William Lowe esquire, heir of Roger Lowe deceased, to Alan Mersshe of Kydermynster co. Worcester mercer and Margery his wife, their executors and assigns. Indenture of lease for 99 years with warranty of a seld in Kyderminster of him now held by the said Alan who dwells therein, by demise of the said Roger, grandfather of the lessor, taken by William Hert and the said Margery, lying between selds of the prior of 'Maydenbradley' and William Euerdoun and extending from the high street to a street behind them, at a yearly rent of 13s. 4d.; and covenant that about Michaelmas next the lessees shall make a new seld upon the place at their own cost, containing a seld below and a hall with chambers and other easements above as they shall see best for their own use, and shall maintain the same, and deliver it up in good repair at the end of that term, and that for five years the lessor shall allow them the whole rent, that is 5 marks for the making thereof, so that the first payment of the said rent shall be at Michaelmas 1446; and if after that time the rent shall be one whole year in arrear, or no sufficient distress may therein be found, it shall be lawful for the lessor, his heirs and assigns, again to enter and hold the said seld in his first estate, thrusting out the lessees and others whatsoever. Somerset, by virtue of an indenture tripartite (text follows), dated 2 January 19 Henry VI, reciting a charter dated 16 April 9 Henry VI, whereby the said Thomas gave the said manors to John Bremsshote esquire, John Dauvers, Robert Thurberne clerk, Thomas Brooke clerk and John Bruton clerk, and to Thomas le Straunge knight, John Wykeham clerk, William Poulet and John Barton the younger now deceased, their heirs and assigns, and witnessing a demise thereof by the surviving grantees to the said Eleanor, Alice and the others for ten years, for performance of the will of the said Thomas Wykeham, with reversion to him and the heirs male of his body, and for lack of such heirs to the heirs of his body, and for lack of such heirs to remain according to a fine levied in the king's court in 20 Richard II; and proviso that this warranty shall not extend to recovery of the value if those manors or any parcel thereof be recovered against the tenants, but only to bar William Wykeham and his heirs.
