After hearing Counsel in Part in the Cause wherein Doctor Stuart Threipland, Physician in Edinburgh, is Appellant, and John Walsh Esquire, and others are Respondents:

It is Ordered That the further Hearing of the said Cause be put off till To-morrow.

E. Harrington sat first in Parliament:

This Day Charles Earl of Harrington sat first in Parliament after the Death of his Father William Earl of Harrington; his Lordship having first at the Table taken the Oaths, and made and subscribed the Declaration, and also taken and subscribed the Oath of Abjuration pursuant to the Statutes.

Pedigree delivered.

Garter King at Arms delivered in at the Table his Lordship's Pedigree pursuant to the Standing Order.

Parker in Custody:

The Gentleman Usher of the Black Rod acquainted the House, "That he had (in pursuance of their Lordships Order of the 16th of February last) attached W. Parker, Printer of The General Advertiser and Morning Intelligencer, Tuesday, December 29th 1778; and had him in safe Custody."

It was moved, "That the Entry in the Journal of the 16th of February last, might be read."

The same was accordingly read by the Clerk.

Sewers Bill.

The Lord Sandys (according to Order) reported the Amendments made by the Committee of the whole House, to the Bill, intituled, "An Act to explain and amend the Laws now in being relating to Sewers."

The said Amendments were read by the Clerk as follow; (videlicet)

Pr. 6. L. 20. After ("Discontinuance") insert ("Provided also, that before the Defendant in any such Suit, Action or Information shall proceed to insist as his Qualification upon the Lands, Tenements or Hereditaments contained in such Notice, it shall be incumbent on him to shew by what Means the Lands, Tenements or Hereditaments specified in his Oath aforesaid, do no longer qualify him to act in the said Commission, the Truth of which, as also of the Particulars specified in the said Oath, it shall and may be lawful to and for the Plaintiff or Informer in such Suit, Action or Information to controvert or disprove")

Pr. 24. L. 25. And the said Amendments being read a Second Time were, severally, agreed to by the House.

Tempest's Bill.

The Lord Viscount Say and Sele reported from the Lords Committees, to whom the Bill, intituled, "An Act for vesting in Trustees and their Heirs, the Settled Estate of John Tempest Esquire, situate in the County of Kent, in Trust to sell the same; and for laying out the Money arising by such Sale, in the Purchase of other Lands and Hereditaments, to be settled in lieu thereof to the same Uses," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Ordered, That the said Bill be engrossed.

Bonnevaux's Naturalization Bill.

The Lord Viscount Say and Sele also reported from the Lords Committees, to whom the Bill, intituled, "An Act for naturalizing Peter Daillé Bonnevaux," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Swaffham. &c. Drainage Bill.

Hodie 2a vice lecta est Billa, intituled, "An Act to explain, amend and render more effectual an Act, passed in the Seventh Year of His present Majesty's Reign, intituled, "An Act for draining and preserving certain Fen Lands and Low Grounds lying in the South Level, Part of the Great Level of the Fens commonly called Bedford Level, and in the County of Cambridge, between the River Cam otherwise Grant, West, and the Hard Lands of Bottisham, Swaffham, Bulbeck and Swaffham Prior, East; and for empowering the Governor, Bailiffs and Commonalty of the Company of Conservators of the Great Level of the Fens commonly called Bedford Level, to sell certain Fen Lands lying within the Limits aforesaid, commonly called Invested Lands."

Lord Osborne's Divorce Bill.

Ordered, That the Second Reading of the Bill, intituled, "An Act to dissolve the Marriage of Francis Osborne Baron Osborne of Kiveton, in the County of York, commonly called Marquis of Carmarthen, with Lady Amelia D'Arcy Baroness Conyers, his now Wife, and to enable him to marry again; and for other Purposes therein mentioned," which stands appointed for this Day, be put off till To-morrow, and the Lords summoned; and that the several Persons who were ordered to attend this Day, do then attend.

Threipland against Walsh at al.

After hearing Counsel as well Yesterday as this Day, upon the Petition and Appeal of Doctor Stuart Threipland, Physician in Edinburgh; complaining of Two Interlocutors of the Lords of Session in Scotland, of the 8th and 24th of July 1778; and praying, "That the same might be reversed, varied or altered, or that the Appellant might have such other Relief in the Premises, as to this House, in their Lordships great Wisdom, should seem meet;" as also upon the Answer of John Walsh, Francis Barlow and Alexander Gerrard Esquires, and the Answer of George Buchan Hepburn Esquire, put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

Interlocutors Reversed.

It is Ordered and Adjudged, by the Lords Spiritual and Temporal in Parliament assembled, That the said Interlocutors complained of in the said Appeal, be, and the same are hereby Reversed; and that the Defenders be assoilzied.

The Earl of Aylesford acquainted the House, "That he and the Lord Cadogan had this Day (pursuant to the Order of the 17th of March last) carried their Lordships Message of Congratulation to Her Majesty on the Birth of a Prince; and that Her Majesty was pleased to return the following Answer:

My Lords,

"I desire you will in the strongest Terms express to the House of Lords, my Thanks for this fresh Mark of their Duty to the King, and Attention to me."

Nicoll's Bill, Petition against.

