Pleading: Thomas Gay senior and Thomas Gay junior state that on 9 February 1448 William Bruges made bond with them in £46, payable at Easter next. They acknowledge satisfaction of £26 of this, but WB has not paid the remaining £20, to their damage of £20. They show the bond in court.

Pleading: WB states that the plaintiffs ought not maintain their actions, as by a release which he shows in court, dated at Ashbury in Berkshire on 4 April 1449, the plaintiffs released an quitclaimed to WB all actions outstanding between them, both real and personal, by reason of any debt, trespass, contract or demand before that date.

Pleading: The plaintiffs state that this release was not made of them. Enquiry by country, sheriff of Berkshire to have jury of Ashbury here at octave of Hilary. Pledges named for defendant.

Pleading: William Miller states that on 10 April 1449 John Skele of Shoreditch forcibly assaulted him in London, and imprisoned him for two days, badly treating him until he made a fine of 40s for his delivery. This was against the peace and to his damage of £20.

Pleading: John Skele of London, poulterer, comes and states that he is the same man as the JS of Shoreditch against whom WM brought the case. He states that on the day of the original writ he was living in London, in the parish of St Botolph without Bishopsgate, and not in Shoreditch as the writ supposed. He cites the terms of the Statute of Additions, and seeks judgment on the writ.

Pleading: WM states that on the day of his original writ, namely [omitted], JS was living in Shoreditch, as the writ supposed. Enquiry by country, sheriff of Middlesex to have jury here at octave of [lost, presumably Hilary]. Pledges named.

Pleading: John Kyng, clerk, brother and co-executor of John Kyng, tailor, Thomas Davy, co-executor, John Morley, former servant of JK tailor, and co-executor, and Richard Nedam and his wife Alice, former wife and co-executor of JK tailor, state that on 2 March 1431 Henry Inglose retained JK tailor, to work on three gowns for his wife, namely one of blue velvet upon satin, another of black of lyre, and the third coloured green lined with buckram, all for 14s 2d, payable on request. Also, on the same day, he borrowed a further 25s 10d, also payable on request, but he did not re-pay either debt, either to the testator or his executors, to their damage of 40s.

Pleading: HI states that he does not detain this 40s or any money from the executors as they claim. Parties on country, jury here at octave of Hilary.

Pleading: John Neell, master of the house of St Thomas of Acon in London, states that on 14 July 1446 John Asshewell made bond with him and his fellow brothers in £100, but has not paid, to their damage of £40. He shows the bond in court.

Pleading: JA granted licence to imparl to the morrow of the Purification, with assent of JN.

Pleading: [continued at Easter 1450, rot 137] JA states that JN ought not maintain his action, as by an indenture, of which he shows the part sealed by JN in court, dated 14 July 1446, JN and his fellow brothers appointed him as their proctor within the diocese of Norwich, conducting all business and taking all profits, to hold from the date of the appointment to All Saints 1446, and from then for 5 years. He was to render account at their house in London, and to render to them £200 for the whole term. For this JA entered into this bond for £100, and also he and William Allard and William Blake made another bond of £200 to the master and brothers. For this, the master and brothers granted that if JA rendered a good and faithful account as required, and made the necessary payments, and returned all the papers and letters at the end of the term, and if JA and his substitutes serve the house well and suffer no scandal to the dishonour of the house, then the bond shall be cancelled; otherwise it shall remain in force. [Further terms of the office also specified.] JA held the office on these terms, rendering account and paying the £40 annually in London, according to the form of the agreement, until Michaelmas last, when he was removed from his post by the master. The profits of the office before that date did not amount to £40. He says that he and his substitutes served the master and brothers well and honestly, causing them no damage or scandal, according to the terms of the agreement.

Pleading: JN, protesting that he and the brothers did not disturb JA and his substitutes from the dues of this office, nor that he was expelled from the office, states that 10m of the £20 which ought to have been paid at the feast of St Peter ad Vincula last are in arrears and not paid.

Pleading: Richard Horton states that on 7 September [1448] Thomas Holm made bond with him in 100s, payable at Michaelmas next, but has not paid, to his damage of [lost]. He shows the bond in court.

