Westminster.
To the warden of the Flete prison. Order to set free Philip Fitz Eustas, delivering him in bail to John Lestraunge of Norffolk knight and Reynold Sheffelde of Berkshire the younger; as he was impleaded for trespass before the justices of the Bench by William Clopton knight, was condemned in 20l., and was after outlawed in Suffolk at suit of the plaintiff for the same, committed to the said prison by virtue of a writ to the sheriff of Essex addressed, and is yet imprisoned there, wherefore on his behalf humble petition is made to the king for remedy, shewing that divers errors have crept into the record and process of the cause and into the publication of outlawry, as he is ready to prove, that he brought a writ of error returnable on the morrow of All Souls last, and that for particular causes with assent of the council all pleas pending before the king from a month after Michaelmas last to the octaves of St. Hilary are to that date adjourned, and that so he might not point out and prove the errors at the day named; and the said John and Reynold have mainperned in chancery to have him there on the morrow of the Purification next to be given up again to prison, and to stand to right according to law and the custom of the realm.
