A Message was brought from the House of Commons, by Mr. Rose Fuller and others:

To return the Bill, intituled, "An Act for vesting a Toft, or Scite of a Copyhold House, at Richmond in the County of Surry, lately pulled down, in Trustees, to be sold, leased, or otherwise disposed of, for the Benefit of the Persons claiming under the Will of Matthias Perkins Gentleman, deceased; and for empowering John Perkins his Son to make such Leases of his Estate at Richmond and Tuddington as are therein mentioned;" and to acquaint this House, that they have agreed to the same, without any Amendment.

Stamford Road, Bill.

With a Bill, intituled, "An Act for repairing and widening the Roads from a certain Bridge called James Deeping Stone Bridge to Peter's Gate in Stamford in the County of Lincoln, and from thence to the South End of the Town of Morcot in the County of Rutland;" to which they desire the Concurrence of this House.

Ashford Road, Bill.

With a Bill, intituled, "An Act for repairing and widening the Road from Flimwell Vent in the County of Sussex, through Highgate in the County of Kent, and the Parishes of Sandhurst, Newenden, and Northiam, to Rye in the said County of Sussex, and from Highgate aforesaid to Cooper's Corner in the said County of Sussex, and to Tubb's Lake in the said County of Kent;" to which they desire the Concurrence of this House.

Foreign Protestant Officers in America, Nat. Bill, Conference on, at the desire of H. C.:

A Message was brought from the House of Commons, by the Marquis of Granby and others:

To desire a Conference with this House, upon the Subject-matter of the Amendments made by their Lordships to the Bill, intituled, "An Act for naturalizing such Foreign Protestants as have served, or shall serve, for the Time therein mentioned, as Officers or Soldiers, in His Majesty's Royal American Regiment, or as Engineers in America."

To which the House agreed.

And the Messengers were called in; and told, "That the Lords do agree to a Conference, as desired; and appoint the same presently, in the Painted Chamber."

Report of the Conference:

And the Lord Chamberlain reported, "That they had met the Managers for the Commons at the Conference, which was managed on their Part by Mr. Charles Townshend; who delivered to them the Bill, with the said Amendments; and also a Paper containing as follows; (videlicet,)

"To the First Amendment made by your Lordships to the Bill, intituled, "An Act for naturalizing such Foreign Protestants as have served, or shall serve, for the Time therein mentioned, as Officers or Soldiers in His Majesty's Royal American Regiment, or as Engineers in America," which is in Press 2. L. 33. to leave out ["the Royal American Regiment"], and instead thereof to insert ["His Majesty's Armies"], the Commons disagree;

"1st, Because it is by no Means correspondent with the Design of the Bill, which was intended to grant the Benefit of Naturalization to those Foreigners only who, having been enabled by the Act of the 29th Year of His late Majesty's Reign to serve under certain Restrictions in one particular Regiment, or as Engineers in America, should have since served for Two Years according to the Terms of the said Act, to which Purpose alone the whole Frame of the Bill is adapted; whereas the Amendment made by your Lordships would establish Military Service in general as a standing and ordinary Mode of Naturalization, a Provision which the Commons cannot but look upon as far too extensive and important to be introduced by Way of Amendment to a Bill of so limited an Extent as the present.

"2dly, Because, if the Establishment of such a Method of Naturalization could with any Propriety be inserted in this Bill; yet, for Want of such a Provision, for enabling the Crown to grant Commissions to the Persons who are the Subject of the Amendment, as was made by the Act of the 29th Year of His late Majesty's Reign with respect to those who are the Subject of the Bill, the Amendment proposed must be ineffectual; unless indeed it could be understood to convey indirectly, and by Implication, to Foreigners at large, a Capacity of holding Military Commissions; which, we fully persuade ourselves, your Lordships would be as unwilling to propose, as the Commons themselves to admit.

"To the Second Amendment made by your Lordships, which is in the Title of the Bill, to leave out ["Royal American Regiment"], and insert ["Armies"], the Commons disagree; because it entirely depends upon the former Amendment."

The Lords do not insist on their Amendments to the Bill.

Which Report being read by the Clerk; the House agreed, not to insist on the said Amendments.

And a Message was sent to the House of Commons, by Mr. Harris and Mr. Daval, to acquaint them therewith.

Clapham's Estate, to vest in Trustees; Bill.

A Message was brought from the House of Commons, by Mr. Ward and others:

With a Bill, intituled, "An Act for vesting certain Estates, in the Parish of St. Botolph Billingsgate, London, late the Estate of William Clapham Gentleman, in Trustees, for the Uses and Purposes therein mentioned;" to which they desire the Concurrence of this House.

Ord's Bill.

