June 20. Indenture between Richard lord Beauchamp and Nicholas Hanley, gentleman of Hanley co. Worcester, whereby the parties have agreed, that where Nicholas sold to the said lord in fee the office of chief forester of Malverne Chace, and the manor of Halle co. Worcester, yet Nicholas by these presents grants that if the said lord shall make to him a sufficient estate in law of an annuity of 3l. 6s. 8d., arising out of Halle manor and other lands in Hanley, Wenland and Upton co. Worcester, besides an annuity of ten marks aforegranted to him and Margery his wife for term of their lives, at the hands of the bailiffs and farmers of the said manors etc. with clause of distraint for nonpayment of the same: in consideration of this Nicholas releases and quitclaims to the said lord all covenants and bargains between them before the date of these presents, and will deliver all covenants between the parties except the enrolment of the annuity to him and Margery his wife: and he will confess such actions and suits when required, and will maintain and avow the same in all courts, temporal and spiritual, such as he has made before the Star Chamber at Westminster, sealed with his own hand—to the effect that where Thomas Hanley and Roger Hanley allege that they had purchased of him the reversion of the chief forestership of Malverne Chace and Hall manor, he asserts that the contrary is true: but Thomas and Roger demanded the reversion of any lands that he might sell, despite his agreement with the said lord: and at Tewkesbury in presence of John Higford, they promised to discharge Nicholas against the said lord; pretending that John Higford whose daughter Anne the said Nicholas had married, was enfeoffed of certain lands of his called 'Yardeleys' to the value of ten marks, and therefore enfeoffed of the above manor of Halle and office: but Nicholas refused to deceive the said lord in this way and sent a surety to the lord and also to John Higford asserting that he never would agree to their desires without the lord's consent: and also he sent one John Scryvener to Bristol to find out whether Thomas and Roger were discharging him to the said lord or no. Yet they made a lease in his name and without his agreement, causing John Higford to seal the deed, with remainder after his death to the said Thomas and Roger, which lease deponent never saw: and when Roger came to him, he first refused to let him see the deed, but then threw it on the ground and departed, which deed read showed the disinheritance of Nicholas against all conscience. So Nicholas sent the same to Lord Beauchamp at Bristol: and the lord came home to Dodington manor: and there Nicholas, his wife and John Higford met and had great variance. And John sought to excuse his double dealing, admitting that he did not know whether he was enfeoffed of the manor, as he had no profit of it. And it was agreed that the lord should pay 40s. to John Higford and have deliverance of the evidence, which he did to John Bigge, esquire of the king's body, Richard Freywyne and John Skryvener: saving one deed, in which it was pretended that Nicholas had given to John the office and manor, which John Higford had forged, as he openly confessed before Thomas Abrigge serjeant: and Roger Hanley offered to Nicholas that he should go to sanctuary, and they would take his livelihood, and pay him a certain sum of money, until lord Beauchamp was entreated: which Nicholas most steadfastly refused to do. Given 4 June, 22 Edward IV, in presence of Hugh Standissh notary, Thomas Sutton, parson of S. Michael Quenehith, William Ponter, parson of S. Anthonyn's, Thomas Temper, parson of S. Alphege, Stephen Shadwell esquire, Thomas Parker 'iremonger,' John Dokkyng salter, citizens of London. English.
Deposition of Nicholas Hanley, that where Thomas and Roger Hanley priest pretended that he had enfeoffed John Higford of the office of chief forester of Malverne Chace etc., he declares upon the Evangelists before the lords of the Star Chamber that he has never made this enfeoffment: since he on his father's death entered into the said office as his son and heir, being seised therein in demesne as of fee: and so continued dwelling in the said manor of Halle and taking all rents of the same: making in his own name fines, amercements and cognisance of tenants, without interruption of John Higford or of others. And long time before the feigned enfeoffment he did homage for the manor to the late duke of Clarence, then lord of Hanley lordship, and paid his relief: and he did all other services and duties of the said office since his father's death till he made a bargain and sale thereof to Richard lord Beauchamp as appears by fine in the common place: and the said Nicholas for casualty of oath, has caused all his depositions and declarations on the premises to be made in this form. In witness whereof etc., 6 July, 22 Edward IV.
