To the provost of St. Salvator's in the diocese of St. Andrews and the official of St. Andrews. Mandate as below. The recent petition of Margaret, damsel, relict of William de Murray of Tulibardyn, layman, exhibited to the pope in the names of herself and her and the said William's children, her wards of the diocese of Dunblane, contained that (fn. 3) she brought before Robert bishop of Dunblane, not by papal delegation, the late Andrew de Murray, provost of Methsen (sic) and John de Murray, layman, of the same diocese, brothers of the said William and executors of his will, in order that they might be compelled to show according to custom the said will, and to give and deliver to her the portion belonging to her and the said children (liberos) of the goods left by the said William, and that they should not be admitted to render account of the said goods nor have their account approved until they had given and delivered the said portion; that although the said bishop decreed that the will ought to be judicially shown, nevertheless he unjustly refused to cause the division of the said goods to be made and the portion belonging to Margaret and her children (liberos) to be given and assigned, and absolved the said John (Andrew, the other executor having died) from prosecution by Margaret, wherefore she has appealed to the apostolic see, and has petitioned for the commission of the cause of the appeal and of the principal matter to some honest (probis) men in those parts. The pope therefore orders the above two to summon the said surviving executor John and other concerned, hear both sides, and decide what is just without appeal, causing their decision to be observed by ecclesiastical censure. To the prior (fn. 4) of St. Mary's, Dungebhin, in the diocese of Derry (Deren.), and the dean and the archdeacon of Derry. Mandate (at the recent petition of Patrick Oceanndaela, priest, of the diocese of Derry, containing that on the voidance of the perpetual vicarage of the parish church of Bothmeba in the said diocese, because Magonius Machbloschayd, having obtained possession by canonical collation, held it for more than a year without having himself ordained priest and without dispensation, John bishop of Derry made collation and provision of it, thus void, by his ordinary authority to the said Patrick, who in virtue thereof obtained possession and at present holds it, but now doubts whether the said collation and provision hold good) to collate and assign to him the said vicarage, value not exceeding 3 marks sterling. To William abbot of St. John the Evangelist's, Tuam, residing in the Roman court, and Nemeas Odroma, canon of Kilmore. Mandate as below. The recent petition of Donald Yconnyn, priest, of the diocese of Killaloe (Laonien.), contained that after Martin V and Eugenius IV's renewal of sentences of excommunication etc. promulgated by their predecessors against simoniacs, and their reservation to themselves and their successors of absolution therefrom, on the voidance of the perpetual vicarage of the parish church of Tulachnaneasbug in the said diocese by the death of Nicholas Osyda, the said Donald simoniacally gave two horses to Donatus bishop of Killaloe, in order that the bishop might make provision to him of the said vicarage, after which gift the said bishop made him collation and provision thereof by his ordinary authority, (fn. 6) under pretext of which he took possession and at present holds it, taking the fruits for about eight years, thereby incurring the said sentences etc.; and that he afterwards promised and swore to pay to a number of clerks or lettered persons, nobles, who were persecuting (infestabant) him in regard to the said vicarage, in order to buy off their vexations, certain pensions, which for several years he unduly paid out of the fruits of the said church. The said collation and provision being therefore without force, and the vicarage being still void as above, the pope hereby orders the above two to absolve Donald from the sentences etc. incurred on account of the foregoing, enjoining penance, dispense him on account of any irregularity contracted, and rehabilitate him, relax the said oath, and decree that he is not bound to observe it, inhibiting the said nobles to vex him in future in regard to the said pensions, and moreover, in the event of their doing so, to collate and assign the vicarage, value not exceeding 16 marks sterling, to Donald, whether it be void as above, or because the late Denis Maconmara did not have himself ordained priest, without dispensation, or whether it be void in any other way.
