Clarke, to amend her Appeal.
A Petition of Jacobina Clarke, was presented, and read, setting forth, "That an Appeal was formerly depending in this House, wherein the Earl of Home was Appellant, and the Petitioner Respondent, and she, being advised that certain Writings, then brought before the Court of Session in Scotland, would be material at the hearing the said Appeal, did, on the 7th of December 1743, apply to this House, "That such Deeds and Writings as were produced in the said Court of Session might be properly transmitted to the Clerk of this House," which Order being made accordingly, the said Writings were transmitted hither, and carefully returned,' and further setting forth, "That she is still advised, it may be material for her to have the same Writings again transmitted hither," and praying, "That the said Order for that Purpose may be renewed, and also that, in the mean Time, she may amend her Appeal, by making the Tenants of the said Earl of Home Parties thereto, who were originally Parties in the Cause below, the Petitioner being willing to amend the Respondent's Copy"
And thereupon the Agents on both Sides were called in, and heard at the Bar.
And being withdrawn.

The Lord Willoughby of Parham reported from the Lords Committees to whom the Bill, intituled, "An Act for repairing and widening the Road from the Town of Warminster, in the County of Wilts, to the City of Bath, in the County of Somerset, and also the Road from the Town of Froome, in the said County of Somerset, to the Town of Beckington, in the same County, and for repairing the Road from Heytesbury to Anstrow Hill, in the County of Wilts," was committed. "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true, and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment.

The Order of the Day being read, for the Second Reading of the Bill, intituled, "An Act for supplying certain Defects in a Settlement of the Family Estates of Peregrine Duke of Ancaster and Kesteven, by enabling him to raise Portions thereout for his Daughters, in the Manner therein mentioned," and for hearing Counsel, as well for as against the same.
Counsel were accordingly called in.
And the said Bill was read a Second Time.
Then the Petition of Robert Bertie Esquire, commonly called Lord Robert Bertie, against the Bill, was also read.
And Mr. Forrester was heard at large thereupon.
Next, Mr Evans was heard at large, for the Bill.
Which done,
The Counsel against the Bill proposed, "To call Robert Harper Esquire, who prepared the Settlement mentioned in the said Bill, in order to inform the House what Instructions he received for preparing the same"
And he, being produced accordingly, was sworn, and examined thereupon.
Then Mr. Pratt, Second Counsel for the Bill, was heard.
As was likewise Mr. Forrester, by Way of Reply.
And then the Counsel were directed to withdraw.
