

After hearing Counsel, as well on Monday last as this Day, upon the Petition and Appeal of John Allardes Merchant; complaining of several Interlocutory Sentences, or Decrees, of the Lords of Session in Scotland, of the Sixteenth of February and Fourteenth of July One Thousand Seven Hundred and Twenty, and the Eleventh of January following, made on the Behalf of Jane Smart and her Children; and praying, "That the same may be reversed:" As also upon the Answer of Jane the Widow of John Allardes, late Merchant in Aberdeen, on Behalf of herself and Children, put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

Interlocutors affirmed.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal be, and is hereby, dismissed this House; and that the Interlocutory Sentences, or Decrees, therein complained of, be, and are hereby, affirmed.

E. Broadalbin et al. versus E. Cauhness.

Upon reading the Petition and Appeal of John Earl of Broadalbin, Sir James Sinclair of Dunbeath Baronet, and John Sinclair of Ulbster Esquire; complaining of several Interlocutory Sentences of the Lords of Session in Scotland, of the Fourth of January, the Seventh and Eighteenth of February, 1720-1, the Twenty-seventh of December and Thirty-first of January last, made on the Behalf of Alexander Earl of Carthness; and praying, "That the same may be reversed:"

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the said Alexander Earl of Caithness may have a Copy of the said Appeal; and do put in his Answer thereunto, in Writing, on or before Monday the Twelfth Day of March next; and that Service of this Order on the Respondent's Agent, or Writer, in the Court of Session in Scotland, be deemed good Service.

E. of Essex, Privilege, for Lanne his Servant:

Complaint being made to the House, of a Breach of Privilege, committed by John Earl, a Bailiss, in arresting Honera Lanire, Valet de Chambre to William Earl of Essex, within the Time of Privilege of Parliament:

And thereupon the said Honera Lanire was called in, and examined upon Oath at the Bar, in relation to the said Arrest.

And being withdrawn:

Earl, a Bailiff, atached for arresting him.

It is Ordered, by the Lords Spiritual and Temporal in Parliament assembled, That the Gentleman Usher of the Black Rod attending this House, his Deputy or Deputies, do forthwith attach the Body of the said John Earl, for his said Offence, and keep him in safe Custody during the Pleasure of this House; and this shall be a sufficient Warrant on that Behalf.

Upon reading the Petition and Appeal of Susanna Lady Wenman, Wife of Richard Lord Viscount Wenman of Tuam in the Kingdom of Ireland; complaining of certain Orders of the High Court of Chancery, of the Twenty-seventh of October 1718, the Twentieth of January 1720, and particularly of an Order of the said Court of the Nineteenth of January last, whereby the Petitioner is committed to the Prison of The Fleet, for a supposed Contempt, in not yielding Obedience to the several Orders of the said Court, and to the Precepts of the Commissioners in the said Order mentioned, for producing the said Lord Wenman, made upon the Application of Sir William Osbaldeston Baronet, in the Prosecution of a Commission of Ideocy against the said Lord; and praying, "That the said Sir William Osbaldeston may answer the Premises, and shew Cause (if he can) why the said Orders, so far as the same relate to the Petitioner, should not be set aside and reversed, and the Petitioner discharged from her said Imprisonment, and otherwise relieved:"

After hearing Counsel, upon the Petition and Appeal of John Walker Merchant in Edinburgh; complaining of an Interlocutor of the Lord Ordinary, of the Twentyeighth of June 1721, and of the Interlocutors of the Lords of Session in Scotland, the Fourteenth and One and Twentieth of July and Two and Twentieth of November following, made on the Behalf of Robert Forrester and William M'pherson; and praying, "That the same may be reversed:" As also upon the Answer of the said Robert Forrester and William M'pherson put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

