Pocklington to amend his Appeal.
Upon reading the Petition of Christopher Pocklington Esquire and Elizabeth his Wife; praying Leave to amend their Appeal, to which Sir Compton Domville Baronet is Respondent, by inserting the Date of the Decretal Order to be the Seventh of June 1728; and mentioning the Respondent to be "One of the Administrators with the Will annexed of his late Father," he being in the Appeal called "One of the Executors:"

Upon reading the Petition and Appeal of George Smallet, Provost of the Borough of Dumbarton, James Duncanson and Humphry Colqubon Bailiffs of the said Borough, Gillies Mitchel Dean of Gild, James Niccoll Treasurer of the said Borough, Sir James Smallet, Dougall Campbell of Craignish, John Semple of Dalmoak, James Campbell Son of William Campbell late Bailiff of Dumbarton, James Howal Merchant, John Irving, William Carrouth, John Glen, William Wilson, and John Campbell, Counsellors of the said Borough, Archbald Cook Common Clerk, Allan Semple Officer, and John Campbell Officer of Work of the said Borough; complaining of an Interlocutory of the Lords of Session in Scotland, of the Sixth of February, and so much of an Interlocutory of the Eighth of February last, as finds that the Execution of the Warrant against David Colqubon, upon an Information exhibited against him of an atrocious Crime, by incarcerating him in the Castle of Dumbarton, was a Contrivance of Design to disable him from being present at the then ensuing Election; and that finds it proved, that the Appellant George Smallet, and those adhering to him, were accessary to the said Contrivance and Execution, which they found relevant to annul the Election of the Appellant Provost George Smallet, and the other Appellants the Magistrates and Council with him, and therefore reduced the Appellants Election; and also of an Interlocutor of the said Lords of Session, of the Twenty-seventh of the said Month of February, made on the Behalf of William Buntin, David Colqubon, David Weir, Alexander Weir Merchant, Robert Latty, William Traquair, William Buntin Younger, John Buchanan, Robert McAlaster, Alexander Weir Taylor, Robert Mitchel, John Kenedy, William Lang, Patrick Hutchinson, David Hutchinson, John Colqyhon, William Mitchel, James Smith, and Alexander Gardner; and praying, "That the same may be reversed:"

"Dissentient.
Because we think our Right to a Place of such Importance to our Commerce should be secured by more than general Stipulations, which may be liable to different Constructions; and will probably be interpreted by the Spaniards in their own Favour, however we may interpret them in ours.
Because the King of Spain, having claimed it by His Ministers several Times, not only from the late King's positive Promise, as He asserts it to be, but from our Forseiture of it too, by our Infractions of those Conditions on which He gave it up to us, and having actually besieged it since He yielded it to us by Treaty; it seems reasonable to us, that we should insist upon His making His Renunciation of it in Words as plain and strong as He has made His Claim to it; especially since, as far as we have heard, our Plenipotentiaries have not been able to prevail upon Him to shew any Inclination to relinquish His Pretensions to it, during the long Course of these perplexed Negotiations, in which we have been unskilfully, as we fear, and we are sure we have been unfortunately, involved.
We think it is incumbent upon us to take particular Care that our Right to it should not in the least be precarious; because, we apprehend, we have great Reason to sear that the King of Spain's Allies are very desirous to have it again in His Hands, and no Reason at all to believe that our own Allies are solicitous to have it continue in ours. If there should be the least Room left, upon a Peace, for the King of Spain's Pretensions to it, from any loose or doubtful Expressions; we are apprehensive, it may lay a Foundation for Uneasiness and Animosity; and might interrupt a perfect Harmony between us and a Nation whose Friendship must always be of the greatest Advantage to us. We think our Zeal to preserve our Title to it, in that most effectual Manner we proposed, would have terrified any wicked Ministers even from the Thoughts of giving it up, if ever we should be in such wretched Circumstances as to have any who might think a War more dangerous to themselves than the Nation; and who might, for that Reason, be tempted to purchase an inglorious Peace at the high Price of so valuable a Part of the Brittish Dominions.

A Petition of Thomas Madgwick, in Custody of the Serjeant at Arms attending this House, for a Breach of Privilege, in causing a Hedge belonging to the Lord Ashburnham to be cut down and carried away, during the Time of Privilege of Parliament, was presented to the House, and read; acknowledging his Offence, begging Pardon for the same, and praying to be discharged.

Sale of Annuities to the Bank, Bill.
The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act for raising the Sum of One Million Two Hundred and Fifty Thousand Pounds, by Sale of Annuities to the Bank of England, after the Rate of Four Pounds per Centum per Annum, redeemable by Parliament; and for applying the Produce of the Sinking Fund."
And, after some Time spent therein, the House was resumed.
And the Lord Delawarr reported from the said Committee, "That they had gone through the said Bill, and directed him to report the same to the House, without any Amendment."