Pleading: TH seeks to hear the text of the bond and the endorsement, and these are read in court. The condition of the bond is such that if TH submit to the arbitration of Thomas George and Richard Waleys, arbiters, concerning all outstanding actions between him and RH, provided that these arbiters make their judgment by 23 September [1448], and if not that he stand in the arbitration of John Rympyngdon, provided that this is made by 6 October following, then the bond shall be cancelled. He then states that he ought not be bound to this bond, as TG and RW accepted this arbitration at Leatherhead on 22 September [1448], and they stated that RH had suffered damage through various trespasses outstanding between them, and ordained that TH should pay RH 26s 8d in satisfaction of all offences committed before Michaelmas 1448. He states that he paid this 26s 8d to RH on the said 22 September, according to the form and effect of the arbitration.

Pleading: RH, not acknowledging anything said by TH, stated that the arbiters accepted the burden of arbitration on the said 22 September 1448 at Leatherhead, but that they ordained that TH was to pay RH all the arrears of a farm of a certain tenement called 'Frydles' in Mickleham, which TH formerly held by a demise from John Wydwysson, to Michaelmas 1448, this being 26s 8d, along with all other outstanding dues up to Christmas 1448. They did not just ordain that TH should pay 26s 8d in full recompense of all outstanding actions, as TH has claimed.

Pleading: TH repeats that the arbiters ordained that he should pay 26s 8d in full satisfaction of all actions, as he claimed. Parties on country, sheriff of Surrey to have jury here at octave of Hilary.

Pleading: John Penne came into court on 10 November this term (1449), and presented the following bill. JP presents against John Thornton, one of the attorneys of the Bench, on a plea that he render to him £13 10s which he owes and unjustly detains. He states that on 18 [February] 1446 JT made three bonds with him, each in [£4] 10s, payable at Easter [1447?], Christmas 1447 and 24 June 1448. However, he has not paid these bonds, to his damage of 20m. He shows the bonds in court.

Pleading: JT states that he should not be bound to these debts, as at this time he was imprisoned by JP and his associates in the parish of St Sepulchre, London, and detained there until he made these bonds under duress.

Pleading: JP denies this, stating that at the time of the bonds JN was not imprisoned, and made the bonds freely and not under any duress. Enquiry by country, jury here at octave of Hilary.

Postea text: Jury placed in respite to quindene of Easter, nisi prius they come before John Prysot, CJCP, at St Martin le Grand on 23 February 1450. On this day, JP came, Prysot sent record that on that day, before him and John Felylod, JP came, JT did not come, in default. Jury came, said that JT was not imprisoned at the time of the bonds, and made them freely and not under duress. Damages assigned at 13s 4d, costs at 33s 4d. Order that JP recover debt and damages. JT amerced.

WW stayed for two weeks and the four men for 10 weeks. Also, on the same day WW hired three horses from him, paying him 12d per day, and he hired them for [lost] days. However, WW has not paid any of these sums, amounting to 60s, to his damage of 10m. [The figures do not appear to add up.]

Pleading: WW states that he does not owe this 60s or any money to RH as claimed. Order that he wager his law at octave of Hilary. Pledges for law named.

Pleading: John Berowe and his wife Agnes, the executor of Philip Fysshwyke, state that on 20 November 1433 PF the testator delivered to William Brampton in Westminster two documents and a chest containing various muniments for safe-keeping, to be returned on request. One of the documents stated that PF was bound to Nicholas Halle, William atte Water and Robert Hoogh in £100, and the other that he was bound to the same people in another 100m. However, WB did not return these to PF, nor to AB, executor of PF, either before or after her marriage to JB, and still refuses, to their damage of £40. They show in court the testamentary letters of PF, by which AB has executry and administration.

Pleading: WB presents the documents and chest in court, to be delivered as the court orders. And he states that the documents and chest were delivered to him on that day jointly by PF and NH, WW and RH under certain conditions, to be returned to one or more of them under those conditions. However, he does not know whether these conditions have been fulfilled on the part of the other three people, and asks that they be summoned. Order to the sheriff to warn these people to be here at the [morrow?] of Martinmas, to show any reason why the documents and chest should not be returned to JB and AB.

