Upon reading the Petition and Appeal of Colonel Charles Straton, in Old Montrose; complaining of an Interlocutor of the Lord Ordinary, of the 28th of January last; and of an Interlocutor of the Lords of Session in Scotland, of the 29th of the same Month; and of Two other Interlocutors of the Lord Ordinary, of the 5th and 9th of February last; and also of Two other Interlocutors of the said Lords, of the 24th and 25th of the same Month, made on the Behalf of the Magistrates and Town Council of the Borough of Montrose; and praying, "That the said Interlocutors may be reversed, varied, or altered; and that the Appellant may have such other Relief as to this House shall seem just:"

After hearing Counsel, upon the Petition and Appeal of Laughlin Naghten Esquire; complaining of a Decree of Dismission of the Court of Exchequer in Ireland, of the 24th Day of April 1738, made in a Cause wherein the Appellant was Plantiff, and Edwin Sandys Reynolds, John Staunton Executor of John Staunton Esquire deceased, Robert Le Strange Clerk and Edward Hudson Executors of Leonard Hudson Clerk, deceased, and Thomas Hudson Eldest Son and Heir of the said Leonard Hudson, were Desendants; and praying, "That the said Decree might be reversed; and that the Appellant might have such further and other Relief as to this House in their great Wisdom should seem meet:" As also upon the joint and several Answer of the said Edwin Sandys Reynolds, John Staunton, Robert Le Strange, Edward Hudson, and Thomas Hudson, put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

After hearing Counsel, upon the Petition and Appeal of William Earl of Sutherland; complaining of an Interlocutor of the Lords of Session in Scotland, of the 9th of July 1740; and of a subsequent Interlocutor of the same Lords, of the 24th of June 1741, whereby they adhered to their said former Interlocutor; and praying, "That the same might be reversed; and that the Appellant might have such Relief as to the House in their great Wisdom should seem meet:" As also upon the Answer of William Anderson put in to the said Ap peal; and due Consideration had of what was offered on either Side in this Cause:

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That so much of the said Interlocutor, whereby the Lords of Session found, "That no sufficient Claim of the Recognition in Question was entered before the Commissioners for inquiring into the forfeited Estates," be, and the same is hereby, reversed: And that in the said Interlocutor, after the Words ["Casualty of Recognition"], these Words be inserted ["incurred prior to the Treason committed by the Vassal"]: And it is hereby Declared, That the Appellant's Grandfather and Father having claimed the Estate in Question, by their Exceptions presented to the Court of Session, as forfeited to them under the Act of the First Year of His late Majesty, for encouraging Superiors and Vassals, Landlords and Tenants, in Scotland, who do and shall continue in their Duty and Loyalty to His Majesty, &c. and having, in the Year 1719, obtained a Decree of the said Court, declaring the said Estate to belong to them, by virtue of the said Act, in respect of the Rebellion of their Vassal, with the Burden always of a Proportion of the Debts affecting the said Estate, the same was a Waiver or Renunciation of any Recognition prior to the Treason so committed as aforesaid; and that the Appellant is bound thereby: And it is further Ordered and Adjudged, That the Residue of the said Interlocutors, with the Alterations or Variations before mentioned, be, and the same is hereby, affirmed.

The House proceeded to take into Consideration the Amendments made by the Commons to the Bill, intituled, "An Act for vesting divers Lands and Hereditaments, in Ravensworth and Washton, in the County of York, in James Cooke the Younger, Gentleman, in Fee Simple, discharged of the Uses and Trusts of his Marriage Settlement; and for settling, in Lieu thereof, other Lands and Hereditaments, of greater Value, to the same Uses."

The House (according to Order) was adjourned during Pleasure, and put into a Committee upon the Bill, intituled, "An Act to continue an Act made in the Fifth Year of the Reign of His present Majesty, intituled, An Act to prevent the committing of Frauds by Bankrupts."
After some Time, the House was resumed.
And the Lord Willoughby of Parham reported from the said Committee, "That they had gone through the Bill, and directed him to report the same to the House, without any Amendment."
Indemnifying Persons omitting to take the Oaths, Bill.
Hodie 2a vice lecta est Billa, intituled, "An Act to indemnify Persons who have omitted to qualify themselves for Offices and Employments within the Time limited by Law, and for allowing further Time for that Purpose; and also for amending so much of an Act, made in the Twenty-fifth Year of the Reign of King Charles the Second, intituled, "An Act for preventing Dangers which may happen from Popish Recusants," as relates to the Time for receiving the Sacrament of the Lord's Supper, now limited by the said Act."
Ordered, That the said Bill be committed to a Committee of the whole House, on Thursday after the Recess at Easter.
Nugent to enter into Recognizance for Savage.
The House being moved, "That Christopher Nugent Esquire, commonly called Lord Delvin in the Kingdom of Ireland, may be permitted to enter into a Recognizance for Andrew Savage Esquire and his Eldest Son, on account of their Appeal depending in this House; they being in Ireland:"
