May 23. Westminster.

Commission to Robert de Kendale, constable of the castle of Dover and warden of the Cinque Ports, and to Roger Sauvage, and Robert de Shirelond. Whereas lately on account of the unusual scarcity of corn and other victuals in the realm and the famine oppressing the people thereof, the king took into his protection and safe-conduct merchants of Spain, Sicily and Genoa coming within his realm with corn and victuals, he now understands that certain persons have, notwithstanding the protection and safe-conduct, taken a great ship, called a Dromond. This ship had been laden with wheat and other corn by merchants of Genoa and brought by them to the port of Sandwich, where, after that part of the corn was discharged and sold to mer chants of the king's realm, the said malefactors carried her off with the remainder, but the ship having been driven back to Sandwich by contrary winds, many of them were taken out of her and delivered into the prison of Sandwich, in which they are still detained. The king considering that by such a deed other merchants from foreign parts coming under his safe-conduct with corn and victuals, through fear of attack, would withdraw themselves and their wares from the realm, directs the commissioners to enquire, by oath, as well of merchants as of good and lawful men whom they shall find within the said ports, touching the truth of the matter and into whose hands the wheat and other corn sold in the town of Sandwich has fallen, and all other matters touching the business, and with the aid of the barons and good men of the said ports they are to provide for the security of merchants coming into the realm, under the king's protection, with corn and victuals. Commission to William de Bourne and John de Westcote, to make an extent upon oath of good men of the county of Dorset, of the lands, fees and advowsons of churches held by Stephen de Baiocis at the date of his death, and which have since been alienated, and in whose hands the same are. Matilda Rabayn claimed by petition exhibited before the king and Council in Parliament that the barony of Baiocis was of her right and inheritance, whereupon the king ordered Roger le Brabanzon and his fellows, justices of the King's Bench, to examine a record and process touching the matter formerly before the late king and then in the custody of the said Roger, and also the pleas of the said Matilda, and because the said Roger and his associates have for certain causes been superseded in the matter, the king has caused the said record and process, which the said Roger had delivered before the king and Council in the last Parliament at Lincoln, to be examined before the Council, by which it appeared that judgment was rendered before the late king of the said barony, whereof Stephen de Baiocis was seised in his demesne as of fee at the date of his death, viz. that a moiety of the barony should remain to the late king and his heirs and the other moiety to the said Matilda, wherefore upon the petition of the said Matilda, exhibited before the king and Council in the said Parliament at Lincoln, it was answered that she should sue before the king to have the moiety of the said inheritance so adjudged to her according to the form of the said judgment, if it should seem good to her. Commission of oyer and terminer to William de Bereford, Thomas Danvers and John Bardolf, on complaint by the abbot of Abyndon that, whereas he is lord of the town of Abyndon and has a market and other liberties there of the grant of former kings and the hundred of Hornemere with view of frank-pledge and other things belonging to the hundred, from which he receives profits, Richard de Shupene, Thomas Cok, Richard Bisshop, John de Colecote, Robert Person, Robert Ballok, John Goneys, Maynard de Lamburne, John Coles, John de Asshedene, John de Mackeney, John de Byleby, William de Cotesford, Stephen de Corneville, John le Peyntour of Mersham, John son of Adam le Peyntour, John de Dounton, John de Denton, John le Bolter, Robert de Hampstede, Robert de Newenham, Thomas de Bloxham, Robert de Goseye, John le Mareschal of London, John Netpayn, Thomas Sampson, John de Staunton the elder, Robert le Goldsmyth, William le Bowyere, William de Wutenham, John de Henele, William le Wisshele, Henry le Daubour, John Ledbeter, Robert de Charneye, John de Wermenistre and others, having conspired together at Abyndon, co. Berks, to harass the abbot and interfere with him in his liberties, prevented him from receiving the stallage and other profits of the market belonging to him by taking them for their own uses, and did not permit the decenners of the town, who in the said hundred ought to present certain articles and in like manner in the said view articles belonging to such view, to come to the hundred or view to make such presentments as hitherto they have been accustomed to make, but such articles, which by the decenners ought to be presented in the hundred and view, they have in derision caused to be written in a bill and sent to the bailiffs of the abbot, who hold that hundred and view, and when those malefactors who are suitors of that hundred were spoken to by the bailiffs of the mode of that presentment so made by the bill, maliciously declared that the presentment was good, and frequently rescued distraints taken for amercements and other causes by judgment of the Court of the abbot by his bailiffs, forced men coming for their corn to the abbot's mills to withdraw, and permitted thieves attached by the bailiffs in the town and hundred according to the liberty of 'infangenethef' and 'utfangenethef,' which the abbot has, and delivered into the custody of the decenners, as was the custom, until they should be delivered in due manner, or if they could not be delivered according to the said liberty to be taken by the decenners to the gaol of Wyndesore, to depart, not permitting them to be placed in custody, and assaulted the men, servants and bailiffs of the abbot, so that the abbot has scarcely any servant or bailiff who dares to go forth to execute his office, and for the maintenance of their ill-doing assessed of their own authority tallages upon the men of the town, as if the commonalty had been there and ought to be obedient to them, and, because certain men of the town neglected to assent thereto, made a public proclamation that no one should buy bread, ale or other victuals from them, and terrified others by levelling their houses, so that they made a fine with them.

June 28. Westminster.

Commission to William de Bourne, John de Erle and Nicholas de Wedergrave to view the state of the hospital of the Holy Trinity, Yvelcestre, co. Somerset. The king understands from divers complaints that the goods of the hospital set aside for the maintenance of the poor sisters thereof have been grossly wasted by John de Draycote, appointed as his deputy by Simon de Monte Acuto, to whom Master John Walewayn, king's clerk, escheator on this side Trent, is asserted to have committed the custody of the hospital by pretext of an inquisition taken by virtue of his office, by which it appeared that Alice de Chitterne, at the presentation of Nicholas de Boleville, son and heir of Nicholas de Boleville, tenant in chief of the late king, had been preferred to be prioress of the hospital, and because the said Nicholas had not proved his age and had not obtained seisin of his lands and tenements from the king, and also by Walter de Wouburne, to whom the king at the suggestion of the said John lately committed the custody, and whom afterwards, for certain reasons, he removed from it, and also by their accomplices. The commissioners are to enquire what goods have been removed by the said John de Draycote and Walter de Wouburne, and the value of the same, and whether the said Nicholas, the father, held of the late king or of any heir a minor in his custody, and whether, at the time of the presentation of the said Alice as prioress of the hospital, Nicholas the son was seised of the lands and tenements of his father, and what estate his ancestors had in the hospital in times of voidance, to return all goods so removed from the hospital which they shall find and to deliver them for the sustenance of the prioress and sisters, and to compel the said John and Walter and others, in whose hands such goods are found, to make restitution thereof.
