RB paid WN 69s 10d of this sum, but he has not paid the remaining £10, either to RN during his lifetime or to the plaintiffs after RN's death, to their damage of 100s. They show the bond in court, and the testamentary letters of RN, by which they are executors and have administration.

Pleading: HP states that this release was sealed and delivered to JB on 5 November 1456, the date given in the document, and was not first delivered to JB after the making of the bond, as JB has claimed.

Pleading: Margaret Hatter states that on 1 June 1457, in the parish of St Mary le Strand in Middlesex, Thomas Freke, now deceased, accounted with her before Thomas Frelond and William Halle, auditors, concerning various sums of money of MH received on account by TF before that time, and on this account was found to be in arrears to her in £22. However, TF did not pay this during his lifetime, and nor has Henry Freke, his executor after his death, to her damage of £10.

Pleading: HF states that MH ought not maintain her action, as long before the date of her original writ, he had fully administered all the goods and chattels formerly of TF, and had nothing then or afterwards in his hands.

Pleading: MH states that on the day of her original writ, namely 8 September 1463, HF had various goods and chattels formerly of TF still in his hands and not administered by which she could have been satisfied, namely in the parish of St Mary le Strand. Pleading: Oliver Tregasowe and John Tregasowe state that on 28 August 1462, at Lostwithiel, John Dogowe, now deceased, made a bond with them in £80, payable at St Bartholomew then next. However, John D has not paid, and nor have the defendants, John Kendall, Roger Chatwyke, Thomas Tomyowe, Robert Whyte and William Boughton, executors of JD together with Margaret, widow and co-executor of John D, to their damage of 100m. They show the bond in court.

Pleading: WB in person and JK, RC, TT and RW in person defend force and injury. WB states that he is called William Bukton, and has always been known as Bukton and not as William Boughton or Bouton, and seeks judgment on the writ. The others state that OT and JT ought not have their action, as they were never executors of the will of John D, and never administered any goods formerly of John D on the date of his death.

Pleading: OT and JT state that their writ ought not cease. They say that WB is and was always known both as William Boughton or Bouton and as Bukton, and they seek enquiry by the country. They also say that the other did administer various goods and chattels formerly of JD, namely at Lostwithiel. Enquiry by country. Justices wish to be advised before issuing writs of venire facias, so day is given at Michaelmas three weeks.

Damages assigned to TP at 6s 8d, costs at 26s 8d. Order that TP recover debt and damages, and a further 6s 8d costs assigned by the court, to a total of 40s. JH amerced.

Pleading: William Michell and John Wylde state that on 3 March 1464, in London, Richard Thornton made a bond with them in £12 11s, payable at Lady Day then next, but has not paid, to their damage of 100s. They show the bond in court.

Pleading: RT seeks to hear the bond and the conditions, and these are read out in court. The condition of this bond is such that if the within-named RT and Thomas [sic] should pay to WM and JW or either of them 20s at the said feast, 20s at the Nativity of St John the Baptist then next, 20s at Michaelmas, 20s at Christmas, and so on year by year until £8 is fully paid, then the bond shall be cancelled, otherwise it shall remain in force. Having heard this, RT states that he ought not owe this debt, since he paid WM and JW the 20s payments due at Lady Day 1464, St John the Baptist 1464, Michaelmas 1464, Christmas 1464 and Lady Day 1465 according to the terms of the agreement, namely at Southwark, and there were no other payments due between the making of the bond and the date of the plaintiffs' original writ.

Pleading: WM and JW, protesting that RL did not keep to the payment dates specified, state that RL did not pay the 20s due at Christmas 1464, according to the terms of the condition.

Pleading: RL states that he did pay the 20s due at Christmas 1464, as he claimed. Parties on country, sheriff of Surrey to have jury of Southwark here at quindene of Michaelmas.

On this day, WB came by attorney, RD sent record that on that day, before RD and Thomas Danby, parties came by attorney, jury said that WB did owe EM 40s, as claimed by EM (sic, names clearly transposed in error). Damages assigned to WB at 6s 8d, costs at 20s. Order that WB recover debt and damages. WB amerced (sic, error for EM).

