Dec. 7.

To the sheriff of Essex. Writ of supersedeas, and order by mainprise of Thomas Melreth, Stephen Ignelflet, William Burgh and Richard Wylly of Essex to set free William atte Hyde, John Baroun, William Clere of Tollesbury and Richard Hevede, if taken at suit of John de Boys for trespass.

John de Rokwyke abbot of St. Mary Jorevalle of the Cistercian order in the diocese of York and the convent of the one part and Thomas More clerk and John Carleton archdeacon of Colcestre of the other part. Indenture tripartite, reciting indentures whereby the abbot and convent granted to the said Thomas for life a yearly rent of 160 marks, to be taken a month after Michaelmas during the life of the archdeacon and after his decease a month after Easter and a month after Michaelmas by even portions, and other indentures whereby they granted a yearly rent of 80 marks to the archdeacon for his life with remainder to the said Thomas for life if the archdeacon should die in his life time, and witnessing an agreement between the parties that, whensoever the abbot or his successors shall be impleaded concerning either rent, and shall be summoned at fifteen days' notice, they shall without delay acknowledge the action both of the said Thomas and the archdeacon, so that the said Thomas may have judgement to obtain both rents, and the archdeacon to obtain the rent of 80 marks, and the abbot and convent hereby covenant that, if the said Thomas shall die before or after the month after Michaelmas next, they shall be bound within a quarter of a year after his decease to content his executors of a proportion of the rent of 160 marks for the term next after his decease, and if he shall overlive the archdeacon and die before or after a month after Easter next, they confess that they are bound to content his executors of a proportional part of the rent of 80 marks; and whereas by divers indentures they granted power to distrain by the grantees, their assigns and deputies, for either rent in their lands whatsoever in any parts of England, they hereby covenant that although any such recoveries of either be made, they and their successors shall by writings thenceforward made after judgment rendered grant like powers, with such a clause that the said Thomas and the archdeacon may have the benefit of distress or execution so often as they please until fully contented of the arrears; and payment shall be made to the said Thomas by the abbot and convent at London in the cathedral church of St. Paul at their own cost, and to the archdeacon all his life at Blithe co. Notyngham, and the abbot has made oath upon the gospels to keep all covenants herein and in the indentures granting the said rents, and all the monks shall make a like oath to lend their aid and power to the fulfilment thereof, saving their obedience, and every abbot in time to come shall be so sworn in presence of one or more to be deputed by the said Thomas, and after his death by the arch deacon, none of them purchasing a discharge of such oath; and the abbot and convent shall cause all writings and indentures which concern the matters aforesaid to be sealed anew in full chapter, and shall at the cost of the said Thomas and the archdeacon acknowledge the same as their act and deed before a trustworthy man having power by dedimus potestatem to receive such acknowledgment; and moreover if either rent shall be in arrear one quarter of a year, or the proportional part unpaid one quarter of a year after the decease of the said Thomas, or any other covenants be unfulfilled, the abbot and convent grant to the said Thomas for life a yearly rent of 20l. thenceforward to be taken of their manors of Ryswyke, Aykebergh, Heselton, Fyngale and Tunstall co. York, with remainder to the archdeacon for life, and power to distrain in the lands of the abbot and convent whatsoever within the realm. Dated 30 October 1398, 22 Richard II.

Brother Richard Alrede, general master of the hospital of St. Thomas the Martyr of Canterbury called of Acoun London in all parts of the world whatsoever, and the brethren his fellows, with deliberate consent of the chapter, to John de Wakerynge clerk. Grant for life, for money by him paid to the use and great profit of the house, of a yearly pension or rent of 10l., to be taken of their house and of all houses, lands and rents in the city and suburbs of London and elsewhere within the realm which they have or their successors shall have hereafter, and payable in the said church of St. Thomas; and they have put him in possession thereof by payment of 12d. at the making of these presents. Dated the chapter house of St. Thomas aforesaid, London, 24 November 1398, 22 Richard II.

