Declaration by John Waspaill esquire of his will, that after his death, if he shall die without issue, and after the death of Joan his wife the manor of Herteleghwaspaill co. Southampton and a tenement there called Morenses shall remain to Hugh Pakenham for life, and that in recompense for a sum of 100 marks by him long ago received from the said Hugh, notwithstanding a charter dated 1 December 18 Henry VI, whereby the said John and Joan did make a feoffment in fee simple of the said manor and tenement to William Shirfelde, Hugh Pakenham, John Pakenham, Sir Adam Phellyng rector of Hertelegh Waspaill, Sir Thomas Hathy rector of 'Southwarneburgh,' Sir John Remes vicar of Odyam and Richard More of Rethirwike, who were thereof seised with attornment of all tenants there, and notwithstanding letters patent of 12 December that year whereby the said John and Joan did declare their will touching that feoffment. Witnesses: Master William Crowton, Master John Pakenham and Master Richard More. Dated 17 November 24 Henry VI, on which date John Waspaill did in presence of those witnesses before Master John Bate clerk of the petty bag cause this writing to be enrolled and exemplified, and did procure a notarial instrument thereupon to be drawn by Master William Crowton canon of the cathedral church of Salisbury and notary public.