Postea text: Process continued, jury in respite to octave of Trinity 1470, from when they were placed in respite to the octave of Michaelmas, before when the pleading remained without day, as Henry VI recovered the crown from Edward IV. On 21 November 1470 JA came into court by attorney and sought a writ to the sheriff of London to re-summon LR, and a writ to the sheriff of Essex to summon the jurors. These were granted, returnable at the morrow of the Purification 1471.

Pleading: Richard Sherde, administrator of the goods and chattels formerly of Roger Werburgh, kinsman and executor of John Standelf, states that on 14 November 1417, in London, John Collee, now deceased, made a bond with John Standelf in £20, payable at Pentecost then next. However, neither John Collee nor his executors, Alice Collee (the defendant) and John Bythunm, have paid this £20, not to JS himself, or to RW, executor of JS, or to RS the plaintiff, to whom administration of the goods formerly of RW was granted by Roger Radclyff, dean of St Mary le Bow in the jurisdiction of the church of Christchurch, Canterbury, to his damage of 20m. He shows the bond in court, together with the testamentary letters of JS, by which RW was executor and had administration, and the letters of administration of RR, by which he has administration of the goods of RW.

Pleading: AC, protesting that the bond is not of the making of John Collee, states that RS ought not maintain his action regarding £19 18s of this sum, as on the day of RS's original writ, and long before, she had fully administered all the goods formerly of JC except one chest worth 2s, and had nothing else in her hands.

Pleading: RS states that, concerning the 2s aforesaid, since AC acknowledges that she had this chest, he seeks judgment and the 2s with damages. Order that RS recover these 2s, to be levied from the goods of JC still in her hands. AC amerced. Concerning the remaining £19 18s, RS states that on the day of his original writ, namely 24 March 1464, AC had various goods and chattels in her hands formerly of JC sufficient to pay this debt and not administered beyond the said chest, namely in the parish of St Vedast in the ward of Farringdon Within, and she could have paid had she wished. Pleading: Nicholas Baylly amerced for many defaults. NB, Thomas Passenchaunt and John Whyte were attached to answer William Babyngton on plea that they forcibly abducted William Dylcok, a prisoner in their custody. William Babyngton states that John Makworth, William Cheyne, William Babyngton, Peter de la Pole and William Fynderne were seised of a messuage and garden with appurtenances within the close of the Fleet in the parish of St Bride in London, pertaining to them as keepers of all the prisoners committed to the king's prison of the Fleet. Thus seised, by a charter which WB shows in court, dated 7 July 1434, having obtained licence from the king, they granted and demised this property and the office, together with all fees, profits and all other things pertaining to the office to William Venour and his wife Elizabeth, daughter and heir of Roger Sapurton, brother of John Sapurton, to hold to them and the heirs of their bodies in perpetuity. If they should die without heirs, then the property and office should remain to the heirs of Elizabeth's body, and then to Robert Babyngton, father of the plaintiff, who's heir he is, as kinsman of Roger Sapurton, and the heirs of his body. WV and EV were thus seised of this property and office as of fee tail. RB later had issue WB, the plaintiff, and later died, and thus the remainder descended to WB. WV then died without issue by EV, and EV survived and had possession alone as of fee tail. According to the statute passed in Parliament in 6 Richard II [Stat. Realm, 6 Ric II, c. 6], should any woman, after being ravished, then consent to this , both she and the ravisher should be disinherited, and all inheritances should pass to their next heirs, and WB therefore states that after the death of WV, a certain Robert Worth, at Edmonton on 5 October 1462, after the death of RB, feloniously seized EV and afterwards, namely on the following Tuesday (12 October 1462), at Westminster, he 'carnally knew' EV with her consent, by which she hence consented voluntarily to the seizure. Since she has no heirs of her body, by the terms of the statute WB therefore claimed the office and property as next kinsman of EV, namely as son of Robert B, son of Margery, daughter of Agnes, sister of Elizabeth, mother of Roger, father of EV, and on 16 November 1463 he entered into the property according to the terms of the statute, and was seised as of fee tail by virtue of the demise and the statute. As keeper of the prison he took possession of a certain William Dilcok, then a prisoner in the Fleet, who had been committed to the prison on 1 May 1460 by John Prisot and his fellow justices of the Bench at Westminster to stay there until he had satisfied a certain Thomas Radclyff of £24, assigned to TR as damages in a case of trespass committed on TR by WD, and had made fine with the king for that trespass. EV had remained keeper of the prison until the said 16 November 1463, and on that day he had taken WD to Westminster, when the defendants took and abducted WD from his custody, against the peace and to his damage of £300.