Memorandum of a mainprise under a pain of 100l., made in chancery 29 November this year by James Billyngford, Thomas Lexham and John Drake of Norffolk and William Saxy of Essex for Master Henry Wynterton, that he shall not repair to any foreign parts, nor by himself or others make any attempt or suit, or cause any to be made, which may tend to prejudice of the king or to impair the laws and ordinances of the realm or the rights of the crown.

To the treasurer and the barons of the exchequer. Writ of supersedeas omnino in respect of any proceedings against Joan who was wife and is executrix of William de Holme, or John de Holme son and heir of the said William, appointed with others a justice to survey the walls, dikes, gutters, sewers, bridges, causeways, weirs and leats upon the shore of the river Humbre in the parts of Holdernesse co. York, and the floods and leats of fresh water flowing down to the sea there in divers places, to make inquisition by knights and good men of Yorkshire by whose default damage has there happened, who have lands or common of pasture or fishery, or have or may have protection and advantage by such walls etc. or damage by such leats, and with the bailiffs of liberties and other places there to distrain them all in proportion to their lands and common to repair and when need be to new make such walls etc., and scour and if need be stop up such leats, but order to proceed against others who did meddle therein; as that commission was not delivered to the said William, as the said John has made oath in chancery.

To the treasurer and the barons of the exchequer. Writ of supersedeas, upon petition of John Russell the king's knight, in respect of any process against him to answer yearly for the surplus hereinafter mentioned or aught else in his grant contained, and of their demand upon the now escheator in Worcestershire to account or answer for any matter therein contained since 28 September 21 Richard II, and order from that date to discharge John Russell, the escheator and others whatsoever; as Thomas father of Thomas late earl of Warrewyk demised to farm to the abbot and convent of Pershore for a term of years a mill called 'Abblewellemulle' co. Worcester with the pond, water and fishery, rendering 26s. 8d. a year and a rent of 12 quarters of corn, and the reversion and rent descended to the late earl as his son and heir, and he granted that reversion with the rent, the manor of Wyke in Wyke co. Worcester, a parcel of land in Hulle within the parish of Fladbury, and divers rents in More, Pydele, Pershore, Wyke, Great Comberton, Little Comberton, Brythlamton and Strengesham to John Athereston his bastard brother for life, rendering yearly 4l. 12s., and by reason of a judgment against the late earl rendered in the parliament holden at Westminster on Monday after the Exaltation of Holy Cross 21 Richard II the rent of 4l. 12s. with the reversion of the said manor, lands, rents, mill etc. and all profits and appurtenances are forfeit to the king, and by letters patent of the great seal, dated Westminster 28 September aforesaid, the king gave the said rent, reversions and profits to the said John Russell, his heirs and assigns, in recompense for 25 marks a year to him promised by the king for life, over and above 50l. which he before had for life by grant of the king, the said reversions and other profits and appurtenances exceeding not the value of 11l. a year, as the king has learned, over and above the said rent payable to the late earl and 102s. a year which shall be paid to the abbot and convent of Westminster, with proviso that if with the rent payable to the late earl the same should exceed the value of 15l. 12s. he should answer for the surplus at the exchequer; and now by complaint of John Russell the king has learned that, although on the same day he gave up those letters patent in chancery to be cancelled, the king sent the tenor thereof to the treasurer and the barons among the estreats of chancery that execution might be made as if they were not given up, and that they are purposed unlawfully to charge him with the surplus.
Robert de Chesthunte otherwise Fauconer, son and heir of Edmund de Chesthunte one of the late king's falconers, to John Walden esquire, Thomas Wisebeche, William Bulcot and Richard Scot clerks, their heirs and assigns. Quitclaim with warranty of a manor called 'le Bruses' in Totynham which came to the said Robert by inheritance after his father's death, and which by name of 'le Bruses' in Totenham the said Edmund had by grant of the late king for his life, and after, by letters patent of that king dated 30 November 50 Edward III, to him and his heirs, the same being in possession of John Walden and the others by the said Robert's charter of Tuesday before the Nativity of the Virgin 21 Richard II. Dated 6 December 22 Richard II.