The Earl of Marchmont (according to Order) reported the Amendment made by the Committee to the Bill, intituled, "An Act for vesting divers Lands and Hereditaments, in the Parish of Igborough, in the County of Norfolk, Part of the settled Estate late of Henry Ord Esquire, deceased, in Trustees, to convey the same to James Nelthorpe Esquire and his Heirs; and to lay out the Money to be paid for the same in the Purchase of other Lands and Hereditaments, to be settled to the Uses therein mentioned;" together with the Reasons offered to the Committee for dispensing with the Standing Order in this Case.

And the said Amendments, being read Twice by the Clerk, were agreed to by the House.

And thereupon the House proceeded to take into Consideration the Motion made Yesterday, for dispensing with the Standing Order upon this Bill.

And the said Reasons reported from the Committee were read, as follow; videlicet,

"That no Estate can be purchased and paid for with the Money to be paid by the said James Nelthorpe until the same be received of him; and the said Mr. Nelthorpe finding that he should not be prepared to pay the Money at Lady Day 1762, when it was supposed the Sale might be finished, an Agreement in Writing, dated the 2d Day of April 1761, was entered into, by the said Mrs. Ord and Mr. Nelthorpe, that the said Mr. Nelthorpe should continue the Purchase-money in his Hands, on Land Security, for Three Years, at Five Pounds per Cent. per Annum, from Lady Day 1762; and Mrs. Ord expects, before the Expiration of the said Three Years, to make a Purchase of Land, to be settled according to the Directions of the intended Act."

And Consideration being had thereof:

Standing Order dispensed with.

Ordered, That the said Standing Order be dispensed with, in this Case.

Ordered, That the said Bill, with the Amendments, be engrossed.

Ashford and Hythe, Road Bill.

Hodie 1a vice lecta est Billa, intituled, "An Act for amending and widening the Road leading from the High Post Road near the Town of Faversham, by Bacon's Water, through Ashford, to the Town and Port of Hythe in the County of Kent, and from Bacon's Water to a certain Place called Holy Lane in Wincheap near the City of Canterbury."

Message from H. C. to return the Bill for Richards to take the Name of Powell.

A Message was brought from the House of Commons, by Mr. Capel Hanbury and others:

To return the Bill, intituled, "An Act to enable William Richards and Edward Richards, Infants, and their Heirs, to take and use the Surname and bear the Arms of Powell, pursuant to the Will of Roger Powell Esquire, deceased; and to acquaint this House, that they have agreed to the same, without any Amendment.

Davys against Howard & al.

After hearing Counsel, as well Yesterday as this Day, upon the Petition and Appeal of Charles Davys of Hampstead in the County of Dublin Esquire; complaining of a Decree of the Court of Chancery in Ireland, of the 9th of March, 1761; and praying, "That the same might be reversed or varied; or that the Appellant might have such other Relief as to this House in their Lordships great Wisdom should seem meet:" As also upon the Answer of Michael Howard and Alice his Wife put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

Judgement.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That so much of the said Decree complained of in the said Appeal, as declares, "That the Trusts in the Deeds of 1699 and 1721, in the Pleadings mentioned, as to the Appellant, were satisfied by the Real Estate that descended to him from John Davys his Father; and that the Appellant is not entitled to any Allowance out of the Personal Estate of the said John, on account of the Securities in the said Deeds mentioned," be, and the same is hereby, reversed: And it is hereby Declared, That the Trusts in the said Deeds are satisfied by the Real Estate that descended to the Appellant from John Davys his Father, except as to the Mortgage made for Two Thousand Pounds and Interest by Thomas Fortescue to St. Leger Gilbert the surviving Trustee, which Mortgage belongs to the Appellant Charles Davys, as First Son of the Marriage: And it is further Ordered and Adjudged, That the said Decree in all other respects be, and the same is hereby, affirmed; and that the said Court of Chancery in Ireland do give all proper Directions for carrying the said Decree, with this Variation, into Execution.

Sir George Colebrooke's Bill.

The Lord Hay reported from the Lords Committees to whom the Bill, intituled, "An Act for vesting the Capital Messuage, with the Lands and Hereditaments thereunto belonging, at Southgate in the Parish of Edmonton, and at Frian Barnett in the County of Middlesex, and at East Barnett in the County of Hertford, late Part of the Estate of James Colebrooke Esquire, deceased, comprised in the Marriage Settlement of Sir George Colebrooke Baronet, in him and his Heirs; and for settling other Lands and Hereditaments, in the Counties of Surrey and Middlesex, of equal Value, to the same Uses, in Lieu thereof; and for other Purposes in the said Act mentioned," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Ordered, That the said Bill be engrossed.

With a Bill, intituled, "An Act to amend so much of an Act, made in the First Year of the Reign of King James the First, for the better Execution of the Intent and Meaning of former Statutes made against shooting in Guns; and for the Preservation of the Game of Pheasants and Partridges; and against the destroying of Hares with Hare Pipes, and tracing Hares in the Snow; as relates to the Preservation of House Doves and Pigeons, by making the Manner of convicting such Person or Persons as shall offend therein more easy and expeditions;" to which they desire the Concurrence of this House.

The said Two Bills were read the First Time.