Pleading: William Hyot, citing the statute made at Westminster against the maintenance of suits, states that on 13 February 1463, at Netteswell, John Thornekyn unlawfully maintained and sustained the suit of one William Atkynson, against whom WH had brought a case in Common Pleas that WA render to him two documents which he unjustly detained. This was in contempt of the king, against the form of the statute and to his damage of £100.

Pleading: JT states that WH ought not have his action, since long before the date of the original writ for the detention suit which WH supposes JH to have maintained, namely 3 December 1462, at the church of St Paul's in London, in the ward of Farringdon Within (sic), there was an agreement between WA, then parson of Coberley in the diocese of Worcester, and WH, then parson of Netteswell in London diocese, that before the feast of the Purification then next (2 February 1463) they should swap their respective rectories. Before that date, WA should deliver to JT in London a presentation to the church of Coberley, in the name of Giles Brugges, patron of the church, for JT to deliver to WH; WH would also deliver to JT a presentation to the church of Netteswell, in the name of the abbot of Waltham, patron of that church, for delivery to WA. As security that each would implement his part of this agreement, WA and WH each bound themselves in one of the two documents allegedly detained. These were to be delivered to JT for safe-keeping, on the condition that if either should not fulfil his part of the agreement, then both would be delivered to the one who had implemented their part, and if both should fulfil their parts, then each should be returned to each person respectively. JT states that WA and WH both requested that if any actions should ensue between them in London, Westminster or elsewhere in Middlesex concerning the delivery of these bonds or the presentations, then JT should state to whom the documents should pertain, and thus JT had possession of the documents until the original writ of detinue brought against him by WA, and until JT appeared in this court and sought a writ of venire facias to WH. Further, JT says that before the said feast of the Purification WA delivered to him, at St Paul's, full presentation to the church of Coberley as agreed, to be delivered to WH if he delivered the presentation to Netteswell, but that WH did not deliver the presentation to Netteswell before that date as agreed. Therefore WA brought the writ of detinue against JT for delivery of the bonds, and while that writ was pending and after the aforesaid writ of venire facias was granted, JT, WH and WA all agreed to enter arbitration in the church of St Paul's, in the parish of St Faith in Farringdon Within ward in London, before John Lambe and Walter Langryche, arbiters. These arbiters, at the time of the alleged maintenance, at St Paul's, asked and required JT to say to whom the bonds ought to pertain and be delivered, and JT told them that WH had not implemented the agreement, and that the bonds should be delivered to WA and not WH. He is therefore not guilty of any maintenance, as claimed by WH.

Postea text: Process continued, jury in respite to octave of Hilary 1466, nisi prius they come before Peter Ardern, JCP, at Harlow on 9 January 1466. They say that they were seised of this property in their demesne as of fee, taking the issues, etc.

Pleading: EA and KA defend their right, and call to warrant Robert Spaldyng, who is present in court. And he freely warrants the messuages to them. The plaintiffs therefore seek the messuages against RS, saying that they were seised of them in their demesne as of fee.

Pleading: RS defends his right, and is granted licence to imparl. Afterwards, plaintiffs return to this court in this same term by their attorney. RS did not return, but is in default. Order that WR, RG and WC recover their seisin against EA and KA of these messuages, and that EA and KA have the value from the lands of RS. RS amerced.