Judgement.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That so much of the Interlocutor of the said Lord Ordinary, of the Twenty-eighth of June One Thousand Seven Hundred Twenty-one, and of the Interlocutors of the said Lords of Session, of the Fourteenth and One and Twentieth of July and Two and Twentieth of November following, whereby the Defence of bona Fide Possessors to liberate the Respondents from accompting for the Rents preceding the Interlocutor of the Thirteenth of November One Thousand Seven Hundred and Nineteen is sustained, and the Allegation of the Respondents being put in mala Fide by the Appellant's Citations or Arrestments is repelled, be, and the same is hereby, reversed: And it is further Ordered, That the Respondents accompt for, and pay to the Appellant, the Rents and Profits of the Estate in Question, intromitted with by them, since the Time of the Arrestment, at the Instance of the Appellant, in July One Thousand Seven Hundred and Fourteen; and that such Parts of the said Interlocutors, whereby the Appellant is denied his Costs, so far as concerns the Costs of the former Suit, be, and the same are hereby, assirmed; and, so far as concerns the Costs of his last Suit, be, and the same are hereby, reversed: And it is hereby further Ordered, That the said Lords of Session do forthwith tax and ascertain the Appellant's Costs of the said last Suit; and that the said Costs, when so taxed and ascertained, be immediately paid by the Respondents to the Appellant.

3dly, We apprehend, that all Matters properly brought before either House of Parliament, especially Inquiries into Mismanagements of the Public Business, ought, if the Time will allow it, to be freely and fully discussed, and determined one Way or other; and ought not to be kept off from coming to any Determination, by One long Adjournment after another, till the Session be ended.

A Petition of Christopher Ernest Kien Esquire, was presented to the House, and read; setting forth, "That the Petitioner is aggrieved by a Decree of the Court of Exchequer; whereby a specific Performance of Articles, to purchase an Estate in the Fens in Lincolnshire, at so extravagant a Rate as Forty Years Purchase, is decreed against him;" and praying, "in regard the said Decree will be carried into Execution, and the Purchase money paid, before the next Sessions of Parliament, that their Lordships will please to receive the Petitioner's Appeal."

Then, the said Petition and Appeal of Christopher Ernest Kien, was presented to the House, and read; complaining of a Decree of the Court of Exchequer, of the Eighth Day of this Instant February, in a Cause wherein Adlard Squire Stukeley Gentleman was Plaintiff, and the Petitioner Defendant; and praying, "That the same may be reversed; and the Plaintiff's Bill dismissed, with Costs:"

Building or selling Ships of Force for the Use of Foreigners, to restrain, Bill.

Motion, that it is necessary to lessen the Public Debt annually, for restoring Public Credit:

Then a Motion was made, "That the lessening the Public Debt Annually, by all proper Methods, is necessary to the restoring and preserving the Public Credit."

The previous Question was put, "Whether the said Question shall be now put?"

It was Resolved in the Negative.

Protest against not putting the Question.

"Diffentient.

1st, Because, as the main Question is undeniably true, and seems to us admitted to be so, by its being prevented to be put by the previous Question; so we think it would have been highly expedient and useful to the Public, to have had it put, and voted in the Affirmative; that, by the declared Opinion of this House (which must always be of the greatest Authority), those who are more immediately concerned to take Care of the Public Credit might not rely on vain and deceitful Projects for restoring and preserving the Credit of the Nation; but apply themselves seriously and diligently to bring about the only effectual Means of doing it.

2dly, Although so clear and evident a Truth as is contained in the main Question cannot, when proposed, but obtain the Consent of all, especially of such as are qualified to be in great Stations; yet, at this Juncture, when the Public is under so great Necessities, from the unexampled Pressure of Debts; and when all other Remedies hitherto attempted have proved ineffectual, if not mischievous; we cannot but conceive it was extremely proper, and must have greatly conduced to the restoring and preserving the Public Credit, to have quickened the Endeavours for that Purpose of all in the public Service, by so high an Authority as a Resolution of this House, not only pointing out to them the Way they should take towards that good End, but intimating also, that, as far as it is possible to be attained, the doing so would be expected from them.

"And therefore we conceive the main Question should have been put, and voted (as we think it must have been had it been put) in the Affirmative.