Trials for Murder, within the Admiralty Jurisdiction in America, Bill.

The Lord Sandys presented to the House, a Bill, intituled, "An Act for the more speedy and effectual Trial and Punishment, in His Majesty's Colonies and Plantations in America, of Persons guilty of Murder, within the Limits of the Admiral's Jurisdiction."

Alteration of the Stairs and Entry leading to the House, Report from the Committee about.

The Earl of Shastesbury reported from the Lords Committees appointed to take into Consideration the Roll of Standing Orders, and to whom it was referred also to consider the Inconveniencies attending the Lords, from Obstructions in the Streets, Passages, and Avenues to this House; and to report their Opinion thereupon:

"That the Committee have again met, and taken into further Consideration that Part of the Matter to them referred, relating to Obstructions in the Streets, Passages, and Avenues, to this House; and, having been attended by the Officers of the Board of Works, with Plans whereby the Inconveniencies attending the Lords in coming up to and going from this House may be remedied, and having inspected the said Plans, and considered thereof, are of Opinion, that, in order to remedy the great and various Inconveniencies arising from the present Entry to this House, the Stairs and Entry to the same be altered, and made according to the Plans laid before the Committee by the Officers of the Board of Works."

Which Report, being read Twice by the Clerk, was agreed to by the House.

Address thereupon.

Ordered, That an humble Address be presented to His Majesty, humbly to desire, "That, in order to remedy the great and various Inconveniencies arising from the present Entry to this House, His Majesty will be graciously pleased to give Directions, that the Stairs and Entry to the same be altered, and made according to the Plans laid before the Committee by the Officers of His Majesty's Board of Works."

Ordered, That the said Address be presented to His Majesty by the Lords with White Staves.

Hodie 2a vice lecta est Billa, intituled, "An Act to enlarge the Term and Powers granted by an Act passed in the Eleventh Year of the Reign of His late Majesty, for continuing several Acts relating to the Harbour of Liverpoole; and for enlarging the said Harbour, by making an additional Dock, and building a Pier in the open Harbour there; and for enlightening the said Dock, and for making another Dock with proper Piers in the said Harbour; and for erecting Lighthouses and other proper Lights in or near the Port of Liverpoole."

Rotherham Enclosure, Bill.

The Lord Willoughby of Parham reported from the Lords Committees to whom the Bill, intituled, "An Act for enclosing and dividing the Common Fields, Moors, and Common Grounds, in the Township of Rotherham, in the County of York," was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents, to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and made several Amendments thereto."

The Order of the Day was read, for taking into Consideration the Motion made Yesterday, for dispensing with the Standing Order, requiring Fourteen Days Notice to be given of the Meeting of Committees upon Private Bills, so far as that the Committee to whom the Bill, intituled, "An Act for repealing Part, and explaining and amending other Parts, of an Act made in the Thirty-second Year of the Reign of His late Majesty King George the Second, intituled, An Act for vesting Part of the Estates entailed by the Will of the most Noble Charles Noel Duke of Beaufort, deceased, in Trustees, to be sold; and for purchasing other Estates, to be settled to the like Uses; and for empowering the Guardian and Trustees named in the said Will to make Leases of the said Duke's Estates in the Counties of Gloucester, Wilts, Hants, Devon, Dorset, Glamorgan, and Brecon, during the Minority of his Children," stands committed, may meet on an earlier Day than is appointed, in regard of the approaching Conclusion of the Session.

And Consideration being had thereof accordingly:

Ordered, That the said Standing Order be dispensed with in this Case; and that the Committee may meet to consider of the said Bill on Monday next.

Weller's Bill.

The Order of the Day was also read, for taking into Consideration the Motion made Yesterday, for dispensing with the said Standing Order, so far as that the Committee to whom the Bill, intituled, " (fn. 2) An Act for Sale of Part of the Estates entailed by the Will of Edward Mellish Esquire, deceased; and for laying out the Money arising by such Sale in the Purchase of other Estates, to be settled to the like Uses," stands committed, may meet on an earlier Day than is appointed, in regard of the approaching Conclusion of the Session.

And Consideration being had thereof accordingly:

Ordered, That the said Standing Order be dispensed with in this Case; and that the Committee may meet, to consider the said Bill, on Tuesday next.

To prevent destroying Pigeons, &c. Bill.

The Earl of Marchmont (according to Order) reported the Amendments made by the Committee of the whole House to the Bill, intituled, "An Act to amend so much of an Act made in the First Year of the Reign of King James the First, intituled, "An Act for the better Execution of the Intent and Meaning of former Statutes made against shooting in Guns, and for the Preservation of the Game of Pheasants and Partridges, and against the destroying of Hares with Hare-Pipes, and tracing Hares in the Snow," as relates to the Preservation of House-Doves and Pigeons, by making the Manner of convicting such Person or Persons as shall offend therein more easy and expeditious."

And the same were read, by the Clerk, as follow:
