Douryssh the younger. Recognisance for 400 marks, to be

Condition, that whensoever the said Osmund and Peter and
Joan wife of the said Peter shall by prosecuting a writ of formedon
in descendere recover the manor of Westwoggewyll co. Devon
or any parcel thereof against Thomas Douryssh the younger and
Margaret his wife, they shall within three months, and before
making an estate thereof to any man, make an estate by writing
indented to the said Thomas and Margaret for life of the said
Margaret without impeachment of waste, and discharged of all
charges, rents and services save those with which the same was
charged before such recovery, shall after, when required, within
one quarter of a year make a grant thereof to the said Thomas
and Margaret during her life as aforesaid by fine levied and
engrossed in the king's court at the cost of those grantees, until
that be done shall suffer them peaceably to take all issues and
profits thereof to their own use, and in case they choose at the
day named in the writ of magnum cape issuing upon the original
writ to plead in bar of such recovery, shall waive their default
at the day named in the original writ, and suffer them so to
plead. |

Condition, that if the said Osmund, Peter and Joan shall by
any writ of the king or by other lawful means recover the manor
of Skyrydon co. Devon or any parcel thereof against any having
an estate of freehold therein, or against those who take the profits
thereof, they shall at the cost of the said Thomas and Margaret,
within three months and before making an estate thereof to any
man, make to the said Thomas and Margaret a good estate in
law, as by the counsel of the said Thomas shall be advised,
of a yearly rent of 8 marks thence issuing during the said Margaret's life, discharged of all charges, rents and services save such
as the same was charged with before such recovery, and from the
time of such recovery until that be done shall suffer the said
Thomas and Margaret to take to their own use the issues and
profits of the manor; and proviso that the said Osmund, Peter
and Joan shall not be charged nor troubled by writ of annuity
by reason of such grant. |

Condition, that on the day the said Osmund, Peter and Joan
his wife shall obtain an original writ of formedon in descendere
against them, to be prosecuted at Westminster on 21 May next
and returned in the quinzaine of Trinity next, Thomas Douryssh
and Margaret his wife shall be sole tenants of the freehold of
all the shares of the manor of Westwoggewyll whereof they
were ever seised in her right, that they shall that day make
default, and at the day named in the writ of magnum cape shall
again make default, or else shall appear and plead in bar of the
action, and shall await the issue so joined and tried without
challenge of the jury or any of the jurors, appearing from day to
day without delay until the jury be passed. |

Thomas, by name of Walter Reynold of Malston and Thomas
Gille of Nitheway, both co. Devon esquires, with William Denys
of Combe Ralegh co. Devon, John Skelton in (sic) Surrey esquires
and with the said Osmund and Peter made a recognisance in
chancery for 400 marks to Thomas Douryssh the younger under
divers conditions therein specified, the said Osmund, Peter and
Joan wife of the said Peter shall fulfil those conditions toward
Thomas Douryssh and Margaret his wife, and shall save the said
Walter and Thomas Gille harmless toward them. |

with all lands etc. thereto pertaining; also the whole messuage
there called 'Mille place' and the moiety of the mill late in the
tenure of Richard Forster and Joan his wife, a ferling of land
and meadow adjacent, a messuage there in 'Playstrete' called