Upon reading the Petition of Richard Kitson of the City of York, Gentleman, setting forth, "That the Petitioner is informed Application has been made to this House to obtain an Act for Sale of the Estates of the late John Nicoll of Bolton, in the County of York, Esquire, deceased, for the Payment of his Debts: That the Petitioner's Interest will be materially affected by the said Act if the same should pass into a Law, especially as it contains no Indemnity to him as an Executor, nor any Clause or Proviso to prevent his being proceeded against as such, in the ordinary Course of Law; and therefore praying, their Lordships to take the Premises into Consideration, and that the said intended Act, so far as the same concerns the Petitioner's Trust Estate or Interest, may not pass into a Law; and that he may be heard by himself or his Counsel against the same:"

It is Ordered, That the said Petition be referred to the Consideration of the Committee, to whom the Bill stands committed, with Liberty for the Petitioner to be heard by his Counsel against the said Bill before the said Committee, as desired; as also Counsel for the Bill at the same Time, if they think fit.

Ordered, That all the Lords who have been or shall be present this Session be added to the said Committee.

Adultery Discouragement Bill.

The Order of the Day being read for the House to be in a Committee upon the Bill, intituled, "An Act for the more effectual Discouragement of the Crime of Adultery;" and for the Lords to be summoned:

The House was adjourned during Pleasure, and put into a Committee upon the said Bill.

After some Time, the House was resumed:

And the Earl of Abercorn reported from the Committee, "That they had gone through the Bill, and made One Amendment thereto, which he was ready to report when the House will please to receive the same."

E. Shrewsbury's Estate Bill.

The Lord President reported from the Lords Committees, to whom the Bill, intituled, "An Act for establishing an Exchange between George Earl of Shrewsbury and Thomas Gilbert Esquire, of divers Lands and Hereditaments in the County of Stafford; and for the other Purposes therein mentioned," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Ordered, That the said Bill be engrossed.

After hearing Counsel this Day upon the Petition and Appeal of the Reverend Doctor James Fordyce, and others, Assignees to the Tack of the Lands and Estate of Belhelire in Scotland; complaining of Two Interlocutors of the Lords of Session in Scotland, of the 18th and 23d of July 1778; and praying, "That the same might be reversed, varied or altered, or that the Appellants might have such other Relief in the Premises, as to this House, in their Lordships great Wisdom, should seem proper;" as also upon the Answer of John Walsh, Francis Barlow, Alexander Gerrard and Martha Grove, put in to the said Appeal; and due Consideration had of what was offered on either Side in this Cause:

Bridgewater Market House Bill.

A Message was brought from the House of Commons, by Mr. Poulett, and others:

With a Bill, intituled, "An Act for erecting a Market House and regulating the Markets within the Borough of Bridgewater, in the County of Somerset; and for paving, cleansing, lighting and watching the Streets, Lanes and other Public Passages and Places, within the said Borough;" to which they desire the Concurrence of this House.

The said Bill was read the First Time.

Adultery Discouragement Bill.

The Earl of Abercorn (according to Order) reported the Amendment made by the Committee of the whole House, to the Bill, intituled, "An Act for the more effectual Discouragement of the Crime of Adultery."

The Lord Scarsdale reported from the Committee of Privileges appointed to consider of the Petition of Hamilton Flemyng Esquire, to His Majesty, claiming the Title of Earl of Wigtoun, &c. "That the Committee had met, and having heard Counsel in Part for the Petitioner, had directed him to report, That the Counsel for the Petitioner having stated that they could not venture to go on unless the Committee would receive Affidavits, that the Committee had come to the following Resolution:

The Lord Scarsdale reported from the Lords Committees, to whom the Bill, intituled, "An Act to empower certain Persons to enfranchise divers Copyhold and Customary Lands and Tenements, within the several Manors or Lordships of Titchfield, Lee Markes and Mirabel Crofton and Newland, in the County of Southampton; and for other Purposes therein mentioned," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Message from H. C. for E. Harrington to attend.

A Message was brought from the House of Commons, by Mr. Townshend, and others:

To desire, "That this House will give Leave to the Earl of Harrington to come to a Committee of that House on Thursday next, which are appointed to take into Consideration several Papers presented to that House, containing the Correspondence between His Majesty's Ministers and Sir William Howe, to be examined relative to the Subject Matter of several Papers which have been referred to the said Committee, containing the Correspondence between Lord George Germaine and Lieutenant General Burgoyne."

And then the Messengers withdrew.

The Messengers were called in again, and acquainted by the Lord Chancellor, "That the Lords will send an Answer by Messengers of their own."

Bowater's Bill.

The Lord Scarsdale reported from the Lords Committees, to whom the Bill, intituled, "An Act to enable John Bowater Esquire, during his Life, and after his Death, the Guardian or Guardians of his Issue Male, by the Honourable Frances Bowater his Wife, during their respective Infancies, to grant Building Leases of his Settled Estates at Woolwich and Charlton, in the County of Kent," was committed: "That they had considered the said Bill, and examined the Allegations thereof, which were found to be true; that the Parties concerned had given their Consents to the Satisfaction of the Committee; and that the Committee had gone through the Bill, and directed him to report the same to the House, without any Amendment."

Ordered, That the said Bill be engrossed.

Greenwich Hospital Enquiry proceeded in.

The Order of the Day being read for taking into further Consideration the Enquiry into the Management of Greenwich Hospital; and for the Lords to be summoned, and for several Witnesses to attend:

Ordered, That the Hearing of the Cause wherein James Lawson, Merchant in Glasgow, is Appellant, and John Tait, Writer to the Signet, is Respondent, et e contra, which stands appointed for To-morrow, be put off to Friday next; and that the Cause which stands for Friday next be put off to Monday next; and that the rest of the Causes be removed in Course.