Pleading: Robert, provost of King's College, Cambridge, and the scholars of that college, amerced for many defaults. Henry Jordon states that on 18 November 1445, in London, a certain William Milyngton, former provost of King's College, Cambridge, predecessor of the defendant, and the scholars of the college, by their factor and servant John Langton, bought from him for the use of their college five large new bells and one small bell called a 'sanctus bell' for £214 5s 10d. These bells came to the use of the college, and HJ acknowledges that WM satisfied him of £125 10s 2d. However, WM was later removed as provost, and Robert was elected and became provost, but neither WM, nor the current provost, nor any of his predecessors have paid him the remaining £88 15s 8d, to his damage of £100.

Pleading: The current provost and scholars are granted licence to imparl to octave of Michaelmas.

Pleading: Joan Mille states that on 25 November 1461, in London, she delivered to William Logeman for safe-keeping a certain sealed chest containing a document, to be returned to her on request. However, WL has refused to return it, to her damage of £10.

Pleading: WL presents the chest in court, to be delivered as the court orders. He states that the chest was delivered to him jointly by both JM and a certain Robert Mille under certain conditions, to be returned to either of them under those conditions. However, he does not know whether these conditions have been fulfilled on the part of RM, and asks that he be forewarned. This is granted, and order to the sheriff to warn RM to be here at the quindene of Michaelmas to show any reason why the chest should not be delivered to JM.

Pleading: [continued on CP 40/818, rot 477] [Earlier pleading repeated in full] On this day (octave of Hilary 1466) JM and WL came by attorney, and RM by attorney Hever. Sheriff sent that he had warned RM to be here by Couper and Gooday. Joan M seeks the chest from RM. RM states that livery of the chest pertains to him and not Joan M, since the chest was sealed and delivered to WL, on the day given, at Croydon in Surrey by both RM and Joan M, under the conditions that if Joan M should, by sufficient documents, before the feast of All Saints then next, release to RM and his heirs all rights in a messuage with appurtenances in Croydon, and after this RM should grant to Joan M an annual rent of 6s 8d for the term of her life in the said messuage, then the chest should be delivered to RM, but if either did not fulfil their part of this agreement, then the chest should be delivered to Joan. Joan did not release all her right in the property to RM by the said feast, and thus delivery of the chest should pertain to him and not Joan [sic].

Pleading: Joan states that delivery should pertain to her and not RM, since the chest was delivered to WL under the condition that if RM should pay to Joan 6s 8d per year for her life, beginning at Christmas [roll damaged], and if RM should default in payment then the chest should be delivered to Joan. Joan states that RM defaulted in this payment at all the said feasts, namely in 2 Edward IV and 3 Edward IV, and therefore delivery of the chest pertains to her, with damages.

Pleading: RM repeats that the chest was delivered to WL under the conditions he has given. Parties on country, jury here at quindene of Easter 1466.

Pleading: Thomas Grene was attached by his body to answer Elizabeth Venour, warden of the Fleet Prison, by virtue of the liberties and privileges of the court, concerning a trespass committed against her by TG and John Longe. EV states that on 18 June 1465, in London, TG, together with JL, forcibly broke into her house in the parish of St Mary Somerset, and took and carried off goods and chattels worth 100m, namely three large lead vessels called 'dyers ledes', three large wooden vessels called dyers' vats, and 800lb of lead. This was against the king's peace and to her damage of £100.

Pleading: TG granted licence to imparl to octave of Michaelmas, with assent of EV. Pledges named for defendant. EV places Simon Elryngton in her place.

Pleading: [continued at Trinity 1466, rot 486d] TG denies force and arms and acting against the peace as claimed by EV. Parties on country. And concerning the rest, he states that EV ought not have her action, as long before the alleged trespass the goods and chattels concerned belonged to a certain John Heydon, and before the alleged trespass, in St Mary Somerset, Queenhithe ward, London, JH demised the goods to the custody of EV, to his own use. Afterwards, but before the alleged trespass, JH sold the goods to TG for £20, which TG paid to JH, and thus at the time of the alleged trespass, TG entered the said house (the door being open) and took the goods as seemed right.

Pleading: EV states that the goods belonged to her at the time of the trespass, and before, and not to JH as claimed by TG.

Pleading: TG repeats that the goods had belonged to JH. Parties on country, jury here at quindene of Michaelmas. Same pledges named for defendant.
