To James Inglis, perpetual vicar of the parish church of Leiartuod in the diocese of St. Andrews, M.A. Dispensation to him, who is a priest and is of noble birth by both parents, and holds the said vicarage and a perpetual chaplaincy without cure at the altar of St. Ninian (sancti Miniani [sic]) situate in the parish church of St. Giles, Edinburgh, in the same diocese, value not exceeding 7l. and 3l. sterling respectively, to receive with the said vicarage any other benefice, or if he resign the said vicarage any two other benefices, with cure or otherwise incompatible, even if two parish churches or their perpetual vicarages, or dignities etc., even if major or principal dignities, or such mixed, and to retain them together for five years only, if parish churches or perpetual vicarages, or for life if other incompatible benefices, and resign them, simply or for exchange, as often as he pleases, etc. Nobilitas generis, litterarum sciencia, vite etc. (P. and A. de Cortesiis. | P.xxxv. de Varris.) To Patrick Graym, (fn. 2) elect of Brechin. Faculty to him, to whom the pope recently (pridem) made provision of the said church, to be consecrated by any catholic bishop of his choice, assisted by two or three like bishops, and for such bishop to consecrate him, after first receiving from him the usual oath of fealty according to the form appended. If such bishop presume to consecrate him without having received such oath, etc., such bishop shall be suspended from the exercise of the pontifical office, and both he and Patrick from the administration of their churches; and Patrick is to send to the pope by his own envoy as soon as possible the said oath by his letters patent sealed with his seal. To the abbot of the monastery of Neubottil in the diocese of St. Andrews. Mandate to receive and admit by papal authority, for this turn only, the proposed resignation by Thomas Witheman, perpetual vicar of the parish church of Lyntermireneryk in the diocese of Glasgow, of that vicarage, and to collate and assign it, value not exceeding 30l. sterling, to Robert de Prestorun (? recte Prestown), priest, of the diocese of St. Andrews, and moreover to reserve and assign to Thomas a yearly pension for life of a third of the fruits etc. thereof, to be paid by the said Robert and his successors in places and at times to be fixed by the said abbot with consent of the parties. Dispensation to him, who is a priest, to receive and retain for life any benefice with or without cure wont to be governed by secular clerks, even if a parish church or its perpetual vicarage or a chantry, annual service, free chapel or hospital, and if of the patronage of laymen, and to resign it, simply or for exchange, as often as he pleases. To the treasurer of Killaloe (Laonien.), and Donatus Meccrach and Thady Olachnayn. canons of the same. Mandate as below. It has been recently set forth to the pope on behalf of Malachy Omullachnan, priest, of the diocese of Killaloe, that although Nicholas V ordered the perpetual vicarage of the parish church of Kyllmanyn in the said diocese to be united and appropriated to the Augustinian monastery of Tamdonayn. wont to be governed by a warden (per custodem), in virtue of which the warden and convent obtained possession and have since held it, and hold it at present, the said pope's will being that it should not be defrauded of its due services nor the cure of souls in it neglected, nevertheless, in consequence of the neglect of the said warden and convent, the said church has been almost brought to ruin, divine worship is not celebrated therein as it ought to be, the cure of souls of the parishioners is abandoned, and many of them have died without confession [and] the sacraments of Eucharist and Extreme Unction. (fn. 4) The pope therefore orders the above three to summon the said warden and convent and others concerned, and if they find the foregoing to be true, to dissolve the said union and appropriation, and in that event to collate and assign the said vicarage, value not exceeding 3 marks sterling, to Malachy; whether it be void by such dissolution, or by the deprivation of Thady Mochonyn without the Roman court, or be void in any other way.   • 1. On the back of the volume is the usual modern description in Italian: ‘Pio ii. 1463. Anno 5. Lib. 3,’ and on a modern flyleaf is Mgr. Wenzel's ‘An. 5. to. 14.’ There is no contemporary flyleaf, but the usual contemporary description occurs on the bottom edge of the volume, viz.: ‘Tertius de diversis anno quinto domini nostri domini Pii pape secundi.’ F. i. is headed ‘de provisionibus prelatorum [anno] v,’ but the words ‘provisionibus prelatorum’ are cancelled, and above them is substituted a word which is almost cut off by the binder, but is evidently ‘diversis.’ The heading ‘de diversis v’ occurs also on f. 26, again half cut off by the binder. There are i–cccxii. ff. of text.
  • 2. The surname ‘Graym’ is added in the margin and subscribed P. [de Varris].
