L. Chedworth takes his Seat.

John Lord Chedworth sat first in Parliament, after the Death of his Father John Lord Chedworth; having, at the Table, first taken the Oaths, and made and subscribed the Declaration, and also taken and subscribed the Oath of Abjuration, pursuant to the Statutes.

With a Bill, intituled, "An Act to explain and amend Two Acts of Parliament; One, made in the Ninth Year of the Reign of Her late Majesty Queen Anne, intituled, "An Act for repairing the Highways from Sheet Bridge, in the Parish of Petersfield, to the Town of Portsmouth, in the County of Southampton;" and another Act, made in the Twelfth Year of the Reign of His late Majesty King George the First, for enlarging the Term in and by the said Act granted; and for other Purposes therein mentioned; and for enlarging the Term and Powers by the said last mentioned Act granted;" to which they desire the Concurrence of this House.

Ordered, That the Lord Bishop of St. Asaph be, and he is hereby, desired to preach before this House, in the Abbey Church, Westminster, on the 29th Day of this Instant May, being the Anniversary Thanksgiving to Almighty God for the Restitution of King Charles the Second and Royal Family, and the Restoration of the Government, after the Great Rebellion.

Standing Orders considered and varied.

The Order of the Day being read, for taking into Consideration several of the Standing Orders of this House:

The Order of the 25th of January 1720, N^o 112, as entered in the Roll of Standing Orders, was read, as follows; (videlicet,)

That, when an Order of the Day is appointed to be read, for taking any Public Business into Consideration, the Lord on the Woolsack do stop the Reading of the Order, till the House shall be cleared of all Persons that have no Right to be in the House when sitting, if any such shall be there at that Time."

Then it was moved, "That the same be vacated, in order to substitute another instead thereof."

Which being objected to;

And Debate thereupon:

The Question was put, "Whether the said Standing Order shall be vacated?"

It was Resolved in the Negative.

Next, the Rule entered in the said Roll, N^o 9, was read, as follows; videlicet,

"Every Lord that comes after Prayers, if he be a Baron or Bishop, is to pay One Shilling; and if he be of any Degree above, Two Shillings, for the Poor: But every Lord who comes not at all, and makes not his just Excuse, is to pay Five Shillings for every Day's Absence."

Ordered, That the said Standing Rule be vacated.

Then, the Standing Order of the 28th of June 1715, N^o 62, was read, as follows; (videlicet,)

"That, on the Days Causes are appointed to be heard, the Cause be called in precisely at Eleven o'Clock; and no other Business to intervene."

Proposed, "To leave out the Words ["called in precisely at Eleven o'Clock"]; and instead thereof to insert these Words, ["the First Business proceeded on after Prayers"]."

And the same was agreed to.

Then, the Standing Order of the 13th of June, 1685, was read, as follows; (videlicet,)

"That, for the future, neither His Majesty's Attorney General, nor any Assistant to this House, shall be allowed to be of Counsel, at the Bar of this House, for any private Person or Persons whatsoever."

Proposed, "To insert, before the Word ["Assistant"], the Word ["other"]."

And the same was agreed to.

Also proposed, "After the Words, ["to this House"], to insert these Words ["after having taken his Place on the Woolsacks as such"]."

And that Variation was likewise agreed to.

Then the Standing Order of the 16th of November 1705, N^o 96, was read, as follows; (videlicet,)

"That, for the future, no Private Bill shall be read in this House, until printed Copies thereof be left with the Clerk of the Parliaments, for the Perusal of the Lords; and that One of the said Copies shall be delivered to every Person as shall be concerned in the said Bill, before the Meeting of the Committee upon such Bill; and, in case of Infancy, to be delivered to the Guardian, or next Relation of full Age, not concerned in Interest, or in the passing the said Bill."

Proposed, "To insert, after the Word ["House"], these Words ["a Second Time"]."

And that Addition was also agreed to.

After which, the Rule, as entered in the said Roll, N^o 79, was read, as follows; videlicet,

"All Proxies from a Spiritual Lord shall be made to a Spiritual Lord, and from a Temporal Lord to a Temporal Lord."

Moved, "To leave out ["a"], after ["made to"]; and insert ["One or more"]."

The same was objected to.

And the Question being put, upon the said Motion:

It was Resolved in the Negative.

Ordered, That the said Roll of Standing Orders be varied, and rectified, according to the aforegoing Directions.

And thereupon the Agents on both Sides were called in, and heard at the Bar.

And being withdrawn:

Ordered, That the said Hearing be put off to the First vacant Day for Causes after those already appointed.

Chetwynd against Fleetwood & al.

