His Majesty being seated on the Throne, adorned with His Crown and Regal Ornaments, and attended by His Officers of State, (the Lords being in their Robes), commanded the Gentleman Uther of the Black Rod to let the Commons know, It is His Majestys Pleasure they attend Him immediately in this House.

Who being come, with their Speaker;

He, after a Speech in relation to the Money Bill to be passed, delivered it to the Clerk, who brought it to the Table, where the Deputy Clerk of the Crown read the Title of that and the other Bills to be passed, severally, as follow; (videlicet),

1. An Act for granting an Aid to His Majesty by a Land Tax, to be raised in Great Britain, for the Service of the Year One thousands seven hundred and seventy-six.

To these Bills the Royal Assent was pronounced by the Clerk Assistant, severally, in these Words; (videlicet),

2. An Act for punishing Mutiny and Desertion; and for the better Payment of the Army and their Quarters.

An Act to enable the Right Honourable Robert Craggs Lord Viscounts Clare, and the Right Honourable Wellbore Ellis, to take, in Great Britain, the Oath of Office as Vice Treasurer, and Receiver General, and Paymaster General, of all His Majestys Revenues in the Kingdom of Ireland, and to qualify themselves for the Enjoyment of the said Offices.

5. An Act for naturalizing John Martin Fulhs.

6. An Act for naturalizing Francis Anthony Rou gemont.

7. An Act for naturalizing Anthony Ten Broeke

St. Leonard Shoreditch, Paving, &c. Bill.

A Message was brought from the House of Commons, by Mr. Mackworth and others:

With a Bill, intituled, An Act to amend and render more effectual an Act, made in the Eighth Year of the Reign of His present Majesty, for opening certain Passages, and for paving the Streets and other Places, in the Parish of Saint Leonard Shoreditch, in the County of Middlesex, and for preventing Annoy- anees therein; and for extending the Powers of the said Act to such Part of a Lane called Hog Lane, as lies within the Liberty of Norton Falgate, in the said County; to which they desire the Concurrence of this House.

The said Three Bills were, severally, read the First Time.

Newcastle upon Tyne. &c Road Bill.

The Lord Scarsdale reported from the Lords Committees, to whom the Bill, intituled, An Act to enlarge the Term and Powers of an Act, passed in the Twenty-second Year of the Reign of His late Majesty, intituled, An Act for repairing the Road from the West Cowgate near the Town of Newcastle upon Tyne, through the West End of Kenton, Pont Eland, Higham Dykes, Newham Edge, Belsay Mill, and South Middleton, to the North Side of the River Wanspeck, in the County of Northumberland was committed: That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the lame to the House, without any Amendment.

Chang et Ux. Against Adams.

Upon reading the Petition and Appeal of John Crang and Mary his Wife, complaining of an Order of the Court of Exchequer of the 18th of November last, over-ruling the Petitioners Plea; which Order was not made up and entered till the 2 lst of November last; and praying, That the fame may be reversed, and his said Plea allowed, or that the Appellants may have such other Relief in the Premises, as to this House, in their Lordships great Wisdom, shall seem meet; and that John Adams the Younger, Esquire, may be required to answers the said Appeal:

It is Ordered, That the said John Adamt the Younger, Esquire, may have a Copy of the said Appeal, and do put in his Answer thereunto, in Writing, on or before Monday the 18th Day of this instant December; and Service of this Order upon the Solicitor or Clerk in Court for the said Respondent in the said Court of Exchequer, shall be deemed good Service.

Nissen and Marwdes Nat. Bill.

The Lord Scarsdale reported from the Lords Committees, to whom the Bill, intituled, An Act for naturalizing Nifs Nissen and Christopher Gabriel Mar wde, was committed: That they had considered the said Bill, and examined the Allegations thereof which were found to be true; and that the Committee had gone through the Bill, and directed him to report the fame to the House, without any Amendment.

Hewitt against Elliot et al.

