To the abbess and convent of St. Mary Winchester. Nomination of William Bolton of the chancery to receive the pension wherein by reason of the new creation of the abbess they are bound to one of the king's clerks, until by them provided with a benefice. By K., and the date etc.

Declaration of Piers Garneys of Becclis esquire, late 'servitour' of King Henry V, that he and his father before him were seised of a manor called 'Jeraldys' in Becclis otherwise Roses manor with a hill 'lyeng by' called Jeraldys Hyl and a little pasture adjoining, of which hill and pasture he, his father and all others whose estate he has, have been seised as parcel of the said manor 'wyth oute the tyme of mynde' and have taken the profits thereof; that he enfeoffed thereof lord Suffolk, sir John Hevenyngham and others in trust to perform his will; that since the enfeoffment certain persons of Becclis, not his 'welwyllers,' of malice 'confedered' more of the town to them, and in his absence came to the hill and hewed, cut up and bore away broom and brakes growing there, saying openly with great cry and clamour: 'This is oure comown'; that thereupon he took 'an oyer and determyner' against them that his counsel gave him; that when they could not justify their deed, they declared that it was the proper and several ground of the house of Bury as appurtenant to the lordship of Becclis, and informed dan William Babyngton, late 'chaumberer' of the house and now abbot, to which office of 'chaumberer' the town and lordship are annexed, that the hill with the said pasture between the same and the gates of Garneys' manor was appurtenant to the 'chaumberer's' manor, 'which were unlike to any resonable mannes discrecyon,' and they required him to sue for it and to the discharge of their riot, so that dan William Babyngton 'wyth the supportacon of myghti lordship' took an assize against Garneys, and had a panel and the country ready before Garneys had knowledge thereof, so that at the assizes he and his heirs were like to have been disinherited; he then, being of a great age and feebleness of spirit and unable to get counsel, 'offred tretees' that their titles might be examined by their 'bothers councel' and surety made to abide by the award of the abbot of Bury, so that Garneys might be warned to have counsel to declare his title; that he came to Bury to have a day assigned to have his counsel inform the abbot of his title, but he could get no longer day 'but at that same tyme'; and so, having no counsel there 'but such as were toward the hous' they threatened that they would make him lose 100l. in damages and expenses; whereat being disconsolate he was ruled to take the hill and pasture to farm under his seal, against right and conscience as far as he could know; wherefore he beseeches his feoffees who were enfeoffed in trust long before his disturbance, and all other good lords, masters and friends, to help and remedy this disturbance, to which he only consented by duress and feebleness of wit and spirit, and thus without 'advisement,' and never attorned nor put them in possession of that hill and pasture. John Stoke abbot of the exempt monastery of St. Albans co. Hertford and the convent to Alice Marchexan widow, her executors and assigns. Writing indented, being a grant for 200l. beforehand paid of a yearly rent of 20l. for a term of ten years from the Annunciation next, payable in the church of St. Nicholas Acon by 'Lombardstrete' London, with power to distrain for arrears in all their manors, lands etc. in Hertfordshire; covenants to pay 10l. in name of a pain if the same be two months in arrear, with like power to distrain for such pain, not to allege any acquittance, release, payment or discharge of rent or pain or of the 200l. bearing date elsewhere than in the said church, and that any so alleged or pleaded shall be void; and bond in 200l. to perform these covenants. Will of John Squery esquire, that all persons enfeoffed to his use or the use of Thomas Squery his father or of their ancestors in the manors, lands etc. in Suthcourt, Westwikham, Bekenham and Fryth or any parcel thereof shall make sufficient estate or release unto John Trevilian esquire and to his heirs, or to such persons as are enfeoffed to their use; that all deeds, evidences etc. touching the said manors, lands etc. wheresoever they may be shall be delivered unto John Trevilian or to whomsoever he may assign, since he has bought the same lands.
