Damages awarded: 20s
Costs: 40s
Case type: Bond

Pleading: Richard Turpyn states that on 27 March 1458 John Peer made a bond with him in London in £20 12s 5d. He acknowledges that JP has paid him 12s 5d of this sum, but JP has not paid the remaining £20, to his damage of 100s. He shows the bond in court.

Pleading: JP states that on the same day, by a schedule of which he presents the part sealed by RT in court, it was agreed between them that if JP should pay this sum of £20 12s 5d according to certain terms, namely that he should pay £7 5s 9d at Michaelmas 1458, £6 13s 4d at Easter 1459, and £6 13s 4d at Michaelmas 1459, then the bond should be cancelled; otherwise it was to remain in force. JP states that he paid the aforesaid £20 to RT according to this agreement.

Pleading: RT, not acknowledging that JP paid any part of this £20 as he has claimed, states that JP did not pay him the £6 13s 4d due at Easter 1459.

Pleading: JP states that he paid RT the £6 13s 4d due at Easter 1459, in the parish of St Martin Ludgate in London. Both parties on country, jury here at quindene of Easter. Pledges named for defendant.

Postea text: RT came, sheriff sent that JP had nothing in his bailiwick. Order to sheriff to take him and have him here at octave of Hilary 1462. Sheriff also sent jury panel, of which nothing. Jury in respite to same term, for default.

Postea text: Process continued, jury in respite to Easter five weeks 1462, nisi prius they come before Robert Danby, CJCP, at St Martin le Grand on 20 May 1462. Damages assigned at 20s, costs at 40s. Order that RT recover debt and damages, JP amerced. RT remits 20s of these damages, of which JP is quit.

Postea text: JP committed to the Fleet prison.

Postea text: Record and process on this case summoned before the king by virtue of a writ of error, directed to RD, dated 20 October 1464.

Pleading: Robert Gille states that on 6 July 1459 William Bartram made a bond with him in £29 2s 4d, but has not paid, to his damage of £10. He shows the bond in court.

Pleading: WB states that he ought not owe this debt, as at the time of this bond he was a lay man and of little learning, and that there was an agreement between him and RG that he would make, seal and deliver to RG a certain bond in £29 2s 4d, under a certain condition, namely that if a certain William Goodyng should pay this sum to RG, then the bond would be cancelled. He states that the bond presented in court was read to him as containing this condition, and he, believing this, sealed it and delivered it to RG. Therefore this simple bond, not containing this condition, is not of his making. Parties on country, jury here at quindene of Easter.

Postea text: Before this date, the plea remained without day, as Edward IV removed Henry VI from power. In Trinity term 1461, William [recte Robert] Gille sought a writ to the sheriff of London to re-summon WB, and to have jury here. This was granted, returnable at the quindene of Michaelmas.

Writ type: Detinue
Damages claimed: £1000
Case type: Detention of goods; Safe keeping

Pleading: John Doreward states that on 27 April 1459, at Bocking, he delivered to a certain William Doreward and Richard Doreward for safe-keeping a sealed chest containing charters and muniments, namely one charter which recorded that he had granted to WD and RD the manor of Leaden Roding in Essex, and other charters and muniments relating to that manor. This chest was to be returned to him on request, and WD and RD therefore had possession. Afterwards, on 30 April 1459, in the parish of St John Zachary in London, they lost this chest, and it came into the possession of Roger Marchall. JD has since requested its return, but RM has refused, to his damage of £1000.

Pleading: RM presents the chest in court, to be delivered to John Plommer of John Doreward senior, as the court decides. He states that this chest is the same chest as both plaintiffs seek from him, but he does not know which of them ought to receive it, and asks that the two plaintiffs speak together to decide. This is granted, and the court says to JD that first response should go to JP, as he had the first writ.

Pleading: JD granted licence to imparl to Easter three weeks, with assent of JP. Same day given to JP and RM.

Case notes: Pleading follows re-enrolment of a plea from Michaelmas 1460, rot 429d, on same case by different plaintiff, John Plommer. Defendant's response relates to both original pleas.

Pleading: John Everdon, cofferer of the king's household, states that on 14 March 1457 William Ottewey made a bond with him and a certain Thomas Salvayne in London in £7 13s 4d, payable on 16 March 1459. However, he has not paid, to their damage of £20. He shows the bond in court.

Pleading: WO states that JE ought not maintain his action, as TS and his wife Margaret, by a document which he shows in court, dated 11 March 1457 and delivered to him at Gamlingay on 12 March 1459, released and quitclaimed him from all actions, suits, etc, both real and personal, outstanding between them [release recited in full, in Latin].

Pleading: JE, not acknowledging anything alleged by WO, states that this plea of WO is not sufficient in law to preclude his action, and seeks judgment, and the debt and damages.

Pleading: WO states that since his plea was sufficient, he seeks judgment and that JE is precluded from his action. Since the justices wish to be advised before rendering judgment, day is given at the quindene of Easter.

Postea text: Plea remained without day, as Edward IV removed Henry VI from power. In Trinity term 1461 JE came by attorney and sought a writ to the sheriff of London to re-summon WO to hear the judgment, and this was granted, returnable at Michaelmas one month 1461.

Postea text: JE came, WO did not come, sheriff said that he had nothing. Sheriff to take for octave of Hilary 1462. Various posteas (all saying that the parties both appeared, but that the sheriff sent that WO was not found?), to quindene of Easter 1463.

Postea text: JE came by attorney, and since it seems to the justices that the pleading made by WO is not sufficient to preclude JE from his action, he seeks judgment, and his debt and damages. Order that JE recover his debt, and damages assigned at 26s 8d, WO amerced.

Postea text: JE acknowledged satisfaction of the debt and damages. WO quit.
