The terms used will be clear from the following description of the legal process involved:—Having entered his plaint or action, the plaintiff proceeds to arrest the defendant on mesne process and hold him to bail. He then serves him with a copy of the Declaration, or formal statement of his demand. The plaintiff then gets the judge to fix a day for the trial and procures a venire facias, or writ to the sheriff's officer bidding a jury (or inquest) come, and, there being a deficiency of attendance, prays a "tales," or supplement from the bystanders. The jury give their verdict, followed by judgment of the court accordingly, and this is registered on the file of proceedings.