After hearing Counsel, as well on Friday last as this Day, upon the Petition and Appeal of Walter Chetwynd Esquire; complaining of a Decree of the Court of Chancery, of the 3^d of November 1735, made in a Cause wherein Henry Fleetwood Esquire was Plaintiff, and the Appellant, together with William Henry Chetwynd and Barbara Chetwynd (since married to William Blacknell), the Appellant's Brother and Sister, Thomas Beckford Esquire Executor of William Beckford Esquire, deceased, William Chetwynd Esquire, William Clayton Esquire, and Edward Lane the Administrator of Walter Chetwynd Esquire, the Appellant's Father, deceased, were Defendants; and also of several subsequent Or ders of the said Court, and Reports made by the Master, in the said Cause; and praying, "That the said Decree, Orders, and Reports, might be set aside and reversed, so far as the same relate to or concern the Appellant or his Estate; and that this House would be pleased to give him such other Relief as in their great Wisdom and Justice should seem meet:" As also upon the joint and several Answers of the said Henry Fleetwood, William Clayton, and Edward Lane; and likewise upon the several Answers of the said Thomas Beckford, William Henry Chetwynd, William Chetwynd, William Blacknell and Barbara his Wife, put in to the said Appeal; and due Consideration had of what was offered on all Sides in this Cause:

Judgement.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Petition and Appeal be, and is hereby, dismissed this House; and that the said Decree, Orders, and Reports, complained of in the said Appeal, be, and the same are hereby, affirmed: And it is further Ordered, That there be paid to the Respondent Thomas Beckford the Sum of Thirty Pounds, for his Costs in respect of the said Appeal; and that the said Sum of Thirty Pounds be added to the Principal, Interest, and Costs, decreed by the said Court of Chancery to be paid to him.

Bank Agreement, Bill.

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act for establishing an Agreement with the Governor and Company of the Bank of England, for advancing the Sum of One Million Six Hundred Thousand Pounds, towards the Supply for the Service of the Year One Thousand Seven Hundred and Forty-two."

After some Time, the House was resumed.

And the Earl of Findlater reported from the said Committee, "That they had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Northey's Bill:

The Order of the Day being read, for taking into Consideration the Motion made on Friday last, for dispensing with the Standing Order of this House, relating to the Time of Commitment of Private Bills, so far as that the Committee to whom the Bill, intituled, "An Act to enable William Northey, an Infant, to settle Lands, Tenements, and Hereditaments, in the County of Wilts, for the Benefit of himself and any Woman he shall marry, and their Issue, notwithstanding his Infancy, and for other Purposes therein mentioned," stands committed, may meet on a sooner Day than was at first appointed.

And Consideration having been had thereof accordingly:

Committee shortened.

Ordered, That the said Standing Order be so far dispensed with, in this Case, as that the said Committee may meet, to consider of the said Bill, To-morrow.

Rolt's Bill.

The like Proceeding was had in relation to the Bill, intituled, "An Act for Sale of Part of the Estates of Edward Bayntun Rolt Esquire, to raise Money, for the Payment of Debts affecting the same, and of Portions for his Younger Brothers and Sister, charged thereon by the Settlement of their Uncle John Bayntun Esquire, deceased; and for other Purposes therein mentioned."

Lucas's Bill;

The last Order of the Day being read, for taking into Consideration the Motion, made likewise on Friday last, for dispensing with the Standing Order, for the same Purpose, in relation to the Bill, intituled, "An Act for vesting Part of the settled Estate of Robert Lucas Esquire and Mary his Wife in Trustees, to be sold; and for applying Part of the Money arising by such Sale in the Purchase of an Estate contracted for, in order to be settled, together with other Lands of the said Robert Lucas, as an Equivalent for the said settled Estate, and to the like Uses."

A Petition of Jeremiah Donovan Esquire, One of the Respondents to the Original Appeal of Samuel Sherriff Gentleman, and Appellant in the Cross Appeal, to which the said Sherriff is Respondent, was presented, and read; praying, "In regard the Petitioner's Case lies now before his Counsel, but is so very long as that he cannot possibly be ready for hearing at the Time the said Causes now stand appointed, that the same may be put off to such further Day as to the House shall seem meet."

And thereupon the Agents on both Sides were called in, and heard at the Bar.

And being withdrawn:

Ordered, That the said Hearing be put off to the First vacant Day for Causes after those already appointed.

Ingoldsby against Napper & al.:

The House being informed, "That William Crookshanks attended, in order to deliver in several Papers, Pleadings, and Proceedings, in the Cause wherein Thomas Ingoldsby Esquire is Appellant, and James Lenox Napper Esquire and others are Respondents:"

He was thereupon called in; and delivered, at the Bar, the said Papers and Proceedings; and attested upon Oath, "The same were true Copies, he having examined them with the Originals in the proper Offices in Ireland."