Pleading: Thomas Brampton states that on 10 February 1447 he delivered to John Devenissh in Southwark for safe-keeping a certain bond in which it was contained that TB was bound to Henry, Duke of Warwick, now deceased, in 1000m, and also a release in which it was stated that TB quitclaimed to Thomas Send, vicar of Burford, all outstanding real and personal actions between them. These were to be returned to TB on request, but JD has not done so, to his damage of £1000.

Pleading: JD presents the documents in court, to be delivered as the court orders. And he states that the two documents were delivered to him on that day jointly by TB and the duke and TS respectively, under certain conditions, to be returned to either of them under those conditions. However, he does not know whether these conditions have been fulfilled on the part of the duke or TS. He states that the duke died intestate, and asks that master John Botryght, William Menston and Thomas Colt, to whom administration of the duke's goods was granted by the Archbishop of Canterbury at Lambeth, and also TS, be warned to be here. This was against the peace, and to his damage of 20m.

WT, denies force and arms and everything except the imprisonment; he and WC on country. And regarding the imprisonment, he states that WC ought not maintain his action, as on 31 March, before the alleged imprisonment, in the king's court in London before William Cantelowe and William Marowe, sheriffs of London, he brought a suit against WC on plea of trespass, with John Colman and Richard Strete as his pledges, concerning which the sheriffs ordered their servant, Richard Dee, to attach WC and have him before them on the said 31 March to answer the plea. By virtue of this order, Dee arrested WC on 31 March and brought him before the court. This is the same imprisonment referred to in the plea.

Pleading: WC states that there is no such record before the former sheriffs regarding this plea, process and arrest.

Pleading: Walter Speryng, by attorney [name omitted, given as Thomas Lambard in subsequent mesne process] states that by a certain indenture between himself, John Sergeaunt and William Dale, both of Earl Soham in Suffolk, which he shows in court, dated 27 October 1441, he sold three new and complete bells to them, of which the largest weighed 1400 pounds and the other two […] which he undertook to deliver to the purchasers at Ipswich before the feast of the conception of the virgin Mary next (8 December 1441). He guaranteed the bells for a year and a day after that delivery date, and that JS and WD would pay him 26s 8d per hundredweight for these bells, of which £10 would be paid on delivery in Ipswich. JS and WD agreed by this to deliver to WS, on the same day, two old bells in part payment of these new bells, at 21s 8d per hundredweight, and to pay the remaining amount on 9 December 1442. And if any of the new bells should break with the year and a day, or be otherwise defective, WS agreed to replace it at his own cost. In fulfilment of this contract WS made a bond of £100, and JS and WD similarly bound themselves in £100 to make payment as agreed. [Pleading incomplete, ends here.]

Pleading: Philip Leweston states that on 4 April 1436 Walter Langley, together with Ivo Etton, now deceased, retained him in the Great Hall at Westminster to be the attorney of WL and his wife Isabel and IE and his wife Joan, against Thomas Mulso regarding a writ of scire facias brought against them as tenants of the manor of Potcote in Northamptonshire. For this he was to take 40d for each term the case continued, and the costs for writs and other documents and services. PL served as attorney for nine terms, for which the fees amounted to 30s, and he is owed a further 74s 9d for the documents and services. However, WL has not paid, to his damage of 10m.

Postea text: Process continued, jury in respite to morrow of All Souls 1450, nisi prius they come before John Prysot, CJCP, at St Martin le Grand on 27 October 1450. On this day, JG came, justices sent record that on that day, before JP and John Fylylode, JG came, EM did not come, in default. Jury in respite to octave of Martinmas, as did not come.

Postea text: Process continued, jury in respite to octave of Hilary 1451, nisi prius they come before John Prysot, CJCP, at St Martin le Grand on 10 December 1450. On this day, JG came, justices sent record that on that day, before JP and JF, JG came, jury came, said that the bond was made of EM, but that EM did not owe JG the other £10, as claimed. Damages assigned at 13s 4d, costs at 26s 8d. Order that EM recover the debt of £22 2d, and damages, EM to be taken. JG amerced for false claim on the £10, EM quit.
