Chatham Road to repair, Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act for repairing and widening the Road from that Part of Chatham which lies next to the City of Rochester, to St. Dunstan's Cross, near the City of Canterbury, in the County of Kent; and for repealing so much of the former Act, as appropriates Part of the Money arising by the Tolls or Duties therein mentioned towards repairing the Road between the Town of Chatham and Boughton under the Blean, in the said County of Kent."

Lucy versus Moore:

After hearing Counsel, upon the Petition and Appeal of Frances Lucy Widow; complaining of Part of a Decree of the Court of Chancery, made the Twelsth of November 1728, in certain Causes, wherein the Appellant was Plaintiff, and Robert Moore Esquire and others were Defendants, et è contra; and praying, That the same may be reversed, and the Appellant relieved:" As also upon the Answer of the said Robert Moore put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause;

Decree affirmed.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal be, and is hereby, dismissed this House; and that the said Decree therein complained of be, and is hereby, affirmed.

Counsel to be heard for and against River Stroudwater Bill.

Upon reading the Petition of several Land Owners and Owners of Mills, and Clothiers, within the County of Gloucester; praying, "That they may be heard, by their Counsel, against the Bill for making the River Stroudwater, in the County of Gloucester, navigable:"

It is Ordered, That the Consideration of the said Petition be, and is hereby, referred to the Lords Committees to whom the said Bill stands committed; and that the Petitioners may be heard, by Counsel, in relation to the said Bill, before the said Committee; and that Counsel may be heard for the said Bill, at the same Time.

Hopkins's Petition, for Money to be paid him, referred to a Committee.

Upon reading the Petition of Bertie Hopkins Gentleman and Margaret his Wife; praying, "In regard they are, by Nineteen Years Expence in the Prosecution of their Cause, reduced to such low and necessitous Circumstances, that they cannot proceed to take the Accompt directed by this House; that Isaac Honywood, who was Respondent to their Appeal, may forthwith pay the Petitioners such Sum of Money, for their present Subsistence, as shall be thought reasonable:"

Folkes versus Lewis.

Upon reading the Petition and Appeal of Thomas Folkes Esquire; complaining of a Decree, or Order, of the Court of Exchequer, made the Fifth of February last, in a Cause wherein Maurice Lewis Esquire was Plaintiff, and the Appellant Defendant; and praying, That the same may be reversed, and the Appellant relieved:"

Worcester Workhouse, Bill.

The Lord Bathurst reported from the Lords Committees to whom the Bill, intituled, "An Act for amending and making more effectual an Act made in the Second and Third Years of the Reign of the late Queen Anne, intituled, "An Act for erecting a Workhouse in the City of Worcester, and for setting the Poor on Work there," was committed: "That they had considered the said Bill, and gone through the same, and made some Amendments thereunto."

Which, being read Twice by the Clerk, were agreed to by the House, and are as follow; (videlicet,)

"Press 5. Line 22. After ["Lease"], insert ["and"]; and in the same Line, leave out ["and dispose"].

Inhabitants near Cirencesters, for Stroudwater Bill.

A Petition of several Gentlemen, Clothiers, and other chief Inhabitants and Traders, lying in and near the Town of Cirencester, and other adjacent Places, in the County of Gloucester, whose Names are thereunto subscribed.:

Inhabitants of Stroud, and other Places, for Stroudwater Bill.

Also, a Petition of the several Gentlemen, Clothiers, and other Chief Inhabitants and Traders, lying in and near the Towns of Stroud and Bisley, and the several Townships and Hamlets of Chalford, Nailsworth, and Woodchester, and other Places, in the County of Gloucester, whose Names are thereunto subscribed;

Were severally presented to the House, and read; praying, "That the Bill for making the River called Stroudwater, in the said County, navigable, may pass into a Law."

And the said Petitions were severally ordered to be referred to the Lords Committees to whom the said Bill stands committed.

His Majesty's Consent signified to the E. of Ranelagh's Bill.

The Lord Privy Seal acquainted the House, "That His Majesty having been informed of the Contents of the Bill for Sale of the Estate of the late Earl of Ranelagh, was graciously pleased to consent that such Sale may be made as desired."

Lords added to the Wisbech Road Bill.

Ordered, That all the Lords that have been present this Session, and not named of the Committee to whom the Bill for making a new Road, and for repairing and amending the ancient Road, between the Towns of Wisbech and March, in the Isle of Ely, stands committed, be added to the said Committee.

Abp. of Armagh and Whaley against The King, in Error.

Counsel (according to Order) were called in, to argue the Errors assigned upon a Writ of Error depending in this House, wherein the Archbishop of Ardmagh and Nathaniel Whaley Clerk are Plaintiffs, and the King is Defendant.

And the Plaintiffs Counsel being heard accordingly:

They were all directed to withdraw.

And being withdrawn:

It is Ordered, That the further hearing of the Errors argued in this Case be adjourned till Tomorrow.

And Counsel being heard, as well Yesterday as this Day, to argue the Errors assigned upon the said Writ of Error:

And the Judges being heard, upon certain Questions to them proposed:

And due Consideration and Debate had of what was offered on either Side in this Case:

[A.] Provided always, and be it further Enacted, That nothing herein contained shall extend, or be construed to extend, to enable the Proprietors, Owners, or Occupiers, of the said Fields, Meadows, and other Commonable Lands, by any Agreement or Agreements between themselves, to lay down with Grass Seeds, or convert to Pasture, more than Twothird Parts of the same in any One Year, without the Consent of the Impropriator or Impropriators of Welsbourne Mountfort for the Time being; but not to prevent or hinder any particular Proprietor, Owner, or Occupier, of any Part of the said intended Enclosures, provided he or she is not the Proprietor, Owner, or Occupier, of Two-thirds of all the Common Fields, Common Meadows, and other Commonable Lands, intended to be enclosed as aforesaid, from continuing his or her respective Share or Shares, Allotment or Allotments, in Tillage or Grazing, in such Proportion, and in such Manner, as he or she shall think most convenient and proper."

The Lord Bathurst reported from the Lords Committees to whom the Bill, intituled, "An Act for making navigable the River Stroudwater, in the County of Gloucester, from the River Severn, at or near Framiload, to Wallbridge, near the Town of Stroud, in the same County," was committed: "That they had considered the said Bill, and heard some Persons in relation thereunto; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

The Earl of Findlater reported from the Lords Committees to whom the Bill, intituled, "An Act for providing a Maintenance for the Minister of the new Church near Bloomsbury Market, in the County of Middlesex; and for making more effectual an Act passed in the Fourth Year of His late Majesty's Reign, for empowering the Commissioners for building the Fifty new Churches to direct the Parish Church of St. Giles in the Fields to be re-built, instead of One of the said Fifty new Churches," was committed: That they had considered the said Bill, and gone through the same; and directed him to report the Bill to the House, without any Amendment."

Bridgewater Roads, to repair, Bill.

The Earl of Findlater reported from the Lords Committees to whom the Bill, intituled, "An Act for repairing several Roads leading into the Town of Bridge water, in the County of Somerset," was committed: "That they had considered the said Bill, and gone through the same; and directed him to report the Bill to the House, without any Amendment."

Bastard Children, Bill:

Dowell's Pet. touching Squier's Costs.

Upon reading the Petition of John Baker Dowell Esquire; setting forth, "That, upon hearing the Appeal of Arthur Squier Gentleman, the Twenty-seventh of February 1726, from a Decree of the Court of Chancery, this House was pleased to affirm the same, and ordered the said Squier to pay the Petitioner One Hundred Pounds for his Costs; who refusing to pay the same, he was, on the Fourth of March following, ordered to be taken into Custody by the Black Rod, unless he should, within Ten Days, pay the said Costs; and has remained in such Custody ever since, to evade the said Payment;" and praying, "in regard the Petitioner is informed the said Squier hath a Real Estate in Cornwall, much more than sufficient to answer the said Costs, that the Recognizance by him entered into may be estreated into His Majesty's Court of Exchequer, to be put in Suit against him, for the Petitioner's Benefit; or that such Order may be made for his Relief as to this House shall seem meet:"

It is Ordered, That the said Arthur Squier be brought to the Bar of this House, To-morrow Morning.

Debtors Relief Act, to explain, Bill.