A Petition of Edward Hewitt of London, Merchant, Appellant in a Cause depending in this House, to which David Elliot and others are Respondent, which stands appointed for Hearing, was presented and read; setting forth, ^u That the Court of Session, After pronouncing the Interlocutor of the 17th of February 1775, complained of in the Appeal, having remitted the Cause to the Lord Ordinary, he pronounced an Interlocutor applying the Judgement of the whole Lords in these Words; 28th February 1775, Finds the Defenders liable in Payment to the Pursuers of the said Sum of .1119 Sterling, with. Interest thereof from the 24th Day of August 1772, and till Payment, deducing therefrom .200 paid to William Jameson, and .113, being the Amount of the Bill drawn on Alexander Dove, of Date the 4th June 1772, at Eighty Days Date; and finds the Defenders are also entitled to a Deduction of such Share of Stephenson s Effects falling to their Debts in Proportion with the other Creditors of Stephenson; and therefore praying their Lordships, That he may be at Liberty to add the above Interlocutor to the said Appeal, he amending the Respond ents Copy.

And thereupon the Agents, on both Sides, were called in, and heard at the Bar.

And being withdrawn:

Ordered, That the Petitioner be at Liberty to amend his said Appeal, by adding the said Interlocutor above recited, as desired, he amending the Respondent Copy.

After hearing Counsel this Day upon the Petition and Appeal of Edward Hewitt of London, Merchant, surviving Partner of the Company trading under the Firm of Hewitt and Brockhurst, Merchants in London, complaining of Two Interlocutors of the Lords of Session in Scotland of the 2d of March 1774, and 17th of February 1775; and also of an Interlocutor of the Lord Ordinary there of the 28th of February 1775; and praying, That the same might be reversed, varied, or altered, or that the Appellant might have such other Relief in the Premises, as to this House, in their Lordships great Wisdom, should seem meet; as also upon the Answer of David Elliot and others, Trifles or Assignees of Andrew Stephenson, Merchant in Glasgow, put in to the said Appeal, and due Consideration had of what was offered on either Side in this Cause:

Judgement.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal, in Parliament assembled, That the said Interlocutor of the 2d of March 1774, complained of in the said Appeal, be, and the fame is hereby affirmed: And it is further Ordered and Adjudged, That the said Interlocutors of the 17th and 28th of February 1775, also complained of in the said Appeal, be. and the fame are hereby reversed; and that the Appellants Defence be sustained;

A Petition of Robert Haripole Esquire, Respondent in a Cause depending in this House, to which Nicholas Ward is Appellant, was presented and read; setting forth, That by the Adjournment of Four Causes, and the Withdrawing of Two others which stood before this Cause for hearing, this Appeal now stands Third for hearing in their Lordships Paper; that the Petitioner conceiving that this Cause could not be Heard till After the Recess, is not prepared for the Hearing of the fame on the Day which now Hands appointed by their Lordships for that Purpose; and therefore praying their Lordships, That this Cause. may be adjourned till the First Day for hearing Causes After the Recess.

And thereupon the Agents, on both Sides, were called in and heard at the Bar.

Upon reading the Petition of the Right Honourable Mary Lady Dowager Holland, on Behalf of herself and of the Right Honourable Henry Richard Lord Holland her infant Son, the Right Honourable Lord Digby, and the Honourable Charles James Fox; praying Leave to bring in a Bill for the Purposes in the Petition mentioned:

Duchess of Kingston, Clerk to summon Witnesses on her Trial.

Upon reading the Petition of Philip Meadows Esquire; setting forth; That at the General Quarter Sessions of the Peace held in and for the County of Middlesex at Hickss Hall, on the 9th Day of January last, a Bill of Indiment was found against Elizabeth the Wife of Augusts John Hervey Esquire, (now Earl of Bristol), stiling herself Elizabeth Duchess Dowager of Kingston; that their Lordships have been pleased to cause the said Indictment to be brought up before their Lordships by Certiorari issued for that Purpose; that since the Certiorari was so returned, their Lord ships have been pleased to appoint the Trial of the said Indictment at the Bar of their Lordships House for Monday the 18th of this instant December, that the Petitioner, at whose Instance, in Behalf of himself and of the Lady Frances his Wife, the only Sifter, Heir at Law, and next of Kin of the most Noble Evelyn Pierrepont Duke of Kingston deceased, the said Indictment was prepared, and is now prosecuted, will have Occasion to require the Attendance of many Persons as witnesses on the said Trial; and therefore praying their Lordships, That the Clerk of this Honourable House may be authorized by-their Lordships to issue Summonses for such witnesses to attend at the said Trial, as shall be desired by the Petitioner:

It is Ordered, That the Clerk this House be authorized to summon such witnesses to attend at the said Trial as may be desired by the Petitioner, or by the said Elizabeth, calling herself Duchess Dowager of Kingston.
