Report from the Committee of Privileges, touching the E. of Bristol.

The Earl of Clare reported, That the Sub-committee for Privileges have met (according to the Order of the 25th of this April), and considered the Message brought from His Majesty by my Lord Keeper, which contained Three general Charges, or Accusations: videlicet, my Lord of Bristoll's ill Service before His Majesty, then Prince, His coming into Spaine, while He was in Spaine, and since His Majesty's coming out of Spaine; and One Accusation more particular: videlicet, That the Earl of Bristoll had immediately scandalized my Lord Duke of Buckingham, who did what he did with the King's Knowledge; and mediately, and by Reflexion, the King himself; which Petition, so conditioned, the Lords thought good to lay aside for that Time, not because they took it at all into their Consideration whether the Lord of Bristoll was committed for Matter of State, as was conceived, but for that they had other great Businesses on Foot, which they held necessary to be first determined. And that the said Sub-committee, entering into further Consideration of the King's Message, called to the Clerk, for the Letter, which was read here the 30th of March last; who answered, that the Duke of Buckingham, who delivered that Letter to be read, did presently take the same from him again, so that we find the same not to be entered here in the Journal Book, which is contrary to Order; for, being the House was once possessed thereof, it ought not to have been taken out of the House, nor delivered, without Leave of the House.

His Lordship also reported, That they perused the Petition of the Countess of Bristol, exhibited here the 25th of this April, and the Order thereupon made, That the Earl shall remain in the Custody of the Gentleman Usher.

And his Lordship further reported, That the said Subcommittee had searched for Precedents, and find this: videlicet, Anno 50° E. III, William Lord Latimer and John Lord Nevill, being accused by the Commons of Misdemeanors, did answer in their Places, and were not committed to Ward till after Judgement of their Peers. And the Bishop of Worcestre, Anno Jacobi Regis, the Bishop of Landafe, Anno 18° Jacobi Regis, and the Bishop of Norwich, Anno 21° Jacobi Regis, being accused of the Commons of Misdemeanors, did all answer in their Places. As for the Earl of Bristol, who is sent for to be brought up by the Gentleman Usher, by Order of this House, and to rest now in his Custody, the Subcommittee leaves it to the Consideration of the House how he shall be demeaned.

The Report ended, the Clerk read the King's Message of the 21st of this April, and the Order to bring up the Earl of Bristol thereupon; and the Petition of the Countess of Bristol, and the Order thereon of the 25th of this April.

And their Lordships having long debated, whether the Earl of Bristol should be sent for, and answer in his Place, or remain as yet in Custody where he is;

It was Ordered, The Gentleman Usher, on Monday next, to return to the House what he hath done upon the Order he received from the House, for bringing the Earl of Bristol before their Lordships; and then the House to be put into a Committee.
